I refer the Noble Lord to the answer provided on 6 July in response to Question HL1318, which, for ease of reference, is reproduced below.
General practices (GPs) are independent business that hold contracts with the National Health Service to perform essential services to the public. We require practices to provide online consultation tools. From 1 October 2025, GPs have been required to offer access to online services throughout core hours, 8:00am to 18:30pm, bringing online access in line with walk-in and phone access. This change aims to improve patient access, reduce long phone queues, and help GPs manage demand more effectively
NHS England collects data on GP appointments, online consultation submissions, and cloud-based telephony. This data shows that 99% of practices have reported having an online consultation system in place. Where a practice does not comply with these contractual requirements, it may be in breach of contract. Patients who have concerns should contact their practice in the first instance, or raise the matter with their local integrated care board.

The Department of Health and Social Care has indicated that it will not be possible to answer this question within the usual time period. An answer is being prepared and will be provided as soon as it is available.

The Care Quality Commission (CQC) does not centrally record whether providers are delivering National Health Service funded care, so cannot identify Regulation 20 duty of candour breaches by those independent providers.
In the last three years, the CQC has suspended the registration of one independent healthcare organisation for breaches of Regulation 20. The CQC has also requested action plans from two independent healthcare organisations for breaches of Regulation 20.
All providers of NHS funded care must comply with the NHS Complaints (England) Regulations 2009 in their complaints handling arrangements. This includes the requirement to advise a complainant of their right to refer their complaint to the Parliamentary and Health Service Ombudsman (PHSO) if they are dissatisfied with the response to their complaint. It is the role of the PHSO to independently investigate complaints that NHS and NHS-funded organisations have not acted properly or fairly.
While it is not the role of the CQC to enforce the complaints regulations, it does assess whether registered providers have effective arrangements for receiving, handling, and responding to complaints as part of its regulatory role, and may take action where providers fail to meet the relevant regulatory requirements.

There is currently no age of sale restriction for nicotine pouches, and therefore no penalties apply. However, from 29 October 2026, it will be an offence to sell these products to a person under the age of 18 years old.

We are carefully considering the responses to our October 2025 call for evidence on tobacco and vapes, including on the granting of licences, to inform our proposals for future consultation, and we will set out our plans in the normal way in due course.
The Government is investing up to £10 million of new funding per year in Trading Standards until 2028/29 to support the enforcement of illicit and underage tobacco and vape sales, and the implementation of the measures in the Tobacco and Vapes Act.
However, powers in the Tobacco and Vapes Act 2026 also allow licensing fees collected from retailers to be used by local authorities to cover the costs of administering and enforcing the scheme. This will minimise burdens on local authorities and central government, and ensure the scheme can be implemented sustainably.

To ask the Secretary of State for Health and Social Care, what recent assessment has been made of the adequacy of the Care Quality Commission's enforcement powers to ensure patient safety.
The Care Quality Commission (CQC) is the independent regulator of health and adult social care in England, with a range of enforcement powers. The Department holds the CQC to account regularly for its overall performance and delivery of its regulatory functions.
Under the Health and Social Care Act 2008, the CQC has civil and criminal enforcement powers enabling it to protect the public and hold registered providers and managers to account where fundamental standards are not met, or regulated activities are provided without CQC registration. Civil powers focus on reducing risks to people using services, while criminal powers enable the CQC to take action in response to serious failures. In some cases, the CQC may use both types of enforcement action.
Decisions on enforcement action are a matter for the CQC, exercised in line with its statutory remit and published enforcement policy.

The Department collects data, through the National Drug Treatment Monitoring System (NDTMS), on the number of people in structured substance misuse treatment, including those reporting a problem with anabolic steroids and other image and performance enhancing drug (IPED) use. However, people seeking help solely for steroid misuse, and not for alcohol or other drug misuse, may not be in structured treatment, depending on local commissioning arrangements, and would therefore not be captured in NDTMS. Where steroid misuse is linked to broader substance misuse, it would be recorded in NDTMS. As a result, NDTMS does not provide data on the prevalence of steroid or IPED use.
Data on anabolic steroid use is collected through the Crime Survey for England and Wales, published by the Office for National Statistics. The latest release provides an overview of the extent of, and trends in, illicit drug use in the year ending March 2025, and is available at the following link:
Anabolic steroid use is not recognised as a distinct diagnostic category in current classification systems, which limits health services’ ability to identify, record, and monitor cases in hospital data. Although some diagnostic codes relating to steroid misuse do exist, they are broad and do not reliably capture anabolic steroid use or its associated complications. As a result, data on hospital admissions linked to anabolic steroid use and related complications is not held.
Enforcement against the illegal online sale of anabolic steroids is a matter for the Home Office under the Misuse of Drugs Act 1971. Officials in the Department of Health and Social Care work closely with the Home Office to tackle the harms that all illicit drugs cause.

The Government has a commitment to ban the sale of high-caffeine energy drinks to children aged under 16 years old. This has been subject to consultation.
In the consultation, we proposed that local authorities would be responsible for enforcing any ban. Local Trading Standards officers are typically responsible for enforcing such regulations, but enforcement policy will depend on local arrangements.
The Department engaged with relevant stakeholders, including representatives for Trading Standards, to develop our proposals and estimate their impacts through the consultation stage impact assessment. A full new burdens assessment for this proposal will be developed and agreed with the Ministry of Housing, Communities and Local Government.
