Caroline Flint: The confiscation and restraint powers in the Proceeds of Crime Act 2002 are triggered by offences committed after
the provisions were brought into force on 24 March 2003.
The information available relates to confiscation order receipts received by the West Midlands magistrates courts committee area.
The total value of confiscation order receipts recovered in the West Midlands under proceeds of crime legislation was £2,967,853 in
2002-03, and £1,308,343 in 2003-04. The total value of confiscation order receipts recovered in the West Midlands under the Proceeds
of Crime Act 2002 in 2003-04 was £5,724 and £66,631 at the end of the second quarter in 2004-05.
The value of restraint orders obtained under the Act by the Crown Prosecution Service in the West Midlands was £275,320 in 2003-04
and £1,085,000 by the end of the second quarter in 2004-05. Information on the value of restraint orders obtained by HM Customs and
Excise is not available. As at the end of September 2004 the Assets Recovery Agency had 40 civil recovery cases subject to freezing
orders with a total value of £19.8 million.

Caroline Flint: The total value of criminal assets recovered under all proceeds of crime legislation was £47 million in
2002-03 and £54.5 million in 2003-04. The £47 million comprises £41 million in confiscation orders and
£6 million in cash forfeitures. The £54.5 million comprises £38.9 million in confiscation orders and
£15.6 million in cash forfeitures.
The confiscation and restraint powers in the Proceeds of Crime Act 2002 are triggered by offences committed after the provisions
were brought into force on 24 March 2003.
The total value of receipts recovered under the Act in 2003-04 was just over £5 million comprising £4.7 million in
cash forfeitures and £343,671 in confiscation order receipts. Information on the value of cash forfeitures broken down by region is
not available. Table A shows the value of confiscation order receipts under proceeds of crime legislation broken down by magistrates
courts committee areas in 2002-03 and 2003-04.
Table B shows the value of restraint orders made in 2003-04 under the Proceeds of Crime Act 2002 by the Crown Prosecution Service
broken down by area. Information on the value of restraint orders made by HM Customs and Excise is not available. In 2003-04 the
Assets Recovery Agency had 24 civil recovery cases subject to freezing orders with a total value of £14.1 million.

Mr. Dismore: To ask the Secretary of State for the Home Department which organisations, and at which level, will be able to bid for
sums from the Recovered Assets Incentive Fund; whether bids will be permitted direct from (a) police operational command units and
(b) local crime and disorder partnerships; against what criteria bids will be assessed; what amount he expects to be available under
the Fund in (i) this and (ii) the next financial year; and if he will make a statement. [133906]
Caroline Flint: The Recovered Assets Incentive Fund was set up this financial year to incentivise asset recovery by asset recovery
agencies including law enforcement and prosecuting authorities. £15.5 million a year for three years has been allocated to the Fund.
The funds have been fully committed over the next three years to projects agreed by the Association of Chief Police Officers (ACPO)
and others, that will increase the confiscation of criminal assets. The fund is not open to bids from other organisations or
partnerships.
Of £46.5 million that will be available under the Fund over the next three years, up to £38 million will be spent on funding an ACPO
proposal to set up an additional four multi-agency regional asset recovery teams to disrupt organised crime groups and to confiscate
criminal assets. The teams will comprise staff from the police, National Crime Squad, Her Majesty's Customs and Excise, National
Criminal Intelligence Service, Crown Prosecution Service, Assets Recovery Agency and Inland Revenue. The balance of the Fund will be
spent on asset recovery projects managed respectively by the Crown Prosecution Service, the Department for Constitutional Affairs,
and the Assets Recovery Agency.
An additional £7 million a year for three years has been made available separately from the Recovered Assets Incentive Fund for
community projects. This year £4 million has been allocated to the Adventure Capital Fund to regenerate communities. The Adventure
Capital Fund Round 2 is open to applications from community- based organisations operating anywhere in England, which are engaged in
specified areas of activity including crime reduction and drug prevention, and which are seeking to achieve sustainability through
enterprise, while investing surpluses for community benefit. The Adventure Capital fund is not open to bids from other organisations
or partnerships.
£1.5 million has been allocated to anti-gun crime initiatives. £1.2 million of this is being disbursed by eight of the regional
government offices to projects that will help local communities in the most affected areas in tackling gun crime and gun culture.
The money has now been allocated and is not open to bids. £300,000 is being used to support the Disarm Trust, and it is open to
projects working to tackle gun crime in local communities to seek support or funding from the Trust. A further £1.5 million has been
allocated to regional government offices to fund capacity building in crime and disorder reduction partnerships.
Of the £7 million available for next year, £3 million has been committed to fund community justice centre pilot schemes. The balance
of £4 million is not yet committed but there are no plans to invite specific bids.

Caroline Flint: Information is available for the United Kingdom only.
The confiscation powers in the Proceeds of Crime Act 2002 are triggered by offences committed after the provisions were brought into
force on 24 March 2003, so it will be some time before cases are dealt with by the Crown Court in numbers. As of 16 October, nine
confiscation orders with a total value of £89,000 had been made against convicted offenders in England and Wales; these orders have
yet to be enforced. No confiscation orders under the new legislation have been made in Scotland. The total amount of cash seized by
police and customs officers under new powers in the Act which came into effect on 30 December 2002 is £41 million in England, Wales
and Scotland. In addition, the Assets Recovery Agency has obtained freezing orders on assets with a total value of over £10 million
on 16 cases which are under investigation under the new powers in the Act for civil recovery of criminal assets.

two confiscation orders with a value of £53,000 have been made against convicted offenders in England and Wales. The value of cash
seizures made under the new provisions in the Act which came into effect on 30 December 2002, and which are not dependent upon a
conviction, is £28.5 million. In addition, the Assets Recovery Agency has obtained freezing orders from the High Court in London and
Belfast on five civil recovery cases with a total value of £5.9 million.

Mr. Menzies Campbell: To ask the Secretary of State for the Home Department how much money held by Saddam Hussein's regime has been
seized by the Assets Recovery Agency; and if he will make a statement. [122615]
Caroline Flint: The Assets Recovery Agency has not seized any funds belonging to Saddam Hussein or his regime.
In accordance with the guidance given to the Director by the Home Secretary, the Agency will normally investigate cases only on the
basis of a referral from the law enforcement or prosecution authorities.
The United Nations Security Council Resolution 1483, passed on 22 May, requires that all funds, financial assets or economic
resources of Saddam Hussein, key members of his regime and their families, be frozen and transferred into the Development Fund for
Iraq to be used for the benefit and welfare of the Iraqi people.

confiscation order with a value of £38,000 has been made against a convicted offender. The value of cash seizures made under the new
cash seizure provision in the Act which came into effect on 30 December 2002 and which are not dependent upon a conviction is £25.6
million.
