Dr. Ladyman: To ask the Minister of Agriculture, Fisheries and Food what was the outcome of the Fisheries Council held in Brussels
on 24 March; and if he will make a statement. [36569]
Dr. John Cunningham: I chaired the meeting of the Fisheries Council in Brussels on 24 March. My hon. Friend the Parliamentary
Secretary, represented the United Kingdom together with my noble friend the Under-Secretary of State at the Scottish Office, Lord
Sewel.
The Council discussed the introduction of a ban on high seas drift nets. Views were divided. The UK, with a majority of other Member
States, argued for the phasing out of such nets because of the by-catch problems associated with them, particularly by-catches of
dolphins. Several Ministers opposed a ban. However, at the end of the discussion I was able to conclude that there was an
expectation that there will be a qualified majority in support of a ban. This helps clear the way for a formal agreement before the
end of June. In the meantime, the European Commission will prepare measures such as decommissioning or conversion, to be applied
within existing funding provisions, for fishermen affected by the ending of drift netting for tuna, swordfish and other high seas
species.
The Council agreed by qualified majority, with Belgium voting against, new total allowable catches (TACs) and quotas for the North
Sea. The six new TACs will help to conserve stocks by extending the quota system to cover anglerfish, megrim, skates and rays,
turbot and brill, dab and flounder, lemon sole and witch. The new TACs are precautionary and national quotas are based on historic
catches, so confirming large UK shares.
Political agreement was reached, with the Netherlands dissenting, on a measure to rationalise by-catch limits for herring in
industrial fisheries for other species and to limit industrial fishing for herring to part of the Baltic Sea. No other herring may
be used for industrial purposes unless it is first offered for sale for human consumption and fails to find a buyer. Taken together,
these measures should help to conserve sensitive herring stocks.
The European Commission presented a report reviewing the operation of fisheries monitoring under the Common Fisheries Policy (CFP)
and drawing attention to areas where enforcement needs to be strengthened by means of a 3-year action plan. In an orientation
debate, the UK supported the introduction of new measures to achieve more effective and more consistent fisheries enforcement. As
chairman, I was able to conclude that there was general support for improved enforcement and the Council welcomed the Commission's
intention to come forward rapidly with concrete proposals. The Council will return to the subject at its next meeting.
The Council unanimously agreed conclusions welcoming pilot regional meetings held during 1997 and calling for the initiative to be
developed and extended in 1998. These regional meetings contribute to the UK's objective of increasing the involvement of fishermen
in CFP discussions and developing the regional dimension of the CFP.
Finally, the Council unanimously agreed, with Spain abstaining, autonomous tariff quotas for imports of fish products in 1998.

Dr. John Cunningham: Footnote 4 to the table in Commission Decision 98/121/EC, approving the new MAGP IV objectives for the fishing
fleet of the Netherlands, refers to compensation for a decrease in efficiency resulting from a reduction in beam length. I
understand that this reflects the outcome of discussions between the Commission and the Netherlands about the Dutch MAGP III
figures. Similar discussions took place about certain aspects of the UK MAGP III figures, which also resulted in adjustments in MAGP
IV though these did not cover the question of beam length in our case. I am not aware of any other adjustments relating to beam
length for any other Member State.

Dr. John Cunningham: The legal obligation to reduce fishing effort by the UK fleet is contained in Commission Decision 98/124/EC
which in turn is based on Council Decision 97/413/EC. As with management of catch quotas, the rules under which effort allocations
have been made to producers' organisations are administrative and have been drawn up after full consultation with industry
representatives. Any action to prevent further fishing by members of a producers' organisation which has exceeded its effort
allocation will be taken by a licence variation under Section 4 of the Sea Fish Conservation Act 1967.

Dr. John Cunningham: As the Parliamentary Secretary, my hon. Friend the Member for Scunthorpe (Mr. Morley), has already made clear,
the Government's preference is for controls on fishing effort to be managed by the industry itself, along the lines of existing
quota management arrangements. Following discussions with industry representatives the available fishing effort in the pelagic and
beam trawl segments has accordingly been allocated between the various producers' organisations (POs) and groups concerned. They
have been invited to manage their uptake of effort to stay within these allocations on whatever basis they and their members
consider appropriate. The Government are not seeking to impose any particular formula for this and are not making any allocations of
effort to individual vessels. POs and groups will therefore have the flexibility to respond to local circumstances and, within their
allocations, to take account of any special factors affecting particular members.

