There has been no expenditure on publicity in any of the years specified for the Court Service and the Advisory Committee on Legal
Education and Conduct and none is planned for 1998-99.
The only advertising that the Court Service carries out is for recruitment. These adverts are placed locally and, as a result, the
amount spent could be established only at disproportionate cost.
It is Government policy that the Public Trust Office does not advertise for the services it provides. The advertising costs shown in
the above table relate to recruitment of staff. There has been no expenditure on publicity in any of the years specified for the
public Trust Office. The Chief Executives of HM Land Registry and the Public Record Office will be replying separately.

Hospitality is defined within the Land Registry as `Local entertainment costs approved within central guidelines for visitors and/or
meetings'. The amounts quoted in the last three years reflect the Land Registry's activities in the international arena with a
marked increase in the number and duration of visits by officials responsible for land administration in other countries.

Mr. Hoon: Except for the Legal Aid Board-- established on 1 April 1989--which incurred £4,215 of such expenditure in 1994-95,
expenditure on overseas travel is not monitored separately from other travel and subsistence in my Department and could be provided
only at disproportionate cost.

Mr. Hoon: The Question concerns a specific operational matter on which the Chief Executive of the Public Record Office is best
placed to provide an answer and I have accordingly asked the Chief Executive to reply direct.

I have been asked by the Lord Chancellor's Parliamentary Secretary to reply for the Public Record Office to your question about the
above.
E-mail created or received by Government Departments is covered by the Public Records Act. Departments are therefore under a
statutory duty to make arrangements, under my guidance and supervision, for the selection of those records which ought to be
preserved permanently and for their safekeeping.
Since 1995 the Public Record Office, supported by a cross- government Advisory Board, has been running an Electronic Records in
Office Systems programme to give leadership across government in the management of electronic records, to ensure that such records
of long term value, are available for future access.
The programme surveys the current programme of electronic records by Departments and delivers advice and guidance on their
management, selection and preservation. Two classes of electronic records have so far been transferred to the Public Record Office
as pilots, to develop and test the new procedures required. A strategy has been developed to implement the software products
supplied by the IT industry, and, in particular, to encourage products that aid the management and archiving of electronic records.

During 1965 47,865 archival units were transferred to the Public Record Office.
To produce actual and percentage figures for those archival units which have been subsequently released either in whole or in part
could only be done by checking against each individual item its expected and actual release date, and to do so would incur
disproportionate cost.
The Public Record Office estimates that around 1 per cent. of its holdings are unavailable because they are closed for longer than
30 years.

The great majority of records produced by Government departments in 1965 will by now have been destroyed under the normal
arrangements for handling public records. Neither the Public Record Office nor Government departments kept statistics at that date
of quantities of records created or destroyed, so that it is not now possible to give percentage figures for those records retained
by their department.
Approvals given by the Lord Chancellor for retention of records all give a date by which the approval is to be reconsidered. As
stated in the White Paper Open Government (Cm 2290 July 1993), paragraph 9.24, records retained by departments for other than
administrative reasons are subject to regular review, ie at least every 10 years.
The Chief Executive, Mrs Tyacke, or I would be very pleased to discuss any of these matters with you further, if you wished

Mr. Ingram : [holding answer 11 June 1997]: No Northern Ireland Office records were passed to the Public Record Office in 1996. The
earliest Northern Ireland Office documents will be due for transfer to the Public Record Offices when they become 30 years old in
the year 2002. The suitability of those documents for permanent preservation will be reviewed under the terms of the Public Records
Act 1958 and/or the Public Records Act (NI) 1923. Neither Act requires statistics to be kept in the form requested. The Chief
Executive of the Public Records Office for Northern Ireland has written to you with such information as he has as he has available.
To comply with their duties under the Acts the Northern Ireland Office and the Northern Ireland Departments make arrangements for
the safe keeping of their records, with a view to their eventual release to the public. The general arrangements for extended
closure or retention of public records as set out in Chapter 9 of the White Paper Open Government of July 1993 (Cm 2290) apply in
Northern Ireland.

