Mr. Connarty: To ask the Parliamentary Secretary, Lord Chancellor's Department if she will make a statement on the enforcement of maintenance agreements made by Scottish courts in English courts. [41556] Ms Rosie Winterton: Under Scots Law a maintenance agreement can be drawn up by means of a Minute of Agreement. (This is an agreement entered into by two or more people, usually drawn up before a solicitor). If there is a clause of consent for registration in the Books of Council and Session and sheriff court, this can then be transferred under section 18 of the Civil Jurisdiction and Judgments Act 1982. Section 18 of the Civil Jurisdiction and Judgments Act 1982 deals with cross border judgments in the UK. In this section "judgment" can mean any document which in Scotland has been registered for execution in the Books of Council and Session or in the sheriff court books kept for any Sheriffdom. If a Minute of Agreement has been registered for execution, this can therefore be transferred to the appropriate court in England under that section. An individual who is in possession of a Minute of Agreement, that has not been registered, has another option. For example, if a party did not subsequently adhere to the obligations stated in the minute, the other party would be able to present the Minute of Agreement to the appropriate court in Scotland and request that a maintenance order is granted. In the event that an order was granted, it could be transferred to another part of the UK under section 16(2)(b) of the Maintenance Orders Act 1950. An order made in a Scottish court, in relation to either spousal or child maintenance can be transferred to the appropriate court in England for registration and enforcement under section 16(2)(b) of the Maintenance Orders Act 1950. Subject to the provisions of section 18 of the Maintenance Orders Act 1958, a maintenance order registered in a court in any part of the United Kingdom may be enforced in that part of the United Kingdom to which it is sent in all respects as if it had been made by that court and as if that court had had jurisdiction to make it.

In addition to the above the Lord Chancellor's Department also let a PFI contract to CSL Group Ltd. The contract is for the provision of accounting, financial, human resources/payroll and management information services. It was awarded in December 1997 and runs until 4 January 2007. The services have IT elements and are delivered using a corporate IT infrastructure provided through the contract. However, the IT elements of the contract are not separable from the accounting, financial, human resources/payroll or management information service provision elements. Therefore, cost information is expressed for the contract as a whole. Since contract award, in response to new requirements from the Department, there have been a number of significant variations to the services provided within the scope of the contract. Current estimated total service charges for the life of the contract amounts to £118.05 million.

Mr. Alasdair Morgan: To ask the Parliamentary Secretary, Lord Chancellor's Department if he will list the non-departmental public bodies responsible to him which have duties relating to Scotland, indicating their budget and staffing in Scotland, the number of Scottish board members and their emoluments. [137626] Jane Kennedy: The Lord Chancellor is responsible for the Council on Tribunals, which has a Scottish committee looking after issues relating to Scotland. The chairman of the committee, and two of its members, are also members of the main council and are jointly appointed by the Lord Chancellor and the Scottish Ministers. Although not having direct responsibility for the Scottish committee, the Lord Chancellor does reimburse the cost of the Committee at the end of each year. The budget for the committee for the year ending 31 March 2000 was £89,000. The committee is supported by a secretariat of two officials. The Lord Chancellor is jointly responsible for three members (the other four are appointed solely by the Scottish Ministers). The Scottish committee chairman is paid £20,803 p.a. Committee members are paid £7,567 p.a. Of the Lord Chancellor's other non-departmental public bodies, only the Advisory Council on Public Records has some duties relating to Scotland. This is because the Public Record Office is the UK national archive and some of the records and issues considered by the Council will affect Scotland as part of the UK. However, there is a separate statutory body in Scotland--the Scottish Records Advisory Council--run by the National Archives of Scotland.

Miss Widdecombe: To ask the Parliamentary Secretary, Lord Chancellor's Department what estimate he has made of the number of additional court cases which will be brought in England and Wales (a) in the year to October 2001 and (b) subsequently in each year, as a result of the coming into force of provisions of the Human Rights Act 1998 in October 2000; what the cost to public funds and the amount of court time taken up will be in (i) the High Court, (ii) the Court of Appeal and (iii) the House of Lords; and what discussions he has had with the Scottish Executive regarding the operation of human rights legislation in Scotland. [118544] Jane Kennedy: The Government anticipate that the vast majority of human rights points will be raised in existing cases, rather than new cases, save for applications for leave to move for Judicial Review which may rise from the 300 received in 1998 to 600 per year. We expect a significant number of human rights points to be raised in the months following implementation but it is anticipated that the level of challenges will reduce subsequently as the higher courts determine the basis on which the Act and Convention are to be applied. The Government have made annual provision for the overall costs of implementing the Human Rights Act in the courts--£60 million, including £39 million for legal aid. In addition, £4.5 million has been set aside to ensure that all full and part-time judges, lay magistrates and their legal advisers are trained to deal with Convention points effectively, which should reduce the impact on court time. On an annual basis, the High Court and Court of Appeal estimate that 2,300 to 2,800 extra sitting days would be required as a direct result of Human Rights Act cases, but the need for additional sittings will, in part, be offset by other changes in workload. Officials in my Department have been, and remain, in contact with officials of the Scottish Executive to benefit from an understanding of how their business has been affected by human rights litigation.
