To ask the Secretary of State for Business, Energy and Industrial Strategy, whether his Department is taking steps to help prevent intellectual property (a) theft and (b) infringement by (i) artificial intelligence and (ii) other products and software with machine learning capabilities.
The Government takes the infringement of intellectual property rights seriously, and as the lead agency the Intellectual Property Office (IPO) recognises the importance of Artificial Intelligence and Machine Learning both for their potential infringing uses, as well as the tools they may provide to assist in the enforcement of IP rights.
To better understand this emerging area of technology, the IPO has commissioned and will shortly publish a report examining whether and how AI can be used to track and trace Intellectual Property infringing goods, as well as assessing the resulting money flows and the potential use of AI by those infringing IPR.

Whilst the NHS track and trace app is not mandatory, employers should not discourage their employees from using it in the workplace. There are, however, some scenarios where the contact tracing feature should be turned off. These are when:
- someone is working behind a Perspex (or equivalent) screen;
- a phone is in storage, such as in a work locker;
- working in a clinical setting practising infection prevention and control.
As set out in the Safer Working Guidance, in order to ensure workplaces are Covid-19 secure, employers must have an alternative system in place for people who either do not have a smartphone or do who not want to use the NHS Covid-19 app.

The safer working guidance includes a section about supporting the NHS Test and Trace. Workplaces must display an official NHS QR code poster and have an alternative system in place for people who do not have a smartphone or do not want to use the NHS Covid-19 app.

An ethical advisory board will be convened to monitor the use of the app.
