Chris Grayling: To ask the Secretary of State for Health what plans the Government have to restrict the use of hormone replacement therapy. [130106] Dr. Ladyman: Following careful review of the recent findings from a number of studies that provide important new information on the safety of hormone replacement therapy (HRT), the committee on safety of medicines (CSM) and its expert working group on HRT have issued clear advice to prescribers and women. The CSM has advised that, for short-term use of HRT for the relief of menopausal symptoms, the benefits outweigh the risks for many women. However, for longer-term use of HRT, prescribers are advised that each decision to start HRT should be made on an individual basis and that women should be made aware of the increased risk of the adverse effects, including cancer and cardiovascular disease. Each treatment decision should take into consideration the known risks and benefits of HRT, the contraindications for use and each woman's individual circumstances. In addition, the need to continue HRT treatment should be reappraised at least once yearly. Product information is being updated to reflect fully the new information and will additionally advise prescribers that, for the treatment of post-menopausal symptoms, the lowest effective dose of HRT should be used and that treatment should only be continued as long as the benefit in alleviating severe symptoms outweighs the risks. As with all licensed medicines, the CSM keeps the safety of HRT under close review, and would take appropriate action if further evidence relating to its safe use became available.

In the 1998 White Paper, "Smoking Kills", the Government committed itself to a programme of public education to persuade smokers to quit and non-smokers not to start. Chris Grayling: To ask the Secretary of State for Health what his policy is on (a) smoking in public places and (b) passive smoking. [98843] Ms Blears: The White Paper, "Smoking Kills" committed the Government to working in partnership with industry to reduce the problem of exposure to passive smoke through voluntary action rather than legislation. It praised the example of the licensed hospitality industry, which agreed, with Government support, the Public Places Charter. The Charter commits signatories to increasing the provision of facilities for non-smokers, improving ventilation and giving customers better information about the level of smoke-free facilities in a given establishment. We consider that if we are to ensure protection against passive smoking in public places, we need action nationally and locally both to raise awareness of the risks associated with passive smoking and to increase the prevalence of smoke free environments. The Department of Health will continue to encourage the development of smoke free policies, working with employers and communities. At a national level the Department of Health has, since 1998, worked with the hospitality industry to reduce the problem of exposure to passive smoking through the development of a Public Places Charter. An independent evaluation of the Charter is being commissioned, and further work will be considered on the basis of the findings.Locally, the Department is funding tobacco control alliances across England to work in communities to raise awareness and to increase the number of smoke-free environments. Findings from these projects will inform future development of the Department's work in this area. The Department of Health will, in addition to action already under way, develop education and information resources to raise awareness and understanding of the risks associated with passive smoking.

Chris Grayling: To ask the Secretary of State for Health if he will place in the Library the Medicines Control Agency's (a) analysis of consumers' reasons for using Kava-kava, and potential hazards created by regulating kava-kava off the market and (b) assessment of consumers accessing Kava-kava product of unknown quality via the Internet and other direct marketing strategies. [91475] Ms Blears: Unlicensed herbal remedies containing kava-kava on sale before The Medicines for Human Use (Kava-kava) (Prohibition) Order 2002 came into force could only lawfully have been sold without any written indications. Traditionally Kava-kava has been used to treat anxiety, tension, restlessness and bladder discomfort. However, consumers may use Kava-kava for many reasons. The test for making a prohibition order under section 62 of the Medicines Act 1968 is whether this is necessary in the interests of safety. Any website reported to the Medicines Control Agency (MCA) that appears to be in breach of regulations regarding advertising, sale and supply of medicines is investigated. The MCA works closely with other Government Departments and law enforcement authorities, both in the United Kingdom and abroad, in an effort to identify and take action where appropriate. There is evidence, both from the UK and internationally, that some unlicensed herbal remedies may be of poor quality and in some cases may pose a threat to public health. However, this problem is not restricted to products sold on the internet or via other direct marketing strategies. Subject to the successful conclusion of negotiations, the proposed Directive on Traditional Herbal Medicinal Products would provide a regulatory regime, which should allow the public to choose from a wide range of herbal remedies, made to assured standards of safety, quality and information. In turn this would make it possible for the public to be given much clearer advice than is currently possible about how to avoid unregulated herbal medicines which may pose a risk to health. A number of papers are available in the Library relating to the considerations which led to The Medicines for Human Use (Kava-kava) (Prohibition) Order 2002. Beyond these the MCA does not hold additional analyses covering the issues raised in this question.
