I raised this issue in opposition—I think it was the subject of the last speech I gave before the election—and it is an issue that I intend to take up with full vigour. We were concerned that parts of the last Government were turning a blind eye to these issues. I hope to come forward with further proposals in the coming weeks.

Mrs. Spelman: To ask the Parliamentary Secretary, Department for Constitutional Affairs what plans the Government has to vary land search charges. [219916] Mr. Lammy: I should first explain that in relation to land search charges the Department for Constitutional Affairs only has responsibility for local land charge fees, which include the fees for official and personal searches of the local land charges register, in England. However, I also have Ministerial responsibility for the fees payable to Land Registry under the Land Registration Act 2002, the Land Charges Act 1972 and the Agricultural Credits Act 1928. There are no plans to change the fees payable to Land Registry for searches of the land register, the land charges register or the register of agricultural charges. Under the Local Land Charges Act 1975, the Lord Chancellor has responsibility, with the concurrence of HM Treasury, for setting local land charge fees in England. On 1 March the Government successfully introduced an amendment to the Constitutional Reform Bill that will alter the Local Land Charges Act 1975 to give local authorities in England the power to set fees for local land charge services, with the exception of personal search fees, 1 March 2005, Official Report, column 849. If the amendment is enacted the new power will come into force on a date to be fixed. The amendment will allow local authorities to set fees, which, taking one year with another, will enable them to recover an amount up to, but not in excess of, the costs they incur in providing local land charge services. In setting fees, local authorities will have to have regard to guidance issued by the Lord Chancellor. An illustrative version of the type of guidance the Lord Chancellor may issue has been placed in the House Library. Further consultation will be undertaken before any guidance is issued. The amendment does not change the position in Wales, where the National Assembly for Wales has, since 31 December 2004, had responsibility for setting local land charge fees. Nor does it change the position in relation to fees for personal searches of the local land charges register, where a review is to be undertaken before any decision on changing the arrangements for setting these fees is made. It is expected that the study into the market for property search information being conducted by the Office of Fair Trading (OFT) will include consideration of the issues relating to personal searches. The OFT aim to complete the study this summer. I will consider in the light of the OFT report whether any further work is necessary to complete the review before making any decisions on the way forward.

Mr. Chope: To ask the Parliamentary Secretary, Department for Constitutional Affairs (1) what estimate he has made of the number of (a) individuals and (b) organisations which have fallen victim to bogus collectors in relation to data protection in each of the last three years; [157600] (2) what estimate he has made of the income received by the Information Commissioner from data protection registration fees under the Data Protection Act 1998 which emanated from bogus agencies in each of the last two years; [157591] (3) on how many occasions fees forwarded to the Information Commissioner by bogus collectors on behalf of data protection were from organisations which do not need to be registered; and what happens to such fees; [157588] (4) if he will estimate the cost to the Information Commissioner of telephone calls, correspondence and administration arising from the activities of bogus organisations posing as collectors in relation to data protection. [157587] Mr. Lammy: I understand from the Information Commissioner that in total approximately 27,000 notifications have been received via these bogus agencies. There were some 2,500 in 2001-02; 12,000 in 2002-03; and 12,500 in 2003-04. The figures available do not distinguish between individuals and organisations. The income received amounted to £420,000 in 2002-03 and £437,500 in 2003-04. The Data Protection Act allows organisations whose processing is exempt from the notification requirement to notify voluntarily. From the documentation submitted through the bogus agencies, it is not possible for the Commissioner to assess whether a notification is mandatory or voluntary. Refunds are given where the registration is a duplicate or where organisations contact the Commissioner and qualify for an exemption. Figures for the total number of refunds made prior to August 2003 are not available. Since that date, there have been approximately 400. The Commissioner estimates that the costs to his office of the bogus agencies in the year 2003-04 have been in the region of £100,000.

In the light of this and of the action taken by the European Commission, before the European Court of Justice, the Government have taken the view that separate representations from them would not add anything at the present time; however we are continuing to monitor the position.

Mr. Steen: To ask the Secretary of State for Health how many people were registered with donor cards in each of the last 10 years; and what steps the Government has taken to encourage a greater take-up. [116932] Mr. Lammy: The national health service organ donor register was established in 1994. The table shows the number of people that have registered each year. People are encouraged to join the organ donor through a number of initiatives, including when they apply for a driving licence, register with a new general practitioner, apply for a new passport or, where available, complete the organ donor registration form sent out by their local authorities annually when they check the electoral register. Additionally, UK Transplant runs publicity campaigns and targets action to raise the profile of organ donation, including specific advertising and information campaigns to increase organ donation from the South Asian and black African and Caribbean populations. _________________________________________________________________________________________________. Dr. Kumar: To ask the Secretary of State for Health (1) what information he has collated on the success rate of (a) Lasik and (b) other laser eye surgery procedures; [109153] (2) what plans he has (a) to regulate providers of laser eye surgery treatments and (b) to record individual surgeons' success rates and history; [109154] (3) what measures are in place to ensure that people offering laser eye surgery are adequately qualified and to require them to inform patients of possible side-effects of any treatment. [109152] Mr. Lammy: Establishments where Class 4 laser treatment is provided are required to be registered with the National Care Standards Commission as independent hospitals, under the Care Standards Act 2000 and must comply with the Private and Voluntary Health Care Regulations. Regulation 42(1) requires that the registered person has in place a professional protocol drawn up by a trained and experienced medical practitioner or dentist from the relevant discipline in which treatment is to be provided. Providers are also required to meet two sets of national minimum standards--core standards and service-specific standards. The core standards apply to all health care providers and include standards on the information that must be provided for patients. The provider must make available to prospective patients a patient's guide, reviewed annually, expressed in clear, relevant language and in a format suitable for the patient profile with regard to language and sensory or learning disabilities. The information provided must be accurate, not misleading and any claims made must be justified. The standards specific to laser treatment set out in detail all the issues to be addressed by the professional protocol and mandatory written policies and procedures, including the operator's responsibilities, technique, biological effects of treatment, procedures, qualifications, training, access, environment, maintenance, management, safety, adverse incidents, hazards, contra-indications, pre-treatment tests, post-treatment care and records. The vast majority of laser eye surgery takes place in private practice. The Department of Health does not collect information about such procedures by individual surgeons.
