Mr. Dobbin: To ask the Secretary of State for the Environment, Transport and the Regions what steps his Department is taking to
transfer freight from roads to rail. [120845]
Mr. Hill: Our policy is to help to establish an integrated, sustainable freight distribution system, both to support economic growth
and to bring social and environmental benefits. The Strategic Rail Authority, already operating in shadow form, will have a duty to
promote rail freight. In the three years beginning April 1997 we have provided £81 million in grants to move freight from road to
rail or inland waterways. We have issued guidance to local authorities to facilitate more use of rail for freight, and our
forthcoming 10 year Transport Plan will set out the Government's longer term strategy.

Official Report, column 427W, on 44 tonne lorries, what studies he has (a) carried out and (b) commissioned on the effect on (i)
rail freight and (ii) the environment of allowing the use of 44 tonne lorries; if he will publish data on the expected level of
direct transfers between road and rail freight following the introduction of such lorries; and if he will list the measures the
shadow Strategic Rail Authority is planning to support rail freight. [118841]
Mr. Hill: In its interim report "Permitting 44 tonne lorries for general use in the UK", the Commission for Integrated Transport
considered carefully the impact of 44 tonne lorries on the rail freight market.
The Government accept the Commission's view that the overall environmental advantage lies in allowing 44 tonne lorries to operate
generally. Not only will the efficiency savings result in a substantial reduction in lorry mileage but the use of 6-axle lorries,
with a lower drive axle weight, will cause less wear to roads and bridges than existing 40 tonne, 5-axle vehicles already on our
roads. This is based on research carried out by the US Highways Research Board, and confirmed by the UK Transport Research
Laboratory and by work carried out in Germany.
The Commission concluded that further work to estimate the precise effect on rail freight's market share would be unlikely to
produce reliable results in the light of the Rail Regulator's forthcoming review of track access charges and other factors.
The Government set up the shadow Strategic Rail Authority (sSRA) with a remit to develop detailed recommendations on measures to
promote the growth of rail freight. That work will help inform our 10-year plan for transport, due to be published in the summer,
and the Commission's final report on 44 tonne lorries, expected in the autumn.

Mr. Hill: [holding answer 30 March 2000]: Vehicle Excise Duty (VED) is a matter for the Chancellor of the Exchequer. In his 1999
Budget, the Chancellor made clear that a high VED rate had been set for the new 40-tonne, 5-axle vehicle first allowed in the UK
from 1 January 1999 in order to discourage its use on UK roads. This was in view of the significant extra road damage caused by
lorries running these new 11.5 tonne axle weights.
The Changes the Chancellor made to VED rates for goods vehicles in his recent Budget and the reasons for them are explained in
paragraphs 6.69 to 6.72 of the Economic and Fiscal Strategy Report, published on 21 March 2000. The VED rate of £5,750 set for the
new, road-damaging 40-tonne lorry on 5-axles in Budget 99 has successfully discouraged its use by domestic hauliers. However, now
that domestic hauliers who need the highest weight limits have the option to use the less damaging 6-axle 44-tonne lorry within the
UK, the only UK hauliers who still need to use the 40-tonne lorry are international operators using continental roads with 40-tonne
lorry weight limits.
To boost the competitiveness of these international hauliers, the Government are cutting the VED rate for the 40-tonne lorry on
5-axles from £5,750 to £3,950. The rate for the less road-damaging 38-tonne lorry on 5-axles will be reduced by £500 to encourage
its continued use, and there will also be a reduction of £500 for the lorry typically used to collect freight from UK ports to boost
the competitiveness of hauliers in this sector.
The Government will continue to monitor trends in vehicle purchasing and plating decisions and in volumes of road haulage movements,
while a sub-group of the Road Haulage Forum will continue to review the costs which different lorry types impose on the environment
and the roads. This work will inform the Chancellor's future decisions on VED rates for goods vehicles.

Mr. Hill: My right hon. and noble Friend the Minister for Transport recently announced the Government's decision to set a target
date of 1 January 2001 for raising the maximum general lorry weight limit to 44 tonnes for lorries with six axles, a maximum drive
axle weight of 10.5 tonnes and Euro II or better engines. This is not connected with EU legislation. The decision follows the
publication of an interim report by the Commission for Integrated Transport (CfIT) on permitting the general use of 44 tonne
lorries. CfIT commissioned independent work from Professor Alan McKinnon of Heriot-Watt University to assess the environmental
effects including the possible effects on rail freight. This work showed a clear net environmental gain from allowing 44 tonne
lorries.
The Integrated Transport White Paper set out our aim to establish an integrated, sustainable freight distribution system to support
economic growth and to bring social and environmental benefits. To that end we are keen to support rail freight where it is
practicable and good value for money. We are equally keen on improvements to efficiency in other modes, including road transport,
where these meet the same ends.
The Government accept CfIT's view that allowing 44 tonne lorries for general use could have a negative effect upon rail freight
traffic, both existing and predicted. The shadow SRA are considering proposals for rail freight and their strategy will include
proposals to support rail freight.