Commission, which has recently instigated infraction proceedings against the Italian Authorities for their failure to collect
super-levy from over-quota producers.

ensuring that all British registered fishing vessels maintain a real economic link with those populations in the UK dependent upon
fisheries and related industries. Those proposals are based on a consultation paper issued in July 1997 and subsequent discussions
with all sectors of the fishing industry. Once the Commission's views are known, an announcement will be made on the way forward.

Dr. John Cunningham: The scientists concerned were staff of the Centre for Environment, Fisheries and Aquaculture Science and I have
asked the Agency's Chief Executive to reply to the right hon. Member direct.
Letter from P. W. Greig-Smith to Mr. Michael Jack, dated 21 November 1997:
Dr. Cunningham has asked me to respond your Parliamentary Question concerning information given by this Department's Scientists to
the representatives of the Fishing Industry on 13 November.[17285]
I would advise that the International Council for Exploration of the Sea's Advisory Committee on Fishery Management (ACFM) met from
22-31 October. At this meeting, ACFM prepared advice for the management of many of the commercial fish stocks important to the UK.
Dr. J. Horwood (CEFAS) was the UK representative and Dr. R. Cook (FRS, Aberdeen) also attended.
On 13 November CEFAS scientists gave representatives of the fishing industry their summary of the expected ACFM advice. The attached
table was handed to the industry. The final column is CEFAS' interpretation of the ACFM advice for catch limits in 1998. As was
explained to the industry, these figures should be used with some caution. They are based upon the latest draft of the ACFM advice,
and the figures are subject to change.
The final ACFM report is expected very soon.

Dr. John Cunningham: The scientists of the Ministry's agency, the Centre for Environment, Fisheries and Aquaculture Science, monitor
fish stocks in order to contribute to the annual assessments made by the International Council for the Exploration of the Sea
(ICES). The 1997 ICES' assessments are expected to be published shortly.

Ms Shipley: To ask the Minister of Agriculture, Fisheries and Food what was the outcome of the Agriculture Councils held on 22 and
23 September in Brussels and on 20 and 21 October in Luxembourg; and if he will make a statement. [13295]
Dr. Jack Cunningham: I represented the United Kingdom at meetings of the European Union Agriculture Council on 22-23 September and
20-21 October. I was accompanied at the October Council by the Parliamentary Under-Secretary of State at the Scottish Office, Lord
Sewel.
At the September Council, EU Agriculture Ministers followed up their informal discussions of early September on the Commission's
proposals to reform the common agricultural policy which have been made as part of Agenda 2000. On this occasion, discussion focused
in particular on rural development, environmental and structural policy. Member states reaffirmed the importance of an active rural
development policy to assist the transformation of European agriculture; there were however differences of view in the Council on
the funding of rural and structural measures in the future. I stressed the importance to the United Kingdom of setting the proposals
on rural development clearly in the context of changes to the market mechanisms of the CAP, on which the Commission's Agenda 2000
proposals represented an important first step. I also emphasised the need to foster alternative rural enterprises as the source of
new employment possibilities in the countryside in the future.
The Council of Ministers also heard reports from the Commission on progress in negotiations on veterinary and plant health
equivalence agreements with third countries; and noted the Commission's intention to lodge an appeal in the WTO dispute concerning
hormones in beef. In a brief discussion of BSE, I reported to the Council the steps I have taken in the United Kingdom, both
legislative and administrative, to tighten up our measures to counter illegal exports of beef and beef products from the UK. These
were welcomed in the Council.
I pressed the Commissioner and the Presidency to provide an early opportunity for the Council to discuss the present state of the
beef market, on a basis of the Commission's promised report, to decide whether the short term market adjustment schemes agreed in
1996 were working effectively.
I also raised in the Council the UK's serious concerns about the impact of the recent WTO Appellate body ruling on the EU bananas
regime in so far as its affects access by ACP Caribbean banana producers to EU markets. I urged the Commission to reach a rapid and
equitable solution to the problems flowing from the WTO ruling which would not only respect WTO obligations but would allow the EU
to meet its commitments to the ACP and in particular on Caribbean trading partners under the Lone Agreement.
At the October Agriculture Council, discussion concentrated on the market reform proposals contained in Agenda 2000. I argued for
the removal of production controls in the form of quotas and compulsory set aside and for a lowering of support levels to bring EU
prices closer to world market prices and that transitional arrangements should begin soon. The Council will resume its discussion on
this crucial issue in November. A letter from the President of the Agriculture Council to the President of the European Council on
employment policy in rural areas was approved by Ministers.
In a debate on the Commission's report on the beef and veal markets, I expressed doubts about the efficacy of the early marketing
scheme for veal in reducing production on the EU market, and urged the Commission to make a further cut in the premium paid under
the calf processing scheme. The Council reached political agreement upon changes to the system of support for producers of durum
wheat. Under the compromise which was agreed by qualified majority (Greece, Sweden and Denmark opposing), the additional aid paid
for durum wheat in traditional producing areas was reduced, and the maximum area eligible for aid in each member state determined.
Five thousand hectares will be eligible in the United Kingdom.
The Council discussed the Commission's green paper on the general principles of food law in the EU, in which I emphasised the UK
Government's commitment to attaining very high levels of food safety. The Council also took note of Commission reports on genetic
resources, BSE, and the state of play on veterinary and plant health negotiations with their countries.

