The Solicitor-General: In 2002-03, the Crown Prosecution Service set two targets in order to deal with prosecution cases in a timely
and efficient manner in partnership with other agencies.
The first target was to send 80 per cent. of committal papers to the defence within 14 days (10 days in custody cases) of receipt
from the police of a full file for committal certified as trial ready. The target was achieved in 86.7 per cent. of cases.
The second target was to deliver 84 per cent. of briefs to counsel within 14 days of committal or transfer (21 days in non-standard
fee cases). The target was achieved in 86.6 per cent. of cases.

The Solicitor-General: The Crown Prosecution Service (CPS) set a target in 2002-03 for Higher Court Advocates (HCAs) to undertake a
minimum amount of advocacy in the Crown Court. The total national requirement was for HCAs to undertake 8,620 sessions; the outturn
was 7,217 sessions or 83.7 per cent. No other targets were set in relation to the presentation of prosecution cases in court.
The CPS did not set any target in relation to testing the defence case.
The CPS does not set a target for compliance with disclosure requirements, but performance is monitored by Her Majesty's CPS
Inspectorate (HMCPSI) as part of their regular cycle of inspections. The latest published annual data from HMCPSI, for 2001-02,
shows that the percentage of cases where primary disclosure was handled properly was 80.4 per cent. and for secondary disclosure it
was 75.3 per cent. From 1 April 2003, the CPS has been undertaking formal monitoring of performance on disclosure as part its
internal Casework Quality Assurance programme.

The Solicitor-General: [holding answer 24 June 2003]:
Key performance targets are agreed as part of the Spending Review and the latest set were published in Spending Review 2002: Public
Service Agreements 2003-06 (Cm 5571). Targets are monitored with HM Treasury and progress is reported regularly.
Crown Prosecution Service
The Crown Prosecution Service, along with other criminal justice agencies, is subject to a Public Service Agreement for which the
Home Secretary, the Lord Chancellor, and the Attorney General are jointly responsible. The Public Service Agreement prescribes three
targets for the criminal justice system: to narrow the justice gap by bringing more offences to justice and reducing ineffective
trials; to improve public confidence in the criminal justice system; and to increase value for money. These are overarching targets
applying to the police, the courts and the Crown Prosecution Service. Day to day delivery is the responsibility of all of these
agencies, working together in partnership through Local Criminal Justice Boards established across each of the 42 operational areas
of the criminal justice system.
Underlying these targets are a number of measures specific to the Crown Prosecution Service, which demonstrate the contribution of
the service to the criminal justice system as a whole and govern the performance of its 42 areas. The targets for 2003-06 are as
follows:
Narrowing the justice gap To reduce by 5 per cent. in 2003-04 the proportion of unsuccessful outcomes in defendant cases in both the
magistrates courts and the Crown court. Further targets are to be agreed for 2004-06; To increase the number of recorded offences
brought to justice for which the offender was a persistent offender at the point of charge; To reduce by 27 per cent. the proportion
of ineffective trials in the magistrates courts and in the Crown court; and To introduce an agreed shadow charging scheme in
partnership with the police in all areas between March 2003 and December 2003.
Improving Public Confidence To ensure, year on year, that at least 95 per cent. of initial and continuing review decisions comply
with the Code for Crown Prosecutors; To increase by five percentage points current CPS compliance with its primary and secondary
disclosure responsibilities; To maintain year on year the average time from arrest to sentence for persistent young offenders at or
below seventy one days; and To increase year on year the number of areas that have regular engagement with groups that support
victims of domestic violence and with minority ethnic communities.
Value for money Specific measures in support of this target are under development.
Other measures
In addition, the service has a number of targets which are not directly related to the Public Service Agreement, as follows: The
Crown Prosecution Service is committed, along with its criminal justice partners, to delivery of agreed timeliness targets from
charge or laying of information to completion for a range of cases in both the magistrates courts and the Crown court; Subject to
the successful rollout of the Compass case tracking system, all Crown Prosecution Service areas to input data providing the capacity
to report on the progress and outcome of cases involving allegations of domestic violence, racially and religiously motivated
offences, homophobic crime, rape and child abuse; To reply to 95 per cent. of complaints within 10 days of receipt and to 95 per
cent. of inquiries from Members of Parliament within 15 days; and Additional measures are under development related to the
timeliness and quality of direct communication with victims.
Targets are determined by the Crown Prosecution Service Board, which comprises the Director of Public Prosecutions, the Chief
Executive, Chief Crown Prosecutors representing the 42 areas, Headquarters Directors and non-executive Directors.
Performance is reported on a quarterly basis to the newly created Business Development Directorate, which has responsibility for
monitoring progress towards targets both at local and national level, and for raising with the 42 areas both matters of concern and
aspects of good practice which emerge from the resulting record of delivery.
Serious Fraud Office
The Serious Fraud Office does not have any agencies or non-departmental bodies. Current performance targets are as follows: a
caseload of 110 active cases (including appeals) within allocated resources; a long-run average investigation time of 16.5 months; a
long-run average prosecution stage length of 14.5 months.
Performance targets are agreed by Ministers and officials, and subject to monitoring by the Director of the Serious Fraud Office,
Ministers and officials.
HM Crown Prosecution Service Inspectorate
HM Crown Prosecution Service Inspectorate has clear objectives set out in its Strategic and Business Plan 2003-06 which is available
on their website at www.hmcpsi.gov.uk. The objectives of HM Crown Prosecution Service Inspectorate support the Government's
overarching objectives for the criminal justice system and the linked Public Service targets.
However, no separate performance targets have been developed for HM Crown Prosecution Service Inspectorate.
The Plan is approved by the Attorney General and progress is monitored by the Attorney General's Advisory Board.
Treasury Solicitor's Department
The Treasury Solicitor's Department is required to meet the following performance targets: (a) to introduce a professionally
informed client survey methodology for all the Agency's legal work by September 2003; (b) to meet client satisfaction levels as
measured by survey results of: at least 95 per cent. for Advisory Divisions at least 90 per cent. for Litigation Division and
ECCG; (c) to recover from clients the full operating costs for chargeable services; (d) to maintain corporate staff overheads costs
at no more than 15 per cent. of total staff costs; (e) to reduce sick absence per staff year by 30 per cent. by 2003-04 (base year
1998-99); (f) to achieve a level of ill-health retirements by 2005 consistent with or better than the best quartile target of 3.72
retirements per 1,000 employees; (g) to pay all undisputed invoices in accordance with terms or within 30 days.
Targets (a) to (d) were agreed between the Department, the Attorney General and HM Treasury as part of the Department's Spending
Review 2002 settlement. Targets (e) to (g) were set centrally by Ministers for all Government Departments.
Achievement against all targets is monitored by the Department's Board and the Attorney General; and reported to Parliament and the
Public in the Law Officer's spring Departmental Report and the Treasury Solicitor's Department's Annual Report.

