Mrs. Spelman: To ask the Secretary of State for Environment, Food and Rural Affairs what assessment she has made of the cost and
enforcement of EU environmental regulations in (a) the UK, (b) other EU countries and (c) applicant states. [143809]
Mr. Morley: In 1998, this Government announced that no proposal for legislation, which has a potential to impact on business, the
voluntary sector or charities, should be considered by Ministers without a Regulatory Impact Assessment (RIA). Departments are
required to undertake RIAs for all proposed regulations and policies, including environmental regulations, that impose a burden or
realise a benefit to business, charities and the voluntary sector whether initiated by the UK or EU. The RIA includes an analysis of
the costs of implementation and enforcement. It is an ex-ante appraisal and it is an explicit requirement that consideration is
given to monitoring and review at the appraisal stage.
The RIA process will be strengthened further by the National Audit Office (NAO) taking on a new role as an independent evaluator of
selected RIAs. The NAO will focus on the quality of analysis in the RIAs and the thoroughness with which the RIAs have been
undertaken. The findings and recommendations of best practice will be fed back to Departments.
All RIAs published by Government Departments since January 2001 can be accessed via the Cabinet Office Regulatory Impact Unit
website (http://www.cabinet-office.gov.uk/regulation/index.htm).
The responsibility for assessing the cost and enforcement of EU environmental regulations in other member states rests with
individual member states.
In June 2002 the European Commission adopted an Action Plan for Better Regulation, in which it committed itself to the introduction
of a two-stage impact assessment process, covering the economic, social and environmental impacts of policy proposals, the phased
implementation of which started earlier in 2003. Impact assessment is to be applied to all proposals listed in the Annual Policy
Strategy or Work Programme. All proposals will be subject to preliminary assessment, with some proposals being selected for extended
assessment.
The European Commission produces an annual survey on the implementation and enforcement of environmental Community law within
existing member states. The 4th edition, which covers 2002, is now available and can be accessed through the Europa server
(http://europa.eu.int). Comparable data on the implementation and enforcement of EU legislation in the Accession States will also be
compiled once they join the EU.

Chris Ruane: To ask the Secretary of State for Trade and Industry how many completed successful investigations into underpayment of
the national minimum wage there have been, broken down by constituency; and how much was recovered in each case. [142634]
Mr. Sutcliffe: Between the start of the minimum wage in April 1999 and September 2003 the Inland Revenue have carried out 8,471
successful investigations, in which underpayments of over £14.3 million was identified.
These statistics are not available at constituency level.

Mr. Cousins: To ask the Secretary of State for Trade and Industry what guidelines she gives under the Posting of Workers Directive;
whether collective agreements in construction will be enforced; and if she will make a statement. [142418]
Mr. Sutcliffe: Guidance on the Posting of Workers Directive is available on the DTI website. Unlike most EU countries, the UK has a
voluntarist system of collective employment relations. Collective agreements in construction are not universally applicable and
accordingly are extended by law to cover employers and workers not party to them. These collective agreements are, therefore, not
covered by the Directive, which we have fully implemented in the UK.

Tim Loughton: To ask the Parliamentary Secretary, Department for Constitutional Affairs what proportion of fines imposed have been
collected by courts in each county in each of the last five years. [141063]
Mr. Leslie: Information on the proportion of fines imposed that have been collected is not available for each county. The
information provided is for the 42 Magistrates' Courts Committees (MCCs) in England and Wales. A new data collection procedure was
implemented in 1999-2000 and comparable figures are therefore only available from that period.
In addition, earlier this year, I agreed to a revision of the fine enforcement payment rate target so that it provides a far clearer
focus for the performance of those involved in this vitally important area.
The April to September column of the table sets out year-to-date performance on the basis of the new formula which excludes things
like confiscation orders.
Further management information is awaited for the rest of the business year before we can be certain that the improvement in
performance we expect is fully delivered. Nevertheless, we now have a much more robust baseline data on performance and early signs
are encouraging.

Mr. Bradshaw: The monitoring of fishing activity in British Fishery Limits adjacent to England and Wales, including the six 12 mile
zone, is the responsibility of the Department's Sea Fisheries Inspectorate using aerial and satellite surveillance and fishery
protection vessels on task from the Royal Navy.
The level of surveillance is kept under review by the Sea Fisheries Inspectorate and is considered to be proportionate to the
fishing activity occurring within British Fishery Limits.

Mr. Browne: The Department has set out its proposals for changing enforcement arrangements for employers' liability compulsory
insurance (ELCI) in the second stage report of the review of ELCI published on 4 December. This also makes reference to the latest
research on compliance which has been commissioned by the Health and Safety Executive (HSE). A copy of the report is available in
the Library.