Dr. Jack Cunningham: Reforming the CAP dairy regime and its system of milk quotas is a high priority for the Government. I shall
continue to press in the Agriculture Council for cuts in support prices and the removal of quotas, to be accompanied by time
limited, degressive and non-discriminatory aid payments to dairy farmers, decoupled from production, in order to facilitate
adjustment to these reforms.

Mr. Savidge: To ask the Minster of Agriculture, Fisheries and Food what measures the Government intends to introduce to ensure that
United Kingdom-registered fishing vessels comply with the law; and if he will make a statement. [4296]
Dr. John Cunningham: The Government propose to take a range of initiatives designed to ensure that all fishing vessels in the UK
abide by the rules.
The Fisheries Departments will continue to give priority to fair and effective enforcement. In 1997-98 some £24 million will be
spent on enforcement, including surface and aerial surveillance. We are determined to bear down on those who disregard the law. If
fish stocks are to be conserved fisheries regulations must be respected.
We have considered whether the existing conditions of fishing licences need to be strengthened to assist enforcement. A matter of
particular concern is the practice of allegedly discarding, after inspection at sea but prior to landing, marketable fish which have
been sorted, stowed on board and recorded in EC logbooks. This practice appears to be used to evade the proper operation of quotas
and is inconsistent with the conservation of fish stocks. Subject to consultation with the Commission and our fishing industry, we
propose to introduce as soon as possible a new licence condition which addresses this problem.
The Registrar General of Shipping and Seamen has powers to terminate a fishing vessel's registration if, taking into account any
requirement of merchant shipping legislation relevant to its safety or that of its crew, he considers that it would be inappropriate
for the vessel to remain registered. In the interests of safety, it is proposed that the Registrar General will serve notice of the
intention to terminate the registration of any fishing vessel which fails to hold a valid safety certificate.
In addition, we shall be making arrangements for British Sea Fishery Officers to assist the Department of Transport by detaining in
port fishing vessels which do not have valid fishing vessel safety certificates, as well as checking that fishing vessels are manned
by crew holding the appropriate certificates, including UK Certificates of Equivalent Competency (CECs) in the case of foreign
qualified crew.
Finally, the Department of Transport and Fisheries Departments have reviewed the requirements for masters and officers of larger
fishing vessels to be competent in the use of English. It has been concluded that these provisions are adequate. Certificates of
competency, including CECs, already require a sound knowledge of English. The more rigorous checking of officers' certificates will
help to ensure that these requirements are properly complied within the interests of safety.
