Mr. Kidney: To ask the Secretary of State for the Home Department for which motoring offences curfew orders and vehicle forfeiture can be used; and how often these court disposals have been used for motoring offences in each of the last three years for which data are available. [96637] Mr. Charles Clarke: Curfew orders under section 12 of the Criminal Justice Act 1991 are available for any offence for which a community penalty is appropriate. This provision has been piloted from July 1995 in seven areas, and will be made available throughout England and Wales from 1 December. The available data on the use of these provisions relate to the period July 1995 to June 1997. Mr. Clappison: To ask the Secretary of State for the Home Department, pursuant to his answers of 27 April 1999, Official Report, column 110, 18 May 1999, Official Report, column 295 and 26 May 1999, Official Report, column 149, on home detention curfews, what powers he has to revoke the licences of the 14 curfewees who were charged with an offence during the period of curfew and who remained on home detention curfew. [86058] Mr. George Howarth: The Secretary of State's powers to revoke the licence of any person subject to home detention curfew are set out in section 38A(1) of the Criminal Justice Act 1991, which provides that: "If it appears to the Secretary of State, as regards a person released on licence under section 34A(3) above-- (a) that he has failed to comply with the curfew condition; (b) that his whereabouts can no longer be electronically monitored at the place for the time being specified in that condition; or (c) that it is necessary to do so in order to protect the public from serious harm from him, the Secretary of State may, if the curfew condition is still in force, revoke the licence and recall the person to prison." In addition, on 1 January 1999, the Government implemented section 103 of the Crime and Disorder Act 1998. This means that a curfewee whose original offence was committed on or after 1 January 1999 and who is charged with a new offence committed during the home detention curfew period will be liable to have his licence revoked by the Secretary of State under section 39 of the Criminal Justice Act 1991. The 14 curfewees referred to in the question are not liable to have their licences revoked by the Secretary of State under section 39 of the 1991 Act, as their original offences were committed prior to 1 January 1999, and there are no grounds for recall under section 38A(1) of the 1991 Act. However, breaches of licence conditions not covered by these provisions may be dealt with by the courts under section 38 of the 1991 Act and may result in a fine and/or recall to prison.

Mr. Coaker: To ask the Secretary of State for the Home Department what guidance he has issued to local authorities on what constitutes anti-social behaviour under the behaviour orders under the Crime and Disorder Act 1998; how he will monitor the (a) use and (b) effectiveness of (i) behaviour orders, (ii) curfews and (iii) parenting orders; and what action he will take to encourage the use of such orders by (1) the police and (2) local authorities. [85671] Mr. Boateng: We published comprehensive guidance on the use of anti-social behaviour orders earlier this year "Crime and Disorder Act 1998: Anti-Social Behaviour Orders--Guidance". This included guidance on the types of case in which such orders might be considered. A review of the use and effectiveness of anti-social behaviour orders is planned during the first two years of their availability. The local child curfew scheme will help address the problems of unsupervised children who are out on the streets late at night, and who may be involved in anti-social behaviour. We intend to carry out a monitoring exercise of the local child curfew scheme to assess how the practical arrangements work in those areas which decide to operate such a scheme. This will help identify good practice, particularly in the area of multi-agency working, which will be required for the enforcement arrangements. The parenting order is the subject of an 18-month pilot scheme, which began on 30 September 1993. This involves monitoring and evaluating the use made of the order. The results of the pilot project will inform the process of national implementation and help to identify good practice which can be reflected in guidance and national standards. The decision to apply for anti-social behaviour orders or local child curfew schemes is one which must be taken by the police or local authority as appropriate, but we shall continue to encourage their use whenever the opportunity to do so arises. Parenting orders are available to the courts and do not depend upon any application being made by either the police or the local authority.
