On behalf of the Leader of the House, I am considering issues relating to the operation and reform of the system for scrutiny of European Union documents in this House. This follows from the recommendations made in the report from the Modernisation Select Committee in its Second Report of Session 2004-05 (HC 465) and from the debate on 25 October relating to the composition of European Standing Committees. I hope to bring forward proposals before the current temporary resolution governing the composition of European Standing Committees, agreed following that debate, expires in February 2008.

May I suggest to the Deputy Leader of the House that he might suggest to the new Leader of the House, whom I look forward to welcoming properly to his new role in business questions on Thursday, that there is a chance to succeed where others have failed? It is more than a year since the Modernisation Committee produced a report stating that"““there are also worrying shortcomings in the House’s scrutiny of EU business””."
Leader of the House after Leader of the House has put off that matter, and I suggest to the Deputy Leader of the House that now is the time for the Government to grasp that particular nettle and introduce firm proposals for improving this House’s scrutiny of EU business.

I do not accept the right hon. Lady’s account. The report to which she has referred was controversial. As she knows, the minutes of the Committee include the voting record, which shows the controversy—the Committee changed its mind before eventually coming up with a recommendation. The Committee was divided, and it is unfair of her to suggest that the Government could move forward as a result of that uncertain recommendation. I know that she shares the desire of my hon. Friend the Member for Rhondda (Chris Bryant) and the rest of the House to have proper scrutiny of legislation, and we would certainly welcome any proposals from the right hon. Lady and her party on that matter.

The overall issue of the scrutiny of legislation referred to by the hon. Member for South Ribble (Mr. Borrow) is important. I note the comments made by the Deputy Leader of the House that the Government will bring forward proposals in due course, but I hope that he agrees that one of the key issues is the House's ability to scrutinise legislation at an early opportunity before Ministers make decisions in the Council of Ministers. Will he assure the House that that is one of the key issues that the Government will consider and that their proposals will address it?

Of course it is vital that as many hon. Members as possible consider legislation at as early a stage as possible. I remind the right hon. Member that MEPs also have a role to play in this. Given the chaos that there appears to be in Europe in her party, perhaps she can tell the House which group her MEPs are going to join so that they can inform this process. We on the Labour Benches will do our best to make sure that there is proper scrutiny by this House, but there cannot be proper scrutiny by Conservative MEPs as long as we do not know which group they are in or are allying themselves to.