The Secretary of State has asked me to reply to your recently tabled Parliamentary Question about the percentage and number of
documents which in 1996 were (a) passed on to the Public Record Office intact, (b) passed on to the Public Record Office in censored
form, (c) retained by her Department in full (d) retained by her Department in part, (e) destroyed, (f) otherwise disposed of and
(g) otherwise unaccounted for.
The place of deposit for the records of the Northern Ireland Departments is the Public Record Office of Northern Ireland, where
separate transfer arrangements operate, namely under the Public Records Act (NI) 1923.
In 1996, a total of 200 linear metres of records (equating to about 7,000 files) were transferred to the Public Record Office of
Northern Ireland by the Northern Ireland Departments, the Northern Ireland Office and the Northern Ireland Court Service. No records
were retained in whole or in part by the Departments.
There would be prohibitive cost involved in compiling statistics for the percentages and numbers of documents destroyed. There is no
mechanism in Northern Ireland for the disposal of records other than by transfer to the Public Record Office in Northern Ireland.

Regarding (a) and (b), records passed to this Office in 1965 were subject to a fifty year rule. The thirty year rule came into force
in 1968, under the Public Records Act 1967.
Regarding (c) and (d), records passed to this Office could not as the same time have been `retained' by government departments.
Retentions were for specified periods, which were renewable.
Regarding (e), 44 Cause Books of the Chancery Division of the Supreme Court (J 12), dating from 1939, were destroyed in 1972,
following the recommendations of the Committee on Legal Records in 1966 (Cmnd 3084). In addition, items from among the War Office,
Registered Papers, General Series (WO 32), dating from 1855 to 1925, were destroyed in 1967 following a re-review of the contents of
the class, as were a small number of items from the War Office reports and Miscellaneous Papers (WO 33), dating between 1925 and
1930, in 1968.
Regarding (f) and (g), no records passed to this Office in 1965 have been disposed of otherwise than by destruction, or are
otherwise unaccounted for.
Details of the records transferred to the Public Record Office in 1965 appear as appendix II to the Report of the Keeper of Public
Records for that year, laid before Parliament in 1966.

Mr. Vaz: To ask the Parliamentary Secretary, Lord Chancellor's Department what proposals he has to increase the number of ethnic
minority employees in his Department. [723]
Mr. Hoon: For the Lord Chancellor's Department, including the Court Service and the Public Trust Office, the Department's Programme
of action to achieve equality of opportunity for people of ethnic minority origin sets out specific commitments in respect of
recruitment, retention and development of ethnic minority employees, including monitoring the impact of the commitments. Equal
Opportunities statements are included in all recruitment literature and advertisements. Training on equal opportunities is
obligatory for all staff in management grades, to assist in retention of ethnic minority employees. Sponsorship of ethnic minority
students under the Windsor Fellowship scheme and provision of mentors for the National Mentoring scheme help to promote the Lord
Chancellor's Department as an attractive employer to minority ethnic groups.
The Northern Ireland Court Service has no proposals/targets specific to ethnic minority employees, but it is the policy of the
Service to ensure equality of opportunity for all current and potential employees on the basis of merit alone. I have asked the
Chief Executives of the Land Registry and of the Public Record Office to reply separately.

Mr. Streeter: The chief executives of the Court Service, the Land Registry, the Public Record Office and the Public Trust Office
will reply on behalf of their agencies. Prior to the establishment of the Court Service and the Public Trust Office as agencies,
there is no record of any contracts with EDS. No contracts have been entered into with EDS subsequently by the remainder of the
Department or its associated offices.

The Parliamentary Secretary, Lord Chancellor's Department, has asked me to reply to the above Question about the contracts the Court
Service has had with Electronic Data Systems Ltd (EDS).
Since the establishment of the Agency in April 1995, the Court Service has awarded two contracts to EDS. The first began in
September 1996 and is for the provision of Information Services to county courts and Crown Court Centres in England and Wales and to
the Bankruptcy and Companies Courts. EDS will be paid only for the volume of valid process produced (eg summonses in the county
courts, petitions in the Bankruptcy Court) so the final cost is dependent on the Court Service's volume of business. However, the
cost of providing the currently contracted IT services is expected to be between £20 million and £25 million (plus VAT) over 7
years. No modifications of the contract have yet been made.
The first module of the contract, to introduce a case management system into the county courts by the end of 1997, will save staff
time equivalent to 600 full time posts.
Under a second contract EDS provided one day of consultancy support in October 1996 to the Management Structure Review Team in Court
Service Headquarters. This consisted of technical advice (not available in-house) on identifying and weighting factors as part of
formal decision-making. The work was not connected with the Information Services contract and was separately negotiated at a daily
rate of £751. EDS completed the work, without modification and no job reductions arose from this contract.

