Mr. Hunter: To ask the Secretary of State for the Environment, Transport and the Regions if he will introduce legislation to prevent
the importing of waste into the United Kingdom for disposal. [138186]
Mr. Meacher: The UK already prohibits most imports of waste for final disposal. Under the legally binding United Kingdom Management
Plan for Exports and Imports of Waste, which came into effect in June 1996, the UK accepts wastes only from those countries which
cannot reasonably be expected to deal with specific wastes in an environmentally sound manner. This is because we have the necessary
treatment facilities which meet tough environmental standards. This policy is designed to encourage countries to become as self-
sufficient as possible in waste disposal.
Consistent with European law, however, the UK cannot prohibit imports of wastes for recovery, which could include shipments of
municipal wastes for incineration with energy recovery. However, shipments of municipal waste still require the prior consent of the
UK enforcement authorities and would have to meet specific criteria set out in the UK Plan. There may be grounds for objecting to
individual shipments if the primary purpose of the importing facility is to treat local wastes and those wastes will be displaced by
the proposed imports. Available data show that no imports of municipal waste have taken place since the existing UK Plan came into
effect in 1996.
UK policies and procedures on the acceptance of waste imports are being considered as part of the current review of the UK Plan.

Mr. Paul Murphy: I have met DETR Ministers to discuss a range of issues affecting Wales, and I have also met the Environment Agency
Wales during the past 12 months to discus environment issues including imports and exports of waste. Policies on exports and imports
of waste are not devolved and are dealt with by DETR. Nevertheless, I have taken a keen interest in these issues, especially during
the consultation period of a UK-wide set of policies on exports and imports of waste, which the National Assembly for Wales were
involved in.

Mr. Mullin: Existing policies on imports of waste are set out in the legally binding United Kingdom Management Plan for Exports and
Imports of Waste, which came into effect in June 1996.
The UK Plan prohibits most waste imports for disposal, including imports of municipal waste for final disposal, in line with
longstanding UK policies of encouraging developed countries to become as self-sufficient as possible in waste disposal. Consistent
with the EC Waste Shipments Regulation (EEC) No. 259-93, though, the UK Plan cannot prohibit imports of wastes for recovery, which
could include incineration with energy recovery. However, individual shipments of municipal wastes for recovery require the prior
consent of the UK enforcement authorities. There may be grounds for objecting to proposed shipments if the primary purpose of the
importing facility is to treat local wastes and those wastes will be displaced by the proposed imports.
Available data show that no imports of municipal waste have taken place since the UK Plan took effect.

Mr. Meacher: UK policy on waste imports is set out in the legally binding United Kingdom Management Plan for Exports and Imports of
Waste, which came into effect in June 1996.
The policies in the UK Plan prohibit most waste imports for disposal, and are designed to encourage countries to become as
self-sufficient as possible in waste disposal. However, where countries cannot reasonably be expected to deal with specific wastes
in an environmentally sound manner, the UK is prepared to accept them given that we have the necessary treatment facilities which
meet tough environmental standards.
Consistent with this approach the UK currently accepts imports for disposal by high temperature incineration from Brazil, Guernsey,
Ireland, the Isle of Man, Jersey, Portugal, South Africa and Thailand. We also have extant agreements to accept waste from
Argentina, Chile, Egypt and Pakistan, although there have been no shipments to date from these countries.
We have only accepted waste for landfilling from the British Antarctic Territory, the Falkland Islands and the Isle of Man.
Earlier this year the UK made a bilateral arrangement to accept wastes from the Sovereign Base Areas of Akrotiri and Dhekelia on
Cyprus for disposal by either option, although there have been no shipments under the arrangement to date.
The position is different for imports for recovery, which under European law includes incineration where the primary purpose is
energy recovery. The UK Plan, consistent with the EC Waste Shipments Regulation and OECD Decision C(92)39/Final, permits movements
of wastes for recovery between OECD members on the basis that this trade provides a valuable source of raw materials; and that no
country is self-sufficient in waste recovery.
However, while any OECD member country may export hazardous wastes to the UK for incineration with energy recovery, to date we have
only received hazardous wastes from Guernsey, Ireland, the Isle of Man, Jersey and the Netherlands.
UK policies and procedures on the acceptance of waste imports are being considered as part of the current review of the UK Plan. I
have made it clear that the UK would expect developing countries to develop, as quickly as is feasible, appropriate facilities to
deal with their own waste, as far as is compatible with environmentally sound and efficient management.

The Plan does not permit imports of municipal waste for final disposal. However, to be consistent with the EC Waste Shipment
Regulation (EEC No.259/93), the Plan cannot prohibit imports for genuine recovery, which could include incineration where the prime
purpose was energy recovery. Any such imports of municipal waste would, though, be subject to a prior informed consent procedure;
and the available data for 1996-98 show that no such imports occurred over that period.

Mr. Burgon: To ask the Secretary of State for the Environment, Transport and the Regions what plans he has to review the policies in
the United Kingdom Management Plan for Exports and Imports of Waste. [124080]
Mr. Meacher: Existing policies on exports and imports of waste are set out in the United Kingdom Management Plan for Exports and
Imports of Waste, which came into effect on 1 June 1996. These reflect the long-standing UK commitment to self-sufficiency in waste
disposal and the well-established proximity principle, namely that waste should be disposed of in, or as close as possible to, the
country of origin.
Since the Plan has been in force, there have been a number of changes at national and international level which have altered the
arrangements for transfrontier shipments of waste. My Department will be issuing tomorrow for public consultation a revised draft of
the United Kingdom Management Plan for Exports and Imports of Waste, copies of which will be placed in the Libraries of the House.
The main proposals for changes to existing UK policies are: to permit shipments between Northern Ireland and Ireland for local
disposal, provided they are in accordance with waste management plans being drawn up by the Northern Ireland District Councils; to
permit exports and imports for trial runs provided that strict criteria are met; and further limited restrictions on imports of
waste for disposal.
Furthermore, the Plan reiterates the UK's commitment to the self-sufficiency principle. The UK will only allow wastes to be imported
for disposal in the UK from developed countries in extremely limited circumstances. Imports from developing countries are not quite
so tightly restricted, but the expectation is still that such countries will as quickly as is feasible put in place the appropriate
facilities to dispose of their own waste, as far as is compatible with environmentally sound and efficient management.
This Plan is separate from, but consistent with, the various domestic strategies in the UK, including the England and Wales Waste
Strategy which will be launched tomorrow.
