The department received 16 applications for the role of Director for Freedom of Speech and Academic Freedom. Professor Arif Ahmed was appointed to the role on 1 June 2023, and will begin at the Office for Students (OfS) on 14 August.
The Director was appointed by my right hon. Friend, the Secretary of State for Education in the same way that other board members of the OfS are appointed, under the Higher Education and Research Act 2017. Officials at the department managed the recruitment process. The department has not conducted an assessment of the costs involved.
The Director role is a full-time executive position. It is a fixed term appointment, with the option of being extended up to a maximum of ten years. The role was advertised with a starting salary of £99,164, but this may be higher due to pay rises in some areas of the public sector in 2022. The Director’s working hours and starting salary will be agreed in his contract with the OfS. The Director will be eligible to join the Civil Service Pension Scheme.

In the Impact Assessment published in June 2022, the government estimated that the administration costs to the Office for Students (OfS) would range between £0.5 to £0.8 million per year. This estimate was made before detailed decisions had been taken about the role and renumeration package for the Director for Freedom of Speech and Academic Freedom, and what funding his team will require. The Director of Freedom of Speech and Academic Freedom is not a post listed in the Public Appointments Order in Council, but we have committed that the recruitment process will be done in accordance with the public appointments process.
The Governance Code on Public Appointments does not require data to be anonymised at any stage of the appointments process. It does require the process to be open, transparent and conducted with integrity. It also requires that public appointments should reflect the diversity of the society in which we live.
The scrutiny of candidates’ CVs allows for the completion of due diligence and supports a robust process. Therefore, the process of making this appointment will not be anonymised.

The House of Lords Appointments Commission (HoLAC) was established in 2000 as an independent body. HoLAC is responsible for the vetting for propriety of all life peerages to the cross-bench and political benches of the House. HoLAC seeks advice from the appropriate vetting agencies and then will either advise the Prime Minister that it has no concerns about the appointment, or will draw its concerns to the Prime Minister’s attention. These vetting procedures and the advice to the Prime Minister are confidential.
Where HOLAC does not support a nomination, and a Prime Minister has exercised their right to recommend it anyway, this information is communicated in general terms to the relevant select committee (PACAC) whilst also protecting the identity of the nominee in question.

The Higher Education and Research Act 2017 gives the Secretary of State for Education the power to appoint the Chief Executive of the Office for Students.
The interim appointment of Susan Lapworth as the Chief Executive was made under these powers. We will be opening the competition to recruit a permanent Chief Executive shortly.

The appointments to the Board were made through a fair and open competition, reflecting the Governance Code on Public appointments and the relevant legislation. The Board members have the broad range of skills and experience needed to lead the Office for Students to deliver better outcomes for students.
