The Government remains committed to introducing statutory Local Authority registers for children not in school, as well as a duty for Local Authorities to provide support to home educating families. The Department will legislate for these at a future suitable opportunity, to support Local Authorities to undertake their existing duties to ensure that all children receive a suitable education and are safe, regardless of where they are educated.
Since 2016, the Department and Ofsted have worked successfully with the Crown Prosecution Services to secure criminal convictions against those responsible for five settings that were operating illegally as schools. The Government has recognised the need to improve powers to investigate and act against such settings. The Department remains committed to legislating for these powers at a future suitable opportunity.

To ask the Secretary of State for Education, what assessment she has made of the adequacy of the average time taken to register a new school; and whether she is taking steps to reduce processing times.
The Department acts as the regulator of independent schools on behalf of the Secretary of State for Education. The Department’s registration guidance document is clear that the process for registering a new independent school can take around six months from receipt of a complete application. The Department is content that this target is being met. For the period February to June 2023, it has taken on average 23 weeks to reach a decision on registration from the date on which a complete application was submitted.
The Department follows a robust set of processes that aim to safeguard and protect children and ensure that only applications that are likely to meet all of the independent school standards (ISS) are approved for registration. Schools not meeting the ISS are not providing a safe and suitable education for children. The Department’s processes include a mandatory pre-registration inspection conducted by Ofsted on the degree to which the ISS are likely to be met in this school. Any proposal to reduce the processing time must ensure that the safety and wellbeing of children is not reduced through more limited scrutiny of new applications.

To ask the Secretary of State for Education, if she will make an assessment of the potential impact of introducing a statutory registration system for children not in school on home educators.
The Department completed all relevant and required impact assessments when the Children Not in School measures were part of the Schools Bill.
The Children Not in School measures were subject to a thorough equalities impact assessment, which considered the impact on families with different protected characteristics, and a regulatory impact assessment which looked at the impact measures will have on businesses and charities. A summary of these impact assessments have been published online as part of the Schools Bill impact assessment document, which can be found here: https://www.gov.uk/government/publications/schools-bill-impact-assessment.
The Department also conducted a Local Authority new burdens assessment in relation to the implementation and maintenance of the register, and the Department is in the process of finalising our data protection impact assessment with the Information Commissioner’s Office prior to the Schools Bill being discontinued. This remains with the Information Commissioner’s Office for consideration.
When a suitable legislative opportunity arises to take forward the Children Not in School measures, all necessary assessments will be reviewed.

Under Section 97 of the Education and Skills Act 2008, His Majesty’s Chief Inspector is able to inspect without notice any institution where she has reasonable cause to believe that the criminal offence of conducting an unregistered independent school is being committed.
As these inspections form part of ongoing criminal investigations, it is not possible to provide real-time updates on the number and outcomes of these inspections. This includes the number of ongoing investigations and the number of suspected unregistered independent schools which are currently operating.

It is a criminal offence under Section 96 of the Education and Skills Act 2008 to conduct an unregistered independent school. The Department and Ofsted continue to investigate institutions believed to be operating illegally.
There are currently 10 institutions under investigation on suspicion of operating an unregistered independent school.
