The Foreign Secretary stated the position very clearly in yesterday’s debate. We certainly do not rule out such an inquiry, and our motion stated that lessons must, of course, be learned, which is always important, but this is not the time for such decisions. Had that motion gone through last night, it would have sent a signal that would have dismayed our coalition allies and the Iraqi Government and heartened all those who are fighting us in Iraq. That is why we opposed the motion and why it is important that we stand up and fight those in Iraq who are trying to prevent the democratic process from taking root.

Let me explain something to the right hon. and learned Gentleman. British troops have been in Iraq for three and a half years with a United Nations resolution. When British forces are trying to help those who want democracy to function in Iraq, and when American forces are trying to make sure that that democratic process is secured, they are not simply acting on behalf of America or Britain; they are acting in accordance with a United Nations resolution and with the full support of the Iraqi Government. The trouble with Liberal Democrat Members is that they want to pray the United Nations in aid when it suits them, but when it does not suit them, they ignore it.

For very obvious reasons, I think that it would be wrong for me to comment on anything that the Attorney-General may do in relation to that case. Once again, however, I would like to extend my deepest sympathy to Mr. Lloyd’s family.

But surely we are entitled to question the strategy to which the Government are committed. Is it not clear that the opinions expressed by General Dannatt, Brigadier Butler, Senator John Warner and now James Baker only lead to one conclusion—that the Government’s strategy has failed? I suspect that the right hon. and learned Gentleman believes that we should simply leave Iraq. That would be a mistake. Let me explain to him again that it is important to understand that if we desert the Iraqi Government now, when they are building up the Iraqi forces to take over security, it would be a gross dereliction of our duty to them. Incidentally, our mission in Basra, where, as we speak, British soldiers working alongside Iraqi forces have already gone through four of the 16 areas that are part of the process, is vital in restoring proper law and order to that city. If we got out now, when the job was not done, and simply deserted the situation, what good would that do, other than to ensure that those who support the extremists around the world gained heart from it? Of course, we should all debate the strategy, but the strategy is clear: progressively to withdraw as the Iraqi capability is put in place, and not to desert the democrats but to support them.

It is correct that innocent civilians are dying in Iraq. But they are not being killed by British soldiers. They are being killed by terrorists and those from the outside who are supporting them, in defiance of the United Nations resolution that says the future of Iraq should be determined democratically by the Iraqi people. Whatever disagreement people have with the original decision on Iraq, I would have thought that we should all now support the United Nations and Iraqi Government position that we should stand up against the extremists and in favour of the democrats.

British forces should remain in Iraq until the job is done. Incidentally, they are there in Iraq—this is important to emphasise—and have been there for three years with full United Nations authority and with the consent of the first-ever democratically elected Iraqi Government. They are doing a magnificent job there. We owe them a huge debt of gratitude. That country wants its democracy to work, and that is why it is important that they stay until the Iraqi forces are capable of engaging with their own security themselves.

It might not surprise the right hon. and learned Gentleman to learn that I am not personally responsible for closing Guantanamo Bay. I agree that it is an anomaly that should be closed; I have said that all along. However, it is important to recognise that in Iraq and Afghanistan we are fighting a battle against the same forces of terrorism that want to disrupt our way of life here and to kill people. This is a global struggle, and it is right that Britain stand firm with its allies in engaging in that struggle and defeating the enemies of democracy and freedom.

Ethnic, religious and tribal loyalties are widespread within Iraqi society. Part of the reform and democratisation process of Iraqi institutions is the removal of those individuals whose loyalties are not to the state. The performance of the Iraqi Interior and Defence Ministries and of the Iraqi Security Forces will be important factors in determining the rate of transfer to Iraqi control of security and we continue to make detailed capability assessments of the Iraqi Security Forces within the UK area of responsibility.

