Mr. Hopkins: To ask the Secretary of State for Transport if he will report progress on each of the bullet points on page 20 of the Department's Race Equality Scheme 2003-05. [176820] Mr. McNulty: [holding answer 7 June 2004]: In complying with the specific duties of Race Relations (Amendment) Act 2000 relating to employment, the Department has some monitoring systems in place, and where they are not, we are setting them up for any areas where monitoring has lapsed. We are monitoring by ethnic group applicants seeking employment by: the number of applications for employment; the numbers dropping out at different stages of the recruitment process; the numbers selected; the numbers successful and unsuccessful at different stages of selection; and the numbers accepting job offers. We also ask applicants to let us know where they found out about our vacancies. As regards staff working within the Department, we monitor by ethnic group, and gender: the numbers of staff in post; applicants for training; numbers receiving training; applicants for promotion, numbers selected, and numbers successful and unsuccessful at different stages of the process; appraisal mark distributions; distribution of performance-related pay or bonuses; harassment and discrimination complaints; those involved in grievances and disciplinary procedures; and ceased employment. Where analysis of this monitoring reveals any disparities, we will take appropriate action to address concerns. The results of monitoring, and impact of action taken to address issues identified will be reported to the Departmental Management Board. The Department reviewed its recruitment processes between November 2003 to January 2004. The findings are yet to be analysed, however, once analysis has taken place we will carry out implementation as appropriate. We have delivered training events on race awareness for staff involved interviewing and chairing for recruitment and promotions. In addition to this, we have held race equality impact assessment training for key staff, and race equality is featured in our Valuing Diversity programme of events being run throughout 2004. In 2003, we delivered diversity awareness workshops for untrained staff. The workshops were designed to challenge some of the stereotypes and misconceptions some managers might have about the ability of minority ethnic staff. We set up a Steering Group, with representation from the trade unions and our minority ethnic staff support network, to develop a career development programme for minority ethnic staff. It is hoped that the programme, to be launched early in 2005, might have some impact in helping to address their under-representation in more senior grades. The Department conducted a staff survey in November 2003. Among the outcomes were that 64 per cent. of black staff felt that they were treated with dignity and respect, compared to 76 per cent. of white employees although these differences are not statistically significant. Compared to benchmarking data on race, the Department for Transport performs well against other public sector organisations in those who claimed to have been unfairly treated on account of their race. The departmental figure is 3 per cent. below the benchmark. The survey also showed that black and Asian staff seem to be more likely to agree that they like working in the Department, but would prefer an alternative job within it (40 per cent. black staff and 47 per cent. Asian staff compared to 23 per cent. of white staff).

Angela Eagle: To ask the Parliamentary Secretary, Department for Constitutional Affairs what progress has been made in the Lord Chancellor's Department and non departmental public bodies on implementing the requirements of the Race Relations Amendment Act 2000; and if he will publish the results of the monitoring required by the Act. [117472] Mr. Lammy: The Department for Constitutional Affairs is fully committed to providing equality of opportunity and valuing diversity in everything it does. Our Race Equality Scheme was published by the Lord Chancellor's Department (as it then was) in May 2002 and sets out the action the Department will take to meet its statutory duties under the Race Relations (Amendment) Act 2000. The Scheme identifies the policies and functions of the Department that have a high relevance to meeting the general statutory duty and outlines the programme of action that is being undertaken in each case in order to meet that duty. Diversity awareness training has been provided for all permanent staff and we have incorporated diversity awareness into induction training for new staff. In accordance with the requirements of the Act we will publish a summary of the assessments, consultation exercises and monitoring we carry out and this will be included as part of the Equality and Diversity Annual Report. We will conduct a review of the Scheme in 2004 to assess which of our functions and policies are relevant to meeting the statutory duties and will publish a revised Scheme by 1 April 2005.

