The Treasury has not issued guidance on the rights of consumers to access property-specific risk data held by insurers or third-party providers.
Consumers have rights to access their personal data under the UK's data protection legislation (the UK General Data Protection Regulations and the Data Protection Act 2018). Under the legislation, organisations are required to process personal data lawfully, fairly, transparently and securely, unless certain limited exemptions apply. However, property-specific risk data may not always fall within the scope of personal data and therefore may not be subject to the same access rights.
The Information Commissioner’s Office, the UK's independent regulator for data protection, publishes a range of guidance for both organisations and members of the public.

The Financial Conduct Authority (FCA), as the independent regulator of financial services, carried out a review into insurance for multi-occupancy buildings in 2022. The FCA had concerns about how certain elements of the market were working and in 2023 it introduced a number of regulatory changes to enhance consumer protection and improve the functioning of the market. The FCA has robust powers to take action against firms that do not comply with its rules.
The government continues to engage with relevant stakeholders, including the regulators, insurers, leaseholder representatives and trade bodies, to keep the market under review.

The Flood Reinsurance (Scheme Funding and Administration) Regulations 2015 define a “flood” as “water, from any source external to a building, which enters a building…at or below ground level, or above ground level, provided that part of the body of such water is at ground level; and does so with a volume, weight or force which is substantial and abnormal". Therefore, under this definition, surface water flooding is included as standard within the Flood Re scheme’s offer.
Insurance companies can choose to cede the flood risk element of an eligible household policy to Flood Re if the Schemes premium for that is lower than they can otherwise offer. Flood Re does not have any involvement in or influence over individual insurers’ decisions to cede policies.

Building owners are responsible for ensuring that buildings have appropriate buildings insurance in place.
The government encourages insurance companies to provide suitable, fairly-priced insurance for all blocks of flats, whatever the conclusion of the Fire Risk Appraisal of External Walls.
Insurers make commercial decisions about the price and terms of cover they offer following their assessment of the relevant risks. Government is determined that insurance companies treat customers fairly and the Financial Conduct Authority (FCA) requires firms to ensure their products offer fair value. The FCA has been clear it will be monitoring firms and, where necessary, it will take action.
My officials would be happy to speak to the insurance industry about any building brought to our attention, which is unable to obtain any buildings insurance cover.
For buildings that do require remediation, the Fire Safety Reinsurance Facility, led by the Association of British Insurers (ABI) and reinsurance broker McGill and Partners, may reduce high premiums for some of the most affected multi-occupancy buildings with fire safety issues.

The government published the consultation on introducing permitted insurance fees for landlords, freeholders and property managing agents via gov.uk and is content that it meets the expected accessibility standards to allow all interested parties to contribute their views.
As prescribed in the government’s Publishing Accessible Documents guidance, the consultation is published in HTML format to make it easier to read and to find. The guidance in question provides alternate ways to respond to meet the range of accessibility needs, including an online response option and via direct email address. Anyone having any difficulty responding can get in touch using the contact details available to request assistance or an alternative way to respond. We also provide documents in alternative formats when these are requested by the public, including large print and braille. We have an alternative formats email address published on gov.uk which invites users to request a different format if they cannot use one of our documents (alternativeformats@communities.gov.uk).

The consultation on introducing permitted insurance fees for landlords, freeholders and property managing agents was launched on 2 December and can be found on gov.uk here.
As per my Written Ministerial Statement of 21 November 2024 (HCWS244), the government will look to consult on the Leasehold and Freehold Reform Act’s provisions on service charges and on legal costs next year, bringing these measures into force as quickly as possible thereafter.
We remain firmly committed to our manifesto commitment to tackle unregulated and unaffordable ground rents, and we will deliver this in legislation.
The government funds the provision of free information and advice by the Leasehold Advisory Service (LEASE).
