The Government have no plans to bring forward such legislation; the legislative framework is already in place. Schools have a duty under part 4 of the Disability Discrimination Act 1995 (as amended by the Special Educational Needs and Disability Act 2001) not to discriminate against disabled pupils and to make reasonable adjustments to ensure that disabled children and young people are not disadvantaged in any way compared to their peers, this includes in extra curricular activities, such as school trips.This, taken alongside the guidance 'Managing Medicines in schools and early years' settings' and the special educational needs code of practice provides a suitable legislative framework to help ensure that children with illnesses, such as diabetes, have the same educational opportunities as their peers.

Over the last 10 years, the main part of the Department's total expenditure on health research has been devolved to and managed by national health service organisations. Those organisations have since 2001 accounted for their use of the research and development allocations received from the Department in an annual report. The reports do not separately identify the cost of research concerned specifically with type 1 diabetes.Departmental expenditure from 2006-07 includes the costs of the National Institute for Health Research diabetes clinical research network formed in May 2006.

Vascular checks will be offered to everyone between the ages of 40 and 74 who have no existing, diagnosed vascular disease. Each component of the risk assessment element of the vascular check will be specified nationally. The Vascular Checks: Risk Assessment and Management: Next Steps Guidance, published on 13 November, provides details of these. A copy has already been placed in the Library.
Current National Screening Committee advice is that it is not clinically and cost-effective to offer diabetes screening to the whole population. However, it has recommended that screening certain subgroups of the population who are at high risk of type 2 diabetes is feasible, but that it should be undertaken as part of an integrated programme to detect and manage cardiovascular risk factors.
As part of the commissioning process, primary care trusts will be responsible for ensuring that those they commission to deliver the vascular checks programme do so in accordance with their contractual obligations. This should include ensuring those conducting the checks do so in accordance with agreed standard operating procedures to assure the quality and consistency of the vascular check. The department will be issuing guidance in the new year on the standard operating procedures for conducting the vascular check.

The national screening programme (NSP) for sight-threatening diabetic retinopathy produces peer-review reports following each external quality assurance visit. These make an assessment against the service objectives and quality assurance standards for the programme. The reports are shared with key stakeholders including local commissioners so that action can be taken to ensure that errors are dealt with competently and sensitively and professionals and organisations can make year-on-year improvements in service. The NSP is in regular contact with the national clinical director so that any appropriate action can be taken at national level to improve service.
The NSP does not currently collect information on management of the patient's blood sugar and blood pressure by their general practitioner to include in the annual report. After a patient has been screened, a report is sent to the health professional managing the patient's diabetes care. Advice is given in information leaflets to both patients and to health professionals about the importance of managing blood sugar and blood pressure levels, and the quality and outcomes framework rewards general practitioners for measuring and improving these levels.

This guidance explains the roles and responsibilities of employers, parents and carers, governing bodies, head teachers, teachers and other staff, and of local health services. This includes the effective management of long term conditions, like diabetes, while attending school.We shall, of course, work closely with DCSF on any future revision of the guidance.

Our document Making Every Young Person with Diabetes Matter, published in April 2007, drew attention to differences in the management of diabetes in children and young people—which is complex and significantly different from adult care. A copy of the document has already been placed in the Library.It stated that all children and young people with diabetes should have access to a Children and Young Person Specialist Diabetes (CYPSD) team with appropriate training and competencies; routine care, continuing care and annual assessment; and access to routine and integrated psychological support.A Children and Young People Diabetes Implementation Support Group has been set up to take forward work on the report's recommendations. The group is chaired by the National Clinical Director for Children, Dr Sheila Shribman, and includes representation from Diabetes UK, Royal Colleges, young people with diabetes, parents and representatives from organisations with an interest in this area, including the Healthcare Commission.

Guidance issued in 2005 by the department jointly with the Department of Health, entitled Managing Medicines in Schools and Early Years Settings, specifically addresses the issue of what schools can do to help children with diabetes and other medical conditions. The guidance encourages schools to develop policies on managing medicines and supporting pupils with medical needs. It also encourages schools to draw up, in consultation with parents and medical professionals, individual health care plans for children with medical needs.