Angela Eagle: To ask the Solicitor-General what progress has been made in her Department and non- departmental public bodies on implementing the requirements of the Race Relations Amendment Act 2000; and if she will publish the results of the monitoring required by the Act. [117618] The Solicitor-General: [holding answer 20 June 2003]: The Crown Prosecution Service has made considerable progress on the implementation of their Race Equality Scheme to comply with the Race Relations (Amendment) Act 2000. The Crown Prosecution Service Race Equality Scheme was published and launched on May 2002. It is a three-year plan, which applies to all existing and future functions and policies developed by the Crown Prosecution Service. To comply with the Act, and action plans must be reviewed within three years. However, the Crown Prosecution Service has decided to review and publish updates on its Race Equality Scheme progress annually. The first update (Year One--Crown Prosecution Service Update 2002-03) is to be published shortly and will be available on the Crown Prosecution internet and internal intranet. An impact assessment form has been produced in consultation with the Commission for Racial Equality. The impact assessment form will be used to evaluate all policies and functions. The Equality and Diversity Unit has overseen the day-to-day delivery of the scheme, which has been reviewed on a regular basis by the Senior Managers Advisory Group on Diversity. The Crown Prosecution Service Board has also assessed progress annually. Training on the Race Equality Scheme for policy makers and key staff is due to be rolled out in July 2003. This will ensure that staff are aware of the Racial Equality Scheme and their duty under it. Training will also be given in how to complete the impact assessment forms to ensure that all local policies that do not fall under the banner of national policies comply with the Act and the Crown Prosecution Service Racial Equality Scheme. In relation to monitoring as stated by the Act, the Crown Prosecution Service is continuing to monitor employment statistics. These are available publicly in the Year One review. With regards to the monitoring of prosecutions, the Crown Prosecution Service has made a good start with a view to extending monitoring via the forthcoming new IT system. All national policies and functions have been reviewed and new policies have been written. A Public Policy Statement on Racially and Religiously Aggravated Crime has been written which has set up monitoring systems. It is due to be launched on 14 July 2003 by the Attorney-General. The Serious Fraud Office has made significant efforts to meet the requirements of the Race Relations (Amendment) Act 2000, especially in encouraging a positive approach to diversity issues and other employment practices. Its full Race Equality Scheme has yet to be published and it is working with the Commission for Racial Equality to complete this task as fully and as quickly as possible. HM Crown Prosecution Service Inspectorate attaches considerable importance to the principles of equality and diversity, both in relation to the inspection process and the management of HM Crown Prosecution Service itself. Under the Race Relations (Amendment) Act 2000, the Inspectorate has a general duty to promote race equality and the specific duty to set out and publish a Race Equality Scheme. In May 2002, the Inspectorate published its Race Equality Scheme drawn up in accordance with the provisions of the Race Relations (Amendment) Act 2000. The Scheme sets out the steps to be taken to ensure that its functions, policies and employment systems eliminate unlawful racial discrimination, promote equality of opportunity and promote good relations between persons of different racial groups. The Scheme also includes the specific duty in relation to employment issues which require HM Crown Prosecution Service Inspectorate to monitor the staff in post and applications for employment, promoting and training by their racial group. In fact, the Inspectorate has gone further by including gender, disability and age. The statistics are currently being compiled for the period ending 31 March 2003 and will be available shortly. HM Crown Prosecution Service has worked closely with the Commission for Racial Equality and other inspectorates in developing an inspection framework to underpin consistent and effective scrutiny of how inspected bodies are discharging their statutory functions under the Race Relations (Amendment) Act 2000. It has been incorporated with appropriate adaptations into the HM Crown Prosecution Service Inspectorate methodology. The Treasury Solicitor's Department, including the Legal Secretariat to the Law Officers, published its Scheme to Promote Racial Equality in May 2002, in accordance with the requirements of the Race Relations (Amendment) Act 2000. The Scheme is overseen by the Department's Diversity Group, which ensures equal opportunities good practice is upheld and monitored in the Agency, and which is currently in the process of carrying out a review of the Scheme one year after its launch, including employment targets. As a result of the Scheme so far, training in telephone technique has been undertaken by Bona Vacantia Division, to ensure race equality in dealing with public callers, some of whom do not speak English as a first language or understand English law or customs. The Diversity Group has also overseen an audit of external administrative recruitment since 2001 and made recommendations on monitoring. Details of employment monitoring will be published shortly, and thereafter each April and October.

Angela Eagle: To ask the Secretary of State for Health what progress has been made in his Department and non-departmental public bodies on implementing the requirements of the Race Relations Amendment Act 2000; and if he will publish the results of the monitoring required by the Act. [117621] Ms Rosie Winterton: The Department is committed to transforming the health and social care system so that it produces faster, fairer services that deliver better health and social care and tackle inequalities. Achieving sustainable improvements in health and services for black and minority ethnic people is an integral and vital aspect of this programme of investment and reform. The Department's Race Equality Scheme covers the Department, Executive Agencies and the Directorates of Health and Social Care. Strategic health authorities, primary care trusts, national health service trusts and special health authorities are subject to the Race Relations (Amendment) Act 2000 and are required to publish a Race Equality Scheme setting out how they intend to promote race equality within their organisation. The Department's strategy for meeting the needs of minority ethnic communities is to set action on race equality within the overall framework for planning and delivering the Department's priorities. The Department has a detailed programme of work under way to take forward our race equality commitments and has strengthened the arrangements for supporting and accounting for progress on race equality. A board level equality review programme has recently been carried out to develop a corporate framework for setting priorities and reviewing progress including those made in the Department's Race Equality Scheme. On 10 March 2003, the Department published "Inside Out", a report making recommendations for improving mental health services for black and minority ethnic groups. The report was developed with the close involvement of local communities and black and minority ethnic stakeholders and provides part of a race impact assessment on mental health. This has provided the evidence to show that there is impact, which is adverse, disproportionate and unjustifiable in terms of the Race Relations (Amendment) Act. The Department will be taking remedial action and will be publishing a remedial action plan for consultation in 2003. As required by its employment duties, the Department will be publishing a report later this summer on the ethnic monitoring data collected so far and also has a programme of work under way to put in place the additional monitoring arrangements required.