Mr. Hill: All road hauliers, freight operators and drivers must abide by the road traffic regulations on, for example, the fitting
and use of speed limiters and drivers' hours. Within the context of these and other regulations governing the way in which the
industry is operated, payment schemes are a matter for industry itself. The Vehicle Inspectorate collates intelligence on vehicle
operators and, where there is a suggestion that the payment of incentives is encouraging malpractice, they will investigate.

Mr. Hill: The latest available figures are for 1998 when heavy goods vehicles travelled 32 billion vehicle kilometres in Great
Britain, accounting for 7 per cent. of all motor traffic. During the same period, 152 billion tonne-kilometres of freight were
moved, and 1,630 million tonnes of freight were lifted, by heavy goods vehicles.

Mr. Dobbin: To ask the Secretary of State for the Environment, Transport and the Regions what was the outcome of the Transport
Council held in Brussels on 9-10 December; and if he will make a statement. [102635]
Mr. Hill: The Transport Council met in Brussels on 9-10 December. My right hon. and noble Friend Lord Macdonald of Tradeston
represented the United Kingdom.
The Council reached political agreement on a package of three draft directives, which take the opening of the internal market for
rail services a significant step further. The package will amend Directives 91/440 and 95/18 and replace Directive 95/19. It will:
provide open access for rail freight operators to a Trans-European Rail Freight Network (TERFN), which includes all major terminals
and ports; broaden the scope of existing provisions for separation of accounts and certain essential functions between
infrastructure management and train service operations; extend Community-wide recognition of train operators' licences to all
railway undertakings established in the Community; and establish rules for allocating capacity on railway infrastructure and
charging for its use. Conclusions were also adopted on improving interoperability and alleviating rail bottlenecks
The Commission gave a progress report to Council on the definition phase of the Galileo satellite navigation project, including a
report on discussions with the US and Russia. Lord Macdonald expressed the UK's disappointment at the pace of work on public-private
financing and cost benefit analysis. He said that more work was needed to enable decisions to be taken at the end of 2000 on the
future development of satellite navigation in Europe.
There was a debate on the establishment of a European Aviation Safety Authority. The Commission proposed that the new authority
should be set up as a Community agency. The UK and some other member states argued that an international body was preferable, as the
Council had previously agreed. It would be genuinely pan-European and would have the support of the aviation industry. Following the
debate, the Presidency asked the Commission to produce an analysis of its proposal for a Community agency, but also to begin
exploratory talks with third countries.
The Commission gave a presentation to the Council on air traffic management in Europe. Referring to lack of ATM capacity as a cause
of increasing delays, and to the need for greater cooperation between states, the Commission proposed centralised management of a
"Single European Sky". The Commissioner, Mrs. de Palacio, proposed that she should chair a high level group of member states'
representatives, to study the issue. It would aim to report to the Transport Council in June 2000.
The Council discussed aviation noise problems. The Commission reported on the latest developments in the International Civil
Aviation Organisation (ICAO) on international standards and on its recent consultations with the United States. The Council
reaffirmed its commitment to the ICAO process, and repeated that, if the outcome was successful and met the EU's objectives,
existing Community legislation could be replaced by new international rules if these were more favourable. The Commission was
invited to look at the issue urgently and propose solutions.
The Commission presented a study on the economic impact of the draft directive on ferry manning, which would ensure that conditions
for third country crew members on intra-EC ferry services were at least as favourable as those of EC crew members. The study
suggested that the impact would be negligible. The Commission's view remained that the directive would protect jobs in the EU. The
UK and some other member states welcomed the report and strongly supported the proposal, which was first put forward during the UK
Presidency. The Council will return to the issue at a later date.
The Council held a further debate on proposals for the extension of working time provisions to road transport. There remains
disagreement between member states on fundamental issues, including application to the self-employed. Following the debate, the
Presidency concluded that the Council should continue to look for solutions.
There was a progress report from the Commission on negotiations with ten Central and Eastern European countries on extension of the
aviation single market.
The Council adopted Resolutions on the promotion of short sea shipping and on ways to encourage the greater use of intermodal
freight transport. It also adopted a mandate authorising the Commission to commence air transport negotiations with Cyprus.
There were also Commission reports on: indicators on transport and the environment; the recent report of the forum on barriers to
innovation in transport, which aimed to produce an action plan by the end of 2000; Community accession to Eurocontrol, on which the
Commission hoped that an Accession protocol could be signed at the MATSE VI Conference of aviation Ministers on 27 January; the
recent aviation open skies conference in Chicago; and a Commission Communication on air transport and the environment.

Mr. Hill: Goods vehicle road trains, ie a lorry towing a trailer, meeting the technical requirements of the Road Vehicles
(Construction and Use) Regulations 1986, as amended, and the Road Vehicles (Authorised Weight) Regulations 1998 are generally
allowed to operate in the UK. However, they may be subject to local restrictions.
There are also in existence some small vehicles that carry passengers in trailers which cannot meet the definition of a public
service vehicle and cannot be used as such. They are individually authorised, generally to operate on limited sightseeing routes.
