The most recent available figures for imprisonment are given in the table. Source: Prison Statistics for England and Wales, 1999, table 1.14 Trials of provisions in the Crime (Sentences) Act 1997 made additional disposals available to a small number of courts for a limited period to deal with fine defaulters who would otherwise have gone to prison. The use made of those disposals by the courts was published in the report of the trials, "New measures for fine defaulters, persistent petty offenders and others", in February 2000. A decision has not yet been taken about making these disposals available nationally.

Mr. McDonnell: To ask the Secretary of State for the Environment, Transport and the Regions (1) if he will list the individuals and companies prosecuted by the Environment Agency for illegal flytipping in the London area in 1999 and 2000; [140500] (2) how many prosecutions have been secured by (a) the Environment Agency and (b) local authorities in relation to illegal flytipping (i) nationally and (ii) in the London area in 1995, 1996, 1997, 1998, 1999 and 2000; [140505] (3) what has been the average fine levied on (a) individuals and (b) companies convicted of illegal flytipping in (i) 1995, (ii) 1996, (iii) 1997, (iv) 1998, (v) 1999 and (vi) 2000. [140504] Mr. Mullin: Flytipping is not defined in legislation but the term is generally used to refer to the illegal disposal of waste on sites which have neither a waste management licence nor a registered exemption from licensing--in contravention of sections 33 or 34 of the Environmental Protection Act 1990. However, it is also an offence under section 33 to dispose of waste in contravention of a licence. The available data do not separately identify the two different types of offences committed under section 33 and the following information therefore includes offences other than flytipping. The Environment Agency advise that in the time available to answer the question it is unable to provide a list of those prosecuted specifically under sections 33 or 34 of the 1990 Act in the London area in 1999 and 2000. However, I am happy to write to my hon. Friend with this information and to place a copy of my letter in the Library of the House. Mr. Wyatt: To ask the Secretary of State for the Environment, Transport and the Regions (1) what powers he has to fine Kent county council in respect of the implementation of the Swale Unified Network in the Rural Bus Challenge 1999 Fund; [139673] (2) when Kent county council will implement the Swale Unified Network; [139672] (3) if Kent county council accrues interest on unspent elements of the Rural Bus Challenge 1999 Fund; and if this is ringfenced. [139671] Mr. Hill: Kent county council were successful in the Rural Bus Challenge 1999 with a bid for the Swale Unified Network project. None of the Department's grant awarded to this project has yet been paid to the council, though an initial payment will shortly be due on the basis of forecast expenditure in this financial year. The question of interest on unspent grant has not therefore arisen. Grant is available, up to the amount awarded, in respect of the costs actually incurred by the council in implementing the project as described in its successful bid. The conditions of the grant are set out in Special Grant Report No. 54, approved by Parliament in March this year. These conditions include the requirement on the authority to repay to the Department any grant received which is found after audit to have been used otherwise than provided for under the terms of the Report. The timing of the implementation of the project, subject to the conditions in the Special Grant Report, is a matter for the council. I understand there have been some difficulties implementing the project as quickly as planned, but that it is now being taken forward.

Mr. Gerald Howarth: To ask the Secretary of State for Trade and Industry if he will list for each of the last five years, in respect of interference with aeronautical radio communications by pirate radio transmitters, (a) the number of reported cases, (b) the number of prosecutions brought by the Radio Communications Agency and (c) the sentences applicable to such offences; and if he will make a statement. [137572] Ms Hewitt: The Department's Radiocommunications Agency take seriously any interference to authorised radio communications. Where the interference has implications for the safety of life the Agency has a target to respond within 24 hours. Reports of interference to aeronautical radio communications are not usually specific as to the source. However, the Agency has seized pirate radio transmitters identified as being the source of interference to aeronautical radio communications on the following number of occasions in each of the past five years. _________________________________________________________________________________________________. In both instances the court can also order forfeit anything used in the commission of the offence. In 1999 one of those convicted was sentenced to 28 days' imprisonment and this year two of those convicted were sentenced to six months' and four months' imprisonment respectively.

Mr. Ian Stewart: To ask the Secretary of State for the Environment, Transport and the Regions when the Government plans to publish the draft Water Bill; and if he will make a statement. [136776] Mr. Meacher: I will publish a draft Water Bill for public consultation on Monday 6 November. The draft bill will have three main elements: first, it will contain provisions to improve the management of water through reforms to the abstraction licensing system and by promoting greater water conservation by water companies; second, it will re-introduce the regulatory reform provisions for water that were removed from the Utilities Bill in March 2000. These clauses have been updated since then, mainly to reflect any relevant amendments made to the equivalent energy provisions now in the Utilities Act 2000. The overall aim is to put the consumer at the heart of the regulatory process and to make regulation more open and accountable; and third, the draft Bill will contain a number of other useful but minor improvements to the regulatory systems for water and reservoir safety. The draft Bill includes provisions to increase the maximum penalty for abstraction and impounding offences and for supplying water unfit for human consumption from £5,000 to £20,000. This reflects the importance the Government attaches to ensuring appropriate fines for water offences. Unlimited fines are available in the crown courts. The draft Bill will also give new powers to the regulators to fine water companies up to 10 per cent. of their turnover for breaches of their conditions of appointment, or for failure to achieve prescribed standards of performance. We are also consulting on measures to ensure that customers have easy access to reliable comparative information on water company performance. We are working with the water industry with the aim of developing a pilot scheme. We are also consulting when we publish the draft water bill on introducing any necessary legislation to require companies to provide comparative performance information to customers. Copies of the draft Bill and covering consultation paper, and an accompanying publication setting out the Government's Regulatory Impact Assessment, Environmental Impact Assessment and a Policy Appraisal for Equal Treatment will be laid before the House at 11am on Monday 6 November.
