Dr. Godman: To ask the Secretary of State for Social Security how many parents caring for children have been penalised by way of a reduction in income support for failing, or refusing, to provide information concerning an absent parent to the Child Support Agency in (a) Inverclyde and (b) Scotland in the past four years; what was the average amount of reduction; and if he will make a statement. [140550] Angela Eagle: The administration of the Child Support Agency is a matter for the Chief Executive, Mr. Doug Smith. He will write to my hon. Friend. Letter from Mr. Doug Smith to Dr. Norman A. Godman, dated November 2000: I am replying to your Parliamentary Question to the Secretary of State for Social Security about the Child Support Agency. We do not have an accurate figure for the number of Reduced Benefit Directions imposed in the Inverclyde area. Based on a 5% sample of the whole national caseload, we would estimate there to have been around 100 cases over the last 4 years, but you will appreciate that this is an estimate and may not be accurate. The following figures represent the number of lone parents claiming Income Support in Scotland who had a Reduced Benefit Direction. Because the Income Support data is only extracted once a month, there may be a small number of claimants who have had a Reduced Benefit Direction for a short period of time that are not included in these figures: _________________________________________________________________________________________________. Year Number 1996-97 1,700 1997-98 1,600 1998-99 2,200 1999-2000 600 _________________________________________________________________________________________________. The latest average reduction for parents with care on Income Support is £20.99 per week. This figure is based on an average of two quarters, May 2000 and August 2000. Other year's average reductions for Scotland are: _________________________________________________________________________________________________. Year £ 1997-98 18.23 1998-99 18.46 1999-2000 20.28 _________________________________________________________________________________________________. A reduced Benefit Direction will not be made when a lone parent has good cause for not seeking maintenance. Good cause is accepted where there are reasonable grounds to believe that the parent or any child living with her would suffer harm or undue distress as a result of pursuing child maintenance. Reductions will not be implemented if the parent with care is in a vulnerable group such as where there is a Disability Premium in payment. Benefits Agency staff now visit the parent with care and help her complete an application form. This has led to a significant increase in the number of parents cooperating. Some 90% of parents with care cooperate now compared to 30% in 1997, and there has also been a 72.7% reduction number of Reduced Benefit Directions imposed in 1999/2000 against 1998/1999 figures. Data has been provided by DSS Analytical Services Division (ASD) using a quarterly 5% sample of cases on the Income Support Computer System. These figures which are rounded to the nearest thousand may be unreliable because they are subject to sampling error. I hope this is helpful.

[138696] Mr. Rooker: Guidance on the level of discretion available to officials in this Department and other matters relating to disclosure of information to the police is contained in the Protection of Customer Information Guide. This was published in April 2000, to replace previous guidance which had been issued in 1992 and which had become out of date. The level of discretion available to officials was unaffected by the revision of the guidance. We have had an exchange of correspondence with ministerial colleagues in the Home Office about the guidance and officials have had discussions with the Association of Chief Police Officers. We have received no representations from the Police Federation about it. A copy of the new guidance has been placed in the Library. The new guidance can also be viewed on the DSS homepage at www.dss.gov.uk. The previous guidance was withdrawn when the new guide was published, but I am arranging to place a copy in the Library for comparison purposes until the end of 2000.

[134761] Miss Melanie Johnson: The information requested falls within the responsibility of the Registrar General. I have asked him to reply. Letter from Len Cook to Mr. David Crausby, dated 30 November 2000: As Registrar General I have been asked to reply to your recent questions on the practice of reporting marriages to the Home Office suspected to be solely for immigration purposes and the numbers of these marriages reported between 1996 and 1999. (134761, 134762) Arrangements for the reporting of suspected marriages of convenience by the Registrar General were introduced in 1925 at the request of the Home Secretary. The purpose of these reports is to identify marriages suspected to have been arranged for the sole purpose of evading statutory immigration controls. The reporting is on a non-statutory basis. During 1996, 1997, 1998 and 1999 Superintendent Registrars reported 607, 421, 467 and 315 cases to the Registrar General. Of this number, information in respect of 519, 294, 344 and 267 reports respectively were passed to the Home Office. Details of the reports received by registration district are shown in the attached tables. These tables are too large to be reproduced in Hansard and I have therefore made arrangements for them to be placed in the House of Commons Library. Figures for 1996 marriages reported to the Home Office are not available by registration district.

Letter from Len Cook to Mr. David Lidington, dated 30 November 2000: As Registrar General for England and Wales I have been asked to reply to your three recent questions about the arrangements for the coming into force on 1 January 2001 of section 24 of the Immigration and Asylum Act 1999 (the 1999 Act). As you know, section 24 is concerned with the duty on registration officers to report suspicious marriages. Specifically you asked about registration officers checking passports and visas and their training and guidance to be issued. (139340/1/2) Under current legislation, registration officers need to ensure the accuracy of information contained in the notice of intention to marry. To achieve this they may examine a variety of documents. The person giving notice of marriage may be asked to provide documentary evidence showing use and spellings of names and details of age and marital status in order to verify the particulars. A variety of documents, including a passport, may be produced. I have not issued any policy guidance to registration officers regarding checks on passports on the validity of visas of persons intending to marry. However, the 1999 Act places a duty on registration officers to report to the Home Office marriages they reasonably suspect as being sham marriages. If, in the course of examining a passport, a registration officer discovers the visa of a part to a marriage has expired this may be taken into account, together with other factors, in assessing whether the marriage is a sham. Registration officers in England and Wales have been invited to attend a seminar arranged to address both the impact on their statutory duties and the consequential amendments to marriage law arising from the 1999 Act. The Reporting of Suspicious Marriages and Registration (Miscellaneous Amendments) Regulations 2000 are to be laid before Parliament shortly. They set out the procedure for reporting sham marriages to the Secretary of State for the Home Department where it is suspected that the marriage is or has been entered into for the purpose of avoiding the effect of United Kingdom immigration law. The regulations specify that reports are made direct to the Immigration and Nationality Directorate and stipulate the information to be contained in reports. A copy of these regulations will be issued to every superintendent registrar in England and Wales. They will also receive written guidance and revised instructions for inclusion in the Handbook for Registration Officers that will contain advice about reporting arrangements. I have no plans to issue further guidance on sharing information with the immigration authorities.