Mr. Jonathan Evans: The Lord Chancellor has responsibility for four agencies: the Court Service, HM Land Registry, the Public Record
Office and the Public Trust Office. As the question concerns a specific operational matter, the chief executives of the agencies
have been asked to reply direct.

Since April 1995, the date on which the Court Service was established, no market testing has been carried out.

Parliamentary Question, listed on 16 May 1996, regarding market testing carried out, the services provided and the results.
The Public Trust Office market tested the typing service in 1993. The proposal made by the in-house team was successful.

market testing of services provided by the agencies for which he is responsible.
The Public Record Office has market tested the following:
1. Security services
The contract was awarded to the in-house bid team. Savings have amounted to £275,000 p.a. on pre-test costs of £1.14m p.a.
2. General office copying
It was decided, as part of the market testing process, that this service should be contracted out. The tender process did not
produce a bid from the private sector which would have provided running-cost savings. The service remains in-house but is likely to
be considered again within a proposed facilities management market test.
Additional services costing £1.79m p.a. have been subject to other efficiency techniques under the Public Record Office's Competing
for Quality programmes, producing savings estimated at £174,500 p.a. for 1996-97. Letter from John Manthorpe to Mr. Martin Redmond,

of office space rented by his Department and its agencies and the number of his Department or agencies' buildings partly, or fully
unoccupied together with the square footage of that unoccupied office space and its estimated rental value where available in each
of the past five financial years.[27725]
Mr. Jonathan Evans: The information shows the area and rental cost of the LCD estate for the period requested. The figures available
are shown in square metres rather than square feet and represent the agents lettable area of the building rather than the whole
building.

The LCD Estate includes the Public Trust Office and the Court Service Estate, with the exception of the figures for 1996-97 which
exclude accommodation covered by the Court Service following agency status. The chief executive of the Court Service will respond
separately in respect of that period. The chief executives of Her Majesty's Land Registry and the Public Record Office will also
reply separately.
The estate occupied by the Lord Chancellor's Department and its agencies has many types of building: offices, courts, residential
properties, storage facilities and offices converted into courtrooms. The majority of the buildings have a combination of uses and
our records, prior to the current year, do not distinguish between the different types. For the current year, the LCD HQ estate has
a total of 1,783 sq m of vacant office space, which is encompassed in an overall review of office space currently being undertaken.
The vacant space has an approximate rental value of £286,275.
Letter from M. D. Huebner to Mrs. Bridget Prentice, dated 8 May 1996:
The Parliamentary Secretary, Lord Chancellor's Department has asked me to reply to your Question about rented office space on the
Court Service estate. As you know, the Court Service was established as an Executive Agency of the Lord Chancellor's Department in
April 1995 and it is, therefore, only possible to supply figures from that date.
The approximate area of the Court Service estate is 6,771,430 square feet. This figure represents the entire agency estate and
includes courtrooms, office accommodation, judges' lodgings, storage space etc. It would only be possible to obtain the percentage
of office space in this figure at disproportionate cost. The rental value of the estate for the financial year 1995/96 was
approximately £69,342,056. This figure includes actual rent paid on leasehold properties and nominal rent paid on freehold
properties held on the Common User Estate. As both types of rent were paid to the Department of the Environment it is not possible
to identify what amount relates solely to leasehold properties.
The Court Service does not keep comprehensive financial records for empty office space on the estate and the information required
could only be obtained at disproportionate cost.

The square footage of office space rented by H M Land Registry at 31 March 1996 was 770,649 sq. ft at a cost of £4,646,813. The

Surplus accommodation has arisen in the Land Registry following reductions in its staff of some 3,400 from the 1989-90 peak.
Disposals of 297,105 square feet of rented accommodation have taken place since 1989 and further major disposals are being
negotiated.

Parliamentary Secretary to reply for the Public Record Office to your question about rented and unoccupied office space.
The Public Record Office rented no office space in the commercial property market in the past five financial years.
The Public Record Office's buildings form part of the Common User Estate and are primarily devoted to storing the public records.
Office space within them over the past five financial years was about 177,540 square feet. The rental for office space, paid through
the Property Repayment Service System, was:
