The administration of justice in Northern Ireland is devolved and a matter for the Northern Ireland Assembly. However, the Government notes that the Northern Ireland Department for Justice has proposed changes to strengthen the way that civil claims on behalf of minors are brought. No changes in this area are planned for England and Wales as children are already protected by the Civil Procedure Rules (CPR). Under the CPR a child must have a litigation friend to conduct proceedings unless the court orders otherwise, and settlements must be supported by legal advice as well as approved by the court which will direct how the money is dealt with and make a detailed assessment of legal costs payable.

The Government has agreed to provide a targeted and limited indemnity, for an economic charge to cover a current gap in the insurance market. The economic charge is calculated by considering a number of factors including risk, claims cost, type of nuclear site and the number of sites. The charge is applied directly from the Department to those nuclear operators who utilise the indemnity. The indemnity will be reviewed annually to ensure that it remains the best value for money option and remains necessary whilst the insurance market works towards filling the cover gap.

To ask the Secretary of State for Health and Social Care, if he will reconsider the recommendation of the 2020 report of the Independent Medicines and Medical Devices Safety Review that an independent Redress Agency be set up to adjudicate on claims from patients arising from pharmaceutical injury.
The Government’s response to the Independent Medicines and Medical Devices Safety Review did not accept the recommendation to establish a redress agency. It is already possible for the Government and others to provide redress for specific issues, where that is considered necessary. We are prioritising the improvement of safety in medicines and medical devices, setting high standards for industry to market and manufacture products with the aim of reducing harm in the future.