Crown Prosecution Service
The Crown Prosecution Service does not have a specific departmental target for efficiency savings in 2003-04. One of the Spending
Review 2002 PSA targets is to increase value for money from the criminal justice system by 3 per cent. a year. The Crown Prosecution
Service will be contributing towards the target, which covers improvements in efficiency as well as improvements in effectiveness.
Treasury Solicitor's Department
The Treasury Solicitor's Department does not have specific target for efficiency savings in 2003-04.
The majority of the Department operates as an Executive Agency recovering the costs of most of its services from Government
Departments and publicly funded bodies. As a result of the Quinquenial Review of the Agency in 2001, significant management effort
and resources are being focused on improving the business operations including greater efficiency. The changes under way will need
to be completed in order that these improvements can be achieved.
In 2003-04, the Department has two cost measures that serve to control expenditure: 1. To recover from clients the full operating
costs for chargeable services. 2. To maintain corporate staff overhead at no more than 15 per cent. of total staff costs.
HM Crown Prosecution Service Inspectorate, Serious Fraud Office and Legal Secretariat to the Law Officers
HM Crown Prosecution Service Inspectorate, the Serious Fraud Office and the Legal Secretariat to the Law Officers do not have
targets for efficiency savings in 2003-04 although they expect, and will, continue to seek to maximise the value for money achieved
in all of its expenditure.

Crown Prosecution Service
The Crown Prosecution Service included its Public Service Agreement targets in its Target Delivery Report, published in February
2003, and in its Strategic and Business Plans for 2003 and 2006, published in March 2003. Public Service Agreement targets are also
included in the annual Departmental Report which will be published very shortly. These documents are available on the Crown
Prosecution website.
The inclusion of Public Service Agreement targets in these documents is at no additional cost to public funds.
Serious Fraud Office
The Serious Fraud Office does not have Public Service Agreement targets but is finalising appropriate targets to cover the Survey
2002 period from 2003-04 to 2005-06. Once agreed they will be published on the official website. The cost to public funds is likely
to be under £500.
Treasury Solicitor's Department and HM Crown Prosecution Service Inspectorate
The Treasury Solicitor's Department is not a main Department and is not, therefore, covered by a Public Service Agreement. However,
the Department was required to produce and agree with the Attorney General and HM Treasury a Corporate Plan covering the Spending
Review 2002 period. This included new performance targets and for accounting purposes covers the Legal Secretariat to the Law
Officers and the HM Crown Prosecution Service Inspectorate.
The Department's Corporate Plan was placed in the House of Commons and House of Lords Libraries and on the Department's website.
Copies were also made available to all staff through the Department's Intranet. The presentational copies for these purposes were
produced in-house at opportunity cost. The only direct cost incurred was £650 for colour photocopying for an additional 60 copies
for senior management, other key staff and clients.

