A wide variety of species are afforded protection under the Conservation of Habitats and Species Regulations (2017) and under the Wildlife and Countryside Act 1981, including all species of bat found in this country. All listed species are covered irrespective of their expected lifespan, which is not a criterion in identifying the need for protection of a species.
Legal protection for hedgerows is provided by the Hedgerows Regulations 1997. These regulations prohibit the removal of most countryside hedgerows (or parts of them) without first seeking approval from the local planning authority, which is required to decide whether a hedgerow is ‘important’ because of its wildlife, landscape, historical (i.e. more than 30 years old) or archaeological value and as such should not be removed.

The 25 Year Environment Plan set out our ambitious plans for improving biodiversity by embedding a net gain approach to development. We have already strengthened planning policy and the revised National Planning Policy Framework, published in July, makes it clear that development should provide net gains for biodiversity. We will shortly be consulting on biodiversity net gain through the planning system.

The Government recognises that access to a network of open and green spaces is important for the health and well-being of communities, and the planning system highlights this in a number of ways. Our revised National Planning Policy Framework sets out that sufficient provision for the conservation and enhancement of green infrastructure should be included in strategic planning policies, the importance of green infrastructure in encouraging healthy lifestyles, and makes provision for communities to identify and protect green areas of particular importance to them through the designation of land as Local Green Space through local and neighbourhood plans.
The planning system acts as a control on an individual’s use of land and therefore it is right that they should have an impartial appeal against the refusal of planning permission. An independent Planning Inspector will give careful consideration to the planning merits of the case and take into account the views of the local planning authority and local residents before reaching a decision to allow or dismiss an appeal. Therefore any submissions made by community groups at the planning application stage will also be a matter for consideration at appeal.

To ask Her Majesty's Government whether they have considered the commercial and residential development potential of land that could be unlocked through a link road connecting the Port of Tilbury and the Lower Thames Crossing.
In developing their proposals for the Lower Thames Crossing, Highways England is seeking to create the right balance between: facilitating economic growth, including through new developments; improving connectivity; optimising the performance of the local and strategic road networks; and meeting the needs of local communities. No decision on the final design of the scheme, including a link road to the Port of Tilbury, has yet been taken.

To ask the Secretary of State for Business, Energy and Industrial Strategy, what steps his Department is taking to ensure that energy firms produce clear and transparent billing for district heating in new developments.
The Clean Growth Strategy committed to assessing the sector’s future market framework. The Department will consider the recommendations from an industry taskforce published in January 2018 and the CMA’s final recommendations in developing an appropriate future market framework that will deliver benefits for consumers and growth for the sector.
District heating has significant potential to reduce energy bills and carbon. We are investing £320m in the sector through the Heat Networks Investment Project launching in the autumn to ensure consumers benefit from this opportunity and get a fair deal; a number of pilot projects have already received funding.
In the 2017 Clean Growth Strategy BEIS assessed the carbon cost-effectiveness of various technologies including district heating systems at an estimated £184/tCO2e for domestic district heating (undiscounted, 2015 prices), and £224/CO2e for non-domestic district heating. These figures do not account for the network benefits of district heating systems and the option value of exploiting future low-carbon heating technologies at large-scale.
The Heat Network (Metering and Billing) Regulations 2014 require heat suppliers to install individual heat meters in all newly constructed buildings connected to district heat networks. The regulations require that bills for those metered properties are accurate, based on actual consumption, and that they clearly set out how the bill was calculated.

Further Education Colleges were incorporated as independent institutions in 1993, taking ownership of their land, buildings and reserves from local authorities. As independent institutions, they are responsible for managing their own estates in accordance with the Further Education Colleges Financial Memorandum. The Education and Skills Funding Agency does not have any role in decisions made to sell assets other than managing previous capital grant investment, where applicable.

To ask the Honourable Member for Meriden, representing the Church Commissioners, pursuant to the Oral Answer of 26 April 2018, Official Report, col 1014, whether she has held discussions with the diocese on St Mary’s the Virgin Church, Seaham.
Since my oral answer of 26th April 2018 (Official Report, col 1014) I have consulted with representatives of the Diocese and of Seaham Parish and I understand that the land being developed is not owned either by the Parish, the Diocese or the Church Commissioners. Any objections must therefore be made formally and in the usual manner to the Local Authority planning office.
To date the Diocese has not been asked to submit a view on the development. It would be for the Parochial Church Council of St Mary’s the Virgin to ask them to do so.
