Mr. Steen: To ask the Secretary of State for Health how many prosecutions have been initiated in each of the last five years for labelling of food content which was deliberately misleading; and what percentage of those prosecutions related to the salt content. [223843] Miss Melanie Johnson: [holding answer 24 March 2005]: Information is not held centrally on the number of prosecutions for labelling of food offences which were deliberately misleading, or which related to salt content. In line with the requirements of the European Union's Official Control Directive (OCD) 89/397, the data on prosecutions collected from local authorities by the Food Standards Agency (FSA) is reported under seven generic headings, one of which is "labelling and presentation". In accordance with the relevant European Union guidance, each type of enforcement action is only recorded once per premises per year. The FSA currently holds information for the five years covering the period 1999 to 2003. The numbers of premises subject to prosecutions initiated in the United Kingdom under the heading of "labelling and presentation" during the years 1999, 2000, 2001, 2002 and 2003 are shown in the table. _________________________________________________________________________________________________. Mr. Letwin: To ask the Secretary of State for Trade and Industry what plans she has to ensure that FSA rules prevent credit card companies from (a) setting minimum payments below the interest charge, (b) failing to show the APR clearly on statements and (c) implying that an interest-bearing period is interest- free. [101614] Miss Melanie Johnson :[holding answer 7 March 2003]: The provision of information on credit card statements is regulated by the Consumer Credit Act 1974, and in particular by the Consumer (Running- Account Credit Information) Regulations 1983 (SI No. 1570/83). These require statements provided for running-account credit agreements, such as credit cards, to contain the following information: any opening balance on the account; the date of any movement on the account; the amount of any payment on the account; the amount of any drawing on the account; and the amount of any interest or other charges on the account. Where a statement shows that interest has been applied to the account, it must contain either sufficient information for the customer to be able to check the calculation of that interest; details of the rate of interest that has been applied; or a statement indicating that the rate of interest applied will be provided upon request. The form and content of consumer credit advertising is governed by the Consumer Credit (Advertisements) Regulations 1989 (SI 1989/1125). These are enforced by the Office of Fair Trading, and I understand that the OFT has investigated a number of credit providers who have advertised interest-bearing agreements as being interest-free. The practice of some credit card providers of reducing the minimum required monthly repayment is one that I highlighted in my response in January this year to the Second Report of the Governments' Task Force on Tackling Overindebtedness. I stated then that I was worried about the effects that this practice can have on consumers, and in particular that it can only lead to an escalation of the total amount owed and the time required to repay it. I stated that the Government would therefore be considering how consumers might be given better information about the effects of a low minimum payment. To that end, and as part of the review of the Consumer Credit Act that I launched in July 2001, I shall be publishing a consultation document on the simplification of the credit advertising regulations in the summer. As well as inviting comments on minimum payments, this will also look at how consumers can get better information in general about credit cards that will enable them to compare offers from different providers. In advance of this consultation, the DTI is in regular discussion with the credit industry and consumer bodies on the scope for a common format for the provision of key information, including details of interest-free periods and the calculation and advertising of APRs.

Mr. Cohen: To ask the Chancellor of the Exchequer what recent representations he has received about the mis-selling of endowment policies; what remedies are available to holders of endowment policies which do not realise sufficient capital on maturity to meet the mortgage repayment commitment; and if he will make a statement. [107128] Miss Melanie Johnson: The advice and selling of endowment policies is fully regulated by the Financial Services Authority (FSA). On 21 December, FSA announced the conclusions of recent work on endowments. FSA concluded that on average holders of mortgage endowments have enjoyed returns which mean they have fared at least as well as they would have done with a repayment mortgage, and that there were no grounds for an industry-wide review of all past business. However, targeted visits to product provider and independent financial adviser firms show current selling practices to be poor. As part of its normal regulatory activities, the FSA will make follow-up visits to check for marked improvements in sales practices by the end of 2000. The FSA will not hesitate to take disciplinary action where appropriate if standards remain poor. For investment business, including the sale of endowment policies, a redress mechanism has been established under the Financial Services Act 1986. Advisers and sellers of financial products, including endowment policies, are obliged to follow rules established under the Act which are designed to protect the financial interests of investors. The rules focus on giving best advice and assessing the suitability of proposed products to the investor's circumstances. An endowment policy holder with a loss resulting from non-compliance with these rules can complain to the firm involved. If the firm cannot settle the complaint, the Personal Investment Authority Ombudsman has the power to require firms to pay compensation in appropriate cases.

Mr. Andy King: To ask the Chancellor of the Exchequer (1) how many claims arising from the mis-selling of pensions are outstanding; and what assessment he has made of the timescale for their resolution; [104314] (2) how many claims arising from the mis-selling of pensions have been resolved to date; [104315] (3) how many people have been affected by the mis-selling of pensions in the last 10 years. [104313] Miss Melanie Johnson: The regulators split the industry's work on the personal pension mis-selling review into two phases. During phase 1 firms were required to address the most urgent cases, where for example pensioners had died, or retired, or were close to retirement. Phase 2--which began in 1999--addresses less urgent cases, mostly younger people. The mis-selling of personal pensions took place during the period April 1998-June 1994 and the statistics given in this answer cover the mis-selling over that period. It is not practical to provide figures for the period from January 1990. The people affected by personal pension mis-selling are those who were mis-sold a pension and who were subsequently entitled to redress. The phase 1 review has led to offers of redress to 410,000 people. About 17,000 phase 1 cases are outstanding. This represents about 2 per cent. of all the cases included in the phase 1 review. These are typically difficult cases or cases which have only recently been identified as proper to phase 1. The Financial Services Authority closely monitors the firms responsible for these outstanding phase 1 cases. The total population to be examined under phase 2 is in excess of 800,000. About 114,000 cases have already been dealt with, and offers of redress have been made in about 90,000 cases. About 700,000 further cases are likely to be dealt with during the rest of the phase 2 review. Not all of these investors will be entitled to redress. The timetable is for all phase 2 case reviews to be completed by June 2002. It is too soon to say how many investors overall are likely to be offered redress under the two phases of the review.