[holding answers 20 December 2005 and 26 January2006]: Centrally available records show that some 230 UK personnel have been treated at UK medical facilities in theatre for wounds received as a result of hostile action between March 2003 and December 2005¹.Our Notification of Casualty reporting records also allow us to give a figure for those categorised in theatre as Very Seriously Ill/Injured/Wounded (VSI), meaning that their life was imminently endangered. Some 40 personnel were categorised as VSI as a result of injury or wounds, however caused, in Iraq between March 2003 and December 2005².Separate records show that between February 2003 and December 2005 some 4,000 military and civilian personnel (including a few Iraqis) have been medically evacuated from theatre. The great majority of cases were due to illness or accidental injury and not as a result of hostile action.The MOD intends to publish casualty figures for Iraq on the MOD website in the next few weeks, identifying the number of personnel categorised as ““Seriously Injured”” and ““Very Seriously Injured””. The figures will be updated regularly. I will write to inform the hon. and right hon. Members prior to the first publication.The Ministry of Defence keeps records of all armed forces personnel currently serving and where they are located. The Veterans Agency maintains up to date records of those troops that have been medically discharged in order to pay their medical pensions."¹ Before October 2004, we only have centrally held records for the Shaibah UK Field Hospital. The figure does not include, for example, UK casualties of hostile action who were treated either by other UK Field Hospitals (early stages of operation only—for which unit records are not held centrally) or by coalition partners, or those with more minor injuries who did not receive Field Hospital treatment. From October 2004, the figure relates to all those wounded who were treated in any of the UK medical facilities in the UK-led Multi-National Division South East MND(SE) area. This figure excludes any personnel who subsequently died."² The VSI figure excludes any personnel who subsequently died.

None of the individuals held by UK forces have been charged with a criminal offence. They are held because they are judged to be an imperative threat to security as coalition forces are authorised to do by International and Iraqi law. All of them are entitled to obtain independent legal advice regarding their detention.The divisional temporary detention facility is subject to regular inspections by the ICRC.

Iraqis detained by the United Kingdom forces are either criminal detainees or security internees. Criminal detainees are transferred as soon as practically possible into Iraqi custody on their detention by UK forces, usually within eight hours. Security internees are detained and then held at the Divisional Temporary Detention Facility at Shaiba.Records held in MND(SE) show that 105 security internees have been transferred into the Iraqi criminal justice system since 1 January 2004.We do not keep figures on the number of criminal detainees placed immediately into Iraqi custody. This is routine business for UK forces and transfers occur very frequently.Following the end of hostilities in Iraq and the completion of the UK's prisoner release programme, a total of 358 prisoners taken into custody by the UK were transferred to US custody at Camp Bucca. With the opening of the UK's Divisional Temporary Detention Facility in December 2003, they, along with further individuals transferred into US custody in the meantime, were either released, or transferred back to UK custody.A further 18 security internees have been transferred to US custody at various times. All but four have been released.Once individuals have been transferred into the Iraqi legal system they become a matter for the Iraqis. We do not hold information on how many are subject to prosecution in the Iraqi courts. I met with the Iraqi Minister of the Interior on 4 December and made clear to him the international community's view that Iraq must have suitable systems of detention, trial and incarceration in line with its international obligations.

[holding answer 15 November 2005]: Iraqis detained by UK forces are either criminal detainees or security internees. Criminal detainees are transferred as soon as practically possible into Iraqi custody on their detention by UK forces, usually within eight hours. Security internees are detained and then held at the Divisional Temporary Detention Facility (DTDF) at Shaibah.The table gives a monthly breakdown of the number of internees entering the DTDF from its opening in December 2003 to the present. Once security internees are no longer judged to be an imperative threat to security they are released. There are currently 35 internees in the DTDF.Before the DTDF was opened, security internees detained by UK forces were transferred into US custody at Camp Bucca. In total, around 1,000 individuals detained by UK forces were interned at Camp Bucca. We do not hold a monthly breakdown for this period.We do not have a record of the number of Iraqis convicted in Iraqi courts. This is a matter for the Iraqis.The Ministry of Defence does not keep any record of the number of Iraqis convicted in Iraqi courts of offences connected to insurgent activity since March 2003. This is a matter for the Iraqi Ministry of Justice.

The paper referred to during the evidence session was a United States report, produced by a team led by General Luck, a retired US General. It was an audit of the coalition's campaign plan in Iraq, in particular the training and development of the Iraqi Security Forces (ISF). During the evidence session with the Liaison Committee, I said that I hoped the paper would be published, but noted that it was still being considered by the US Government. Following this, the US Government decided not to publish this report. As this was a US report, this was a matter for the US Government to decide.