The Solicitor-General :[holding answer 22 May 2003]: The Croydon CPS Criminal Justice Unit dealt with 12,860 last year and achieved
a conviction rate of 97.0 per cent. of those cases that went to trial.
I am also aware that continuing efforts are made to improve performance and procedures if any deficiencies are found.

In relation to the departments for which the Attorney General holds ministerial responsibility, the answer is as follows. Crown
Prosecution Service
The public service agreement (PSA) targets for the criminal justice system are overarching measures. They apply to all criminal
justice agencies working together in the 42 local criminal justice boards. Delivery against the targets and local monitoring of
progress towards them are the responsibilities of a wide range of managers at both a local and national level, some within the Crown
Prosecution Service (CPS) and some working for other agencies. Their grades vary according to their respective range and level of
responsibility. These diverse arrangements cannot be readily summarised, nor is any central record held of the numbers and grades of
those involved.
A new Directorate within CPS Headquarters, the Business Development Directorate (BDD), established in April 2003, has national
responsibility for the Service's response to the PSA targets. Its role includes ownership of the business processes and
co-ordination of the programme of change and reform needed to support service delivery. It also provides policy and guidance on
planning and performance management, together with the provision and analysis of the management information which measures and
accounts for our steps towards PSA goals. None of the staff within the BDD works exclusively on monitoring PSA targets: all have
other responsibilities related to supporting the 42 CPS areas in realising the Service's demanding reform programme.
BDD is headed by a business development director and, within his overall command, the management of performance falls to the head of
resources and performance. Both posts are filled at senior civil service level. Performance information is handled within the
Internal Resources and Performance Branch, headed at grade D level, by one level B3 and one level B2, both of whom also have other
responsibilities.
Serious Fraud Office
The Serious Fraud Office does not have a public service agreement. Instead, it has a service delivery agreement which contains
targets on the total number of cases undertaken and the time taken to complete those cases. Responsibility for monitoring progress
against these targets rests with the Director the Serious Fraud Office.
Treasury Solicitor's Department
Progress towards the public service agreement targets is monitored quarterly by the Executive and Supervisory Boards of the Treasury
Solicitor's Department.
The Executive Board comprises six Senior Civil Servants; the Supervisory Board comprises 19 Senior Civil Servants, including the
Treasury Solicitor.
HM Crown Prosecution Service Inspectorate
HMCPSI does not have direct responsibility for delivering any PSA targets. However, its activities have close links to all three key
PSA targets for the criminal justice system (i.e. Narrowing the Justice Gap, increasing public confidence and increasing value for
money). The HMCPSI Business Plan links all activities to one or more PSA targets. However, it does not have any officials directly
involved in monitoring progress.
A number of HM inspectors employed by HMCPSI comment on the progress of CPS performance towards PSA targets. However that work is
integrated to their ordinary duties and cannot be separately costed.

I draw attention to the second column of the table `Active Caseload at Year End', where the figures represent those cases actually
under investigation, those awaiting trial and those where a trial had been commenced but had not been formally concluded with a
verdict or verdicts. I feel the other statistics speak for themselves.
Since its inception, the conviction rate of the Serious Fraud Office as an average, is 84 per cent. by number of trials in which at
least one defendant was found guilty and 73 per cent. by number of defendants, which I'm sure you will agree is a respectable
record.

The Solicitor-General: A holding reply was given on 4 February 2003.
The Crown Prosecution Service will publish its Strategic Plan for the period 2003-2006, and a Business Plan for 2003-2004, before
the end of March 2003. These plans set out what the CPS will be doing to deliver its Public Service Agreement
The Serious Fraud Office will publish agreed service delivery targets before the end of March 2003.
The service delivery agreement for the Treasury Solicitor's Department will be published in April 2003 alongside its Business Plan
for 2003-2004. The service delivery targets and how they will be met is a key feature of that Business Plan.
