The Government are taking forward a whiplash reform programme that will deter unnecessary, exaggerated or speculative claims. Reforms to control the costs of claims were implemented on 1 October, and on 2 December we announced further plans to have independence and quality safeguards in the system for obtaining expert evidence.
What evidence does the Minister have to demonstrate that his measures have been effective in cracking down on fraudulent whiplash claims, as it would seem that, as a nation, we are happy to allow both the profits of insurance companies and our reputation for having the weakest necks in the world to go unchallenged?

This Government have made and continue to make major changes to deter fraudsters and reduce the number and cost of whiplash claims. We have already seen an impact from these reforms and industry data show that they have contributed to a 14% reduction in premiums since February 2012.

The offence of ‘making fraudulent insurance claims’ is likely to be proceeded against under Section 1 of the Fraud Act 2006. This includes offenders who dishonestly make false representations to make gains for themselves or cause losses to another person.
The Ministry of Justice does not collate all details of proceedings. As a result it is not possible to specifically identify and cost proceedings that relate to drivers accused of making fraudulent insurance claims under Section 1 of the Fraud Act. This information could be obtained only by examining all relevant court records of Her Majesty's Courts and Tribunals Service and would incur disproportionate cost.

The number of uninsured vehicles in Great Britain has fallen from 2 million in 2005 to 1.4 million in 2010 and 1.2 million today. We have no numbers by region so cannot exclude London and figures were not collected for 2002 and 2007.

A person who makes a fraudulent insurance claim is likely to be guilty of fraud by false representation under section 1 of the Fraud Act 2006. Fraud by false representation can be committed in a variety of ways and data collated centrally by the Ministry of Justice does not include all the details of each offence. It is therefore not possible to identify the number of convictions under section 1 which specifically relate to making fraudulent insurance claims.

The Ministry of Justice has no records relating to the costs of operating magistrates courts prior to the creation of Her Majesty's Courts Service on 1 April 2005. The timings associated with the court records maintained by Her Majesty's Courts and Tribunals Service (HMCTS) do not provide a reliable basis for the estimation of the time taken by particular types of proceedings. As a result it is not possible to provide estimates of court costs or time for 1997 or 2002.
HMCTS has derived average court timings from survey data as an element of its activity based costing. Based on these data the estimated direct court and bench costs, excluding non-cash expenditure such as depreciation, of court proceedings relating to people accused of being uninsured drivers in 2011 was £6.9 million. The estimated time taken by such proceedings was 21,600 hours.

The Crown Prosecution Service (CPS) does not maintain a central record of the number of uninsured drivers prosecuted in (a) 1997, (b) 2002 and (c) 2011. This information could be obtained only by examining all of the CPS's cases files, which would incur disproportionate cost.
Records held by the CPS identify the number of offences charged under section 143 of the Road Traffic Act 1988 (use of a motor vehicle not insured or secured against third-party risks) in which a prosecution commenced rather than the number of defendants prosecuted. The data have been maintained since 2005. Prior to 2005 there is no central data. The number of offences prosecuted by the CPS in 2011 was 63,183. This figure represents only those cases prosecuted by the CPS. The Prosecution of Offences Act 1985 (Specified Proceedings) Order 1999 allows the police to prosecute uninsured drivers without reference to the CPS. The CPS does not maintain a central record of police prosecutions.
