The Information Commissioner's Office (ICO) is independent of Government and is responsible for deciding how Freedom of Information Act complaints are prioritised, investigated and resolved. Whilst DCMS sponsors the ICO, government policy for Freedom of Information sits with the Cabinet Office.
The Department does not hold the operational information requested. The ICO publishes information about its performance and case-handling activity on its website and reports annually to Parliament on its approach to complaints and investigations.

The Information Commissioner's Office submitted a Spending Review bid as part of the Government's Spending Review process. The Government considers bids from a range of its arms length bodies. Final funding allocations have been determined through the Spending Review process and details of settlements are announced through the usual government channels. The Government does not routinely publish details of individual funding bids submitted as part of Spending Review discussions.

The ICO is responsible for its own staffing, pay and operational decisions. It is an independent regulator accountable to Parliament.
The ICO does not pay bonuses and there have not been any recent changes to pay arrangements linked to the ICO's Equality, Diversity and Inclusion objectives. Since 2024, the ICO's Career Banding framework, which is the mechanism through which staff can access in-grade promotion, has been linked to the ICO’s values, one of which is inclusion.

Departmental officials are engaged with the Information Commissioner’s Office regarding the development of the EdTech and AI codes, including scope and interaction with other initiatives, such as proposals for a safety certification scheme for EdTech and AI.
The department continuously monitors the emerging implications of AI on education, including its use by pupils and teachers.

The data protection fees fund the ICO's statutory responsibilities under data protection and privacy and electronic communications legislation. There are three levels of fee payable based on organisational size. Micro organisations, including sole traders, fall within the lowest tier and are required to pay £52 annually, or £47 if payment is made by direct debit. Around 90% (circa 1.1 million) of fee payers sit in this tier.
The ICO plays a vital role in helping all data controllers, including the smallest businesses, meet their data protection obligations. Sustainable funding is essential to ensuring that the ICO can maintain and expand its support for smaller organisations, delivering greater regulatory certainty, lower compliance costs and better value for money.
The government considers that the current fees are proportionate, with the smallest data controllers paying a modest amount. The government will keep the Funding Regulations, including fee levels and the scope of existing exemptions, under review to ensure they remain fit for purpose.

The ICO regularly promotes the requirement for eligible businesses to register and pay the data protection fee. This includes using publicly available company information to send 800,000 letters annually to prompt organisations who may be required to pay. They also regularly look for new and innovative ways or alternative datasets to reach businesses who may be required to pay.
It is important to note that not all businesses are required to register and pay the fee with the ICO, and registration is not a reflection of wider data protection compliance. Irrespective of registration requirements, all businesses that process personal data are required to comply with data protection legislation in full and are within scope of the ICO's regulatory remit.

The independent investigation, and subsequent report, focused solely on the allegations made against Mr. Edwards. We are working closely with the ICO to consider what the next steps should be.
