That this House notes that, at its entry to the Council of Europe in September 1993, Romania gave a commitment to decriminalise homosexuality; expresses concern that Romania remains the only member of the Council of Europe which continues to condemn its citizens to prison for engaging in consensual same sex relationships; further notes that homosexual men and women are a social group which continues to be systematically discriminated against under the Romanian penal code; shares Amnesty International's concern that the planned revision of the law will criminalise same sex relations that cause a public scandal, which is a vague legal definition that is open to interpretation to allow the prosecution of Romanian adults solely because of consensual homosexual acts in private, acts which are legal if carried out in similar circumst ances but by heterosexuals; also expresses its concern at the proposed restrictions on the rights to freedom of assembly,expression and association of gay and lesbian Romanian ci tizens; and calls on the Romanian Parliament to pass a full and proper discrimination measure and to eliminate other forms of discrimination against homosexual men and women in the penal code.
