Dawn Primarolo: Since October 2003 HM Customs and Excise prosecutions in relation to animals, plants or their products imported
through airports (but excluding cases involving illegal drugs or any counterfeit organic materials) have involved: four people
prosecuted under the products of animal origin regulations, and one person prosecuted under endangered species regulations.
All were convicted.

and timber imports are free from sudden oak death. [149113]
Mr. Bradshaw: The Plant Health (Great Britain) Order 1993 (SI 1993/1320, as amended) sets out the controls on the import, movement
and keeping of plants within the EU. The Order requires all plants entering the UK from third countries to be accompanied by a
phytosanitary certificate and are subject to inspection at import. For trade within the EU, specific disease control measures are
applied at the place of production and plant passports may be issued that travel with consignments allowing their free movement
between member states. From May 2002 measures to control the movement of plants susceptible to Phytophthora ramorum into and within
the UK where introduced under the Plant Health (Phytophthora ramorum) (England) Order 2002. Following the agreement of community
wide measures this Order was superseded in November 2002, by the Plant Health (Phytophthora ramorum) (England) (No. 2) Order 2002
(SI 2002 No. 2573). The latter applied specific disease control measures at the place of production to rhododendrons and viburnums,
the two types of plant which have been most often found to be infected in Europe.
Findings of Phytophthora ramorum in imported and UK origin plants are of concern and inspections at UK nurseries and ports of entry
are to be stepped up to ensure that all consignments of plants moved into and within the UK are free from Phytophthora ramorum and
meet plant passport requirements. Any consignment found to be infected, or not to have the correct documentation, will, as now, be
destroyed.
The regulations controlling imports of wood and wood products are set out in the Plant Health (Forestry) (Great Britain) Order 1993
(SI 1993/1283, as amended). These require that imports of wood of oak from North American countries are treated to protect against,
in particular, another fungal organism Ceratocystis fagacearum, the cause of Oak wilt disease. The Forestry Commission concluded
that these controls are effective against Phytophthora ramorum but that they needed to be extended to bring under regulation wood
from other trees that are known to host this pathogen and which originate in the USA. The Forestry Commissioners therefore
implemented emergency measures in June 2002 by way of the Plant Health (Phytophthora ramorum) (Great Britain) Order 2002 (SI 2002
No. 1478). This Order was superseded in November 2002, to implement the European Community measures against Phytophthora ramorum, by
the Plant Health (Phytophthora ramorum) (Great Britain) (No. 2) Order 2002 (SI 2002 No. 2589).
The Forestry Commission enforces the controls on wood and wood products through its system of import inspections carried out at
ports of entry.

Mr. Paterson: To ask the Secretary of State for Environment, Food and Rural Affairs how many plants have been imported without
passports in each year since passports were introduced. [149260]
Mr. Bradshaw: The plant passporting regime applies to certain plants and plant products known to host the most serious
("quarantine") pests and diseases. It applies only for movements within the European Community and there are no border checks
carried out, although spot checks may take place anywhere in the trade chain. Producers of such material are required to be
officially registered and be subject to official inspection at least annually in order to be authorised to issue plant passports.
There are no data available either on the number of consignments received in the UK for which a plant passport has been issued by a
producer, or the number of consignments received for which a passport is not required. EU legislation does not require such
information to be recorded, although those despatching and receiving passported material must maintain records to facilitate
monitoring and enforcement.
In cases where official monitoring detects that a plant passport is missing on a plant or product covered by the passporting
requirements, enforcement action is taken. This involves notification of the plant health authorities in the member state in which
the material originated, as well as the return or destruction of the material.

Mr. Bradshaw :[holding answer 11 December 2003]:
Measures are already in place to help prevent garden centres and growers from importing plant material susceptible to the pathogen
Phytophthora ramorum. These included, banning the import of host plants from affected areas of the USA and extending current
controls on imported oak wood to include wood that comes from host trees in affected areas in the USA. All other susceptible plant
material imported into the UK from third countries must be accompanied by a phytosanitary certificate. For trade within the EC, all
consignments of rhododendron and viburnum must be accompanied by a plant passport.
The European Community's Standing Committee on Plant Health recently reviewed these measures and agreed that they should continue.
Commission officials are now working on a draft to strengthen the current Decision. In addition, the UK will be stepping up its
inspection of plant material entering the UK to ensure it complies with import arrangements. Any consignment entering the UK that is
found not to possess the required documentation is destroyed.

Mr. Bradshaw: [holding answer 11 December 2003]: A Defra plant health official and an industry nominee recently made a visit to the
Netherlands, at the invitation of the Dutch plant health authorities, to see how new EC measures against "Phytophthora ramorum" were
being implemented. The visit has been the subject of misleading reports in the press. Boskoop, the main venue for sale of nursery
stock in the Netherlands, was found to be fully compliant. At Aalsmeer, which is primarily a flower market, some consignments of
plants were losing their plant passports when they were split up and sold on; a shortcoming which the Dutch plant heath authorities
have agreed to address. Our surveillance of plants moving in trade, including those from the Netherlands, is being stepped up and
plants found not to comply will continue to be destroyed.
Collaboration between Forestry Commission scientists and their Dutch and German counterparts helped in 2001 to establish the link
between dying trees in California and a new but minor disease on rhododendrons in Europe.
We do not know how or where the pathogen arrived in Europe. Of the 330 UK findings, 70 per cent. have been on plants originating
within this country, rather than imports. I do not believe it is appropriate at this stage to seek sanctions or compensation from
the other countries with whom we are working to deal with this threat to European trees. The first recourse for someone who has
received infected plants should be their supplier.