[117623] Alun Michael: One of the key values of the Department is to treat everyone fairly and to encourage, value and recognise everyone's views and contributions. This applies to the public and our external customers as well as to our staff. Defra's draft Race Equality Scheme, published last year, covered core Defra and the two smallest Agencies, the Pesticides Safety Directorate and the Veterinary Medicines Directorate. The remaining four Defra Agencies (the Centre for Environment, Fisheries and Aquaculture Research, the Central Science Laboratory, the Veterinary Laboratories Agency and the Rural Payments Agency) have each produced specific schemes and associated action plans. The draft Defra Scheme was the subject of a public consultation exercise in the autumn last year and has been revised in the light of comments received. A revised Race Equality Scheme will be published in the summer together with a report on progress of action, including the results of monitoring. The Departments non-departmental public bodies are expected to follow the lead of the core Department. I will write to my right hon. Friend separately to provide information on the action that they are taking to respond to the general duty.

Angela Eagle: To ask the Secretary of State for the Home Department what progress has been made in his Department and non-departmental public bodies on implementing the requirements of the Race Relations Amendment Act 2000; and if he will publish the results of the monitoring required by the Act. [117620] Fiona Mactaggart: The Home Office is committed to promoting equality and diversity for the communities we serve and also for our staff. This accords with the Department's purpose of working with individuals and communities to build a safe, just and tolerant society and our aim to support strong and active communities in which people of all races and backgrounds are valued and participate on equal terms. The Home Office published its Race Equality Scheme on 25 April 2002, in line with the requirements of the Race Relations (Amendment) Act 2000. We have identified a number of areas of our work as having a high potential impact on race equality and race relations, including policies on reducing crime and disorder, on police leadership, powers and relations with the public, on victims of crime, on drugs and on active communities, community cohesion and race relations. Our scheme commits us to assessing and consulting on new policies, and monitoring policies generally, for their impact on race equality and race relations. The Police Complaints Authority, National Crime Squad, National Criminal Intelligence Service and Commission for Racial Equality have all published race equality schemes in line with the requirements of the Act. Although not required to do so, the Central Police Development and Training Agency (Centrex) has also published such a scheme; and the Parole Board, which has already produced an action plan against racial discrimination, on which it has consulted the Commission, is preparing a scheme. Mr right hon. Friend the Home Secretary appointed Mary Coussey as Independent Race Monitor for ministerial authorisations to discriminate on grounds of nationality, and of national and ethnic origin, in immigration and nationality functions. Her first interim report was published in November 2002. The Prison Service is in the process of revising its Race Equality Action Plan to take account of issues raised by the Commission for Racial Equality following the Commission's formal investigation of the Service. The Home Office has published a number of reports setting out the results of monitoring of the position of minority ethnic people in relation to our policies and employment practices, for example the Statistics on Race and the Criminal Justice System 2002 report, published in March 2003; and the milestone report on the Home Secretary's Race Equality Employment Targets (covering staff targets for the Home Office and Prison, Police, Fire and Probation Services), published in January 2003. We are currently collating and analysing data from monitoring of the Home Office's own employment processes relating to the first year of operation of the Department's Race Equality Scheme and expect to be in a position to publish the results in September 2003.

Angela Eagle: To ask the Minister of State, Department for International Development what progress has been made in his Department and non- departmental public bodies on implementing the requirements of the Race Relations Amendment Act 2000; and if he will publish the results of the monitoring required by the Act. [117619] Hilary Benn: In accordance with the Race Relations Amendment Act 2000, DFID published a Race Equality Scheme in May 2002. This reiterates DFID's commitment to promoting race equality and sets out how the department plans to meet its obligations under the new Act, both as a service provider and as an employer. Due to the international focus of its work, DFID has only a few functions which provide services to the UK public. The Department has set up systems to assess, review and monitor its policies and practices including as an employer so as to ensure compliance with the Act. The results of this monitoring will be published annually, with the first report expected in the last quarter of 2003. It will be placed on the DFID website and be made available in hard copy on request. DFID has three non-departmental public bodies. Systems are in place to monitor their recruitment policies and practices. The principles of equal opportunity and diversity apply within the appointments process at all stages, and care is taken not to discriminate on the grounds of gender, race, age, disability, religion, marital status, sexual orientation or community background. All appointments to these non-departmental public bodies are made on merit.