[holding answer 28 November 2005]: The Coalition Provisional Authority (CPA) ceased operating in Iraq at the end of June 2004, at which point control of the Development Fund for Iraq (DPI) was transferred to the sovereign Government of Iraq. We continue to encourage the transparent management of public funds by the Iraqi Government.The UK is providing economic technical assistance to the Iraqi Government to improve the transparency and management of public expenditure through reforms to the budget cycle. A team of UK-funded advisers also works closely with the Iraqi Ministry of Finance on essential reforms to the subsidy system which will help to improve transparency in public funds. The UK is also helping to build up the capacity of the Prime Minister's Office, the Iraqi Cabinet Office, the Ministry of Interior, and the southern Provincial Councils. This work is supporting the development of an effective Iraqi civil service which is able to administer public funds in a more accountable way. Earlier this year the National Audit Office hosted a study tour for the Iraqi Supreme Board of Audit to compare current practices. In addition, the UK is encouraging Iraq to sign up to the Extractive Industries Transparency Initiative and to the UN Convention for Anti-Corruption.The role of the International Advisory and Monitoring Board (IAMB) is to act as an audit oversight body for DPI. Its purpose is to help ensure that the DPI is used in a transparent manner for the benefit of the people of Iraq and that export sales of petroleum, petroleum products, and natural gas from Iraq are consistent with prevailing international market best practices. IAMB membership includes representatives from the International Monetary Fund, World Bank, UN Secretary General's Office, Arab Fund for Economic and Social Development and Iraq's Ministry of Finance. External audits of the IAMB have been carried out by KPMG, The UK is not directly involved with the IAMB.

[holding answer 28 November 2005]: The Coalition Provisional Authority (CPA) ceased operating in Iraq at the end of June 2004, at which point control of the Development Fund for Iraq (DPI) was transferred to the sovereign Government of Iraq. We continue to encourage the transparent management of public funds by the Iraqi Government.The UK is providing economic technical assistance to the Iraqi Government to improve the transparency and management of public expenditure through reforms to the budget cycle. A team of UK-funded advisers also works closely with the Iraqi Ministry of Finance on essential reforms to the subsidy system which will help to improve transparency in public funds. The UK is also helping to build up the capacity of the Prime Minister's Office, the Iraqi Cabinet Office, the Ministry of Interior, and the southern Provincial Councils. This work is supporting the development of an effective Iraqi civil service which is able to administer public funds in a more accountable way. Earlier this year the National Audit Office hosted a study tour for the Iraqi Supreme Board of Audit to compare current practices. In addition, the UK is encouraging Iraq to sign up to the Extractive Industries Transparency Initiative and to the UN Convention for Anti-Corruption.The role of the International Advisory and Monitoring Board (IAMB) is to act as an audit oversight body for DPI. Its purpose is to help ensure that the DPI is used in a transparent manner for the benefit of the people of Iraq and that export sales of petroleum, petroleum products, and natural gas from Iraq are consistent with prevailing international market best practices. IAMB membership includes representatives from the International Monetary Fund, World Bank, UN Secretary General's Office, Arab Fund for Economic and Social Development and Iraq's Ministry of Finance. External audits of the IAMB have been carried out by KPMG, The UK is not directly involved with the IAMB.

[holding answer 23 November 2005]: The number of security internees fluctuates due to the continuous review and release programme and the continuing need to detain individuals for imperative reasons of security. On 18 November 2005, the UK did not hold any individuals under the age of 18 years of the total (33) held by the UK. The US Government has told us that, on 14 November 2005, they were holding approximately 250 security internees who are aged under 18 years old.

[holding answer 17 November 2005]: The Ministry of Defence does not contract any private military companies or private security companies in Iraq, and we hold neither employment records nor company policy documents for those which do operate there. Contractors working for Coalition nations are immune from Iraqi legal process only with respect to acts performed by them pursuant to the terms and conditions of a contract or sub-contract. Otherwise, they must respect all relevant Iraqi laws, including Coalition Provisional Authority order regulations, orders, memoranda and public notices.
