Mr. Dobbin: To ask the Secretary of State for the Environment, Transport and the Regions what was the outcome of the Transport Council held in Brussels on 9-10 December; and if he will make a statement. [102635] Mr. Hill: The Transport Council met in Brussels on 9-10 December. My right hon. and noble Friend Lord Macdonald of Tradeston represented the United Kingdom. The Council reached political agreement on a package of three draft directives, which take the opening of the internal market for rail services a significant step further. The package will amend Directives 91/440 and 95/18 and replace Directive 95/19. It will: provide open access for rail freight operators to a Trans-European Rail Freight Network (TERFN), which includes all major terminals and ports; broaden the scope of existing provisions for separation of accounts and certain essential functions between infrastructure management and train service operations; extend Community-wide recognition of train operators' licences to all railway undertakings established in the Community; and establish rules for allocating capacity on railway infrastructure and charging for its use. Conclusions were also adopted on improving interoperability and alleviating rail bottlenecks The Commission gave a progress report to Council on the definition phase of the Galileo satellite navigation project, including a report on discussions with the US and Russia. Lord Macdonald expressed the UK's disappointment at the pace of work on public-private financing and cost benefit analysis. He said that more work was needed to enable decisions to be taken at the end of 2000 on the future development of satellite navigation in Europe. There was a debate on the establishment of a European Aviation Safety Authority. The Commission proposed that the new authority should be set up as a Community agency. The UK and some other member states argued that an international body was preferable, as the Council had previously agreed. It would be genuinely pan-European and would have the support of the aviation industry. Following the debate, the Presidency asked the Commission to produce an analysis of its proposal for a Community agency, but also to begin exploratory talks with third countries. The Commission gave a presentation to the Council on air traffic management in Europe. Referring to lack of ATM capacity as a cause of increasing delays, and to the need for greater cooperation between states, the Commission proposed centralised management of a "Single European Sky". The Commissioner, Mrs. de Palacio, proposed that she should chair a high level group of member states' representatives, to study the issue. It would aim to report to the Transport Council in June 2000. The Council discussed aviation noise problems. The Commission reported on the latest developments in the International Civil Aviation Organisation (ICAO) on international standards and on its recent consultations with the United States. The Council reaffirmed its commitment to the ICAO process, and repeated that, if the outcome was successful and met the EU's objectives, existing Community legislation could be replaced by new international rules if these were more favourable. The Commission was invited to look at the issue urgently and propose solutions. The Commission presented a study on the economic impact of the draft directive on ferry manning, which would ensure that conditions for third country crew members on intra-EC ferry services were at least as favourable as those of EC crew members. The study suggested that the impact would be negligible. The Commission's view remained that the directive would protect jobs in the EU. The UK and some other member states welcomed the report and strongly supported the proposal, which was first put forward during the UK Presidency. The Council will return to the issue at a later date. The Council held a further debate on proposals for the extension of working time provisions to road transport. There remains disagreement between member states on fundamental issues, including application to the self-employed. Following the debate, the Presidency concluded that the Council should continue to look for solutions. There was a progress report from the Commission on negotiations with ten Central and Eastern European countries on extension of the aviation single market. The Council adopted Resolutions on the promotion of short sea shipping and on ways to encourage the greater use of intermodal freight transport. It also adopted a mandate authorising the Commission to commence air transport negotiations with Cyprus. There were also Commission reports on: indicators on transport and the environment; the recent report of the forum on barriers to innovation in transport, which aimed to produce an action plan by the end of 2000; Community accession to Eurocontrol, on which the Commission hoped that an Accession protocol could be signed at the MATSE VI Conference of aviation Ministers on 27 January; the recent aviation open skies conference in Chicago; and a Commission Communication on air transport and the environment.

Mr. David Taylor: To ask the Secretary of State for the Environment, Transport and the Regions if he will announce the allocation of capital resources for expenditure on local transport infrastructure in 2000-01. [103349] Mr. Hill: This is the second year of the three-year £2.4 billion package for local transport under the Comprehensive Spending Review, including £700 million of additional expenditure. The total allocation for 2000-01 will be £754.9 million, which will provide for major improvements to local transport infrastructure. Schemes approved or provisionally approved include innovative proposals for integrating public transport, providing greater travel choice; new bypasses to take through traffic away from local communities, improving their quality of life. We have also made provision of £301 million for highway maintenance--up 24 per cent. on this year's figure and in line with our commitment to reverse previous cuts in this area. In addition, we have increased general allocation for public transport, minor road improvements, walking, cycling and safety schemes. In addition, we are providing an extra £18 million for local authorities to improve public transport ahead of the introduction of congestion charging or workplace parking schemes. Local Transport Plans replace the Transport Policies and Programmes regime, and are the cornerstone of our integrated transport policy. They provide for a longer-term, more strategic approach and greater certainty of funding for Local Authorities. Copies of the Press Notice, containing a full analysis of the settlement, have been placed in the Library of the House. They have also been placed in Members' mail boxes in the Members' Post Office counter.

Statistics for military offences dealt with summarily are not held centrally and could be provided only at disproportionate cost. Offences against the Road Traffic Act 1988 or Disobedience to Standing Orders dealt with by Army Court Martial are set out in the following table but cannot be broken down into civilian or military vehicles. [100043] Mr. Hill: The percentage of persons killed in accidents where one driver or rider involved was over the legal alcohol limit in each of the last ten years was as follows: _________________________________________________________________________________________________. Statistics are not available for road accident deaths involving drugs or both alcohol and drugs. The Department has recently completed a three-year sample survey of the incidence of drugs in road accident fatalities for which interim results were released in February 1998. These showed that 6 per cent. of all road users (including drivers, riders, passengers, pedestrians and cyclists) had measurable traces of medicinal drugs and 16 per cent. had traces of illicit drugs (mainly cannabis). The results also showed that 19 per cent. of the sample of drivers and riders killed had taken illicit drugs and consumed alcohol over the legal limit. A full report on the research will be available next year. The presence of drugs in an accident victim is not evidence of accident causation, although there may be an association. The picture is further complicated by cannabis, because traces can remain in the body for four weeks or more after use, long after it has ceased to have any effect.

Mr. Kidney: To ask the Secretary of State for the Environment, Transport and the Regions (1) if he will establish a research group to provide advice on sleep-related incidents across the transport modes. [102506] (2) assessment he has made of the number of road crashes in which sleep is a contributory factor; and if he will make a statement; [102503] (3) what advice he plans to issue to drivers to reduce the incidence of sleep-related road crashes; [102505] (4) what research his Department is undertaking into sleep-related road crashes; [102504] Mr. Hill: The Department began a major research programme on fatigue in December 1992, conducted at Loughborough University. The first phase included a comprehensive study of HGV and car drivers. The results suggested that, for car drivers in particular, tiredness is a principal factor in around 10 per cent. of accidents. The next phase of the research looked at the relative effectiveness of possible counter measures to tiredness, to ensure that drivers have the best possible advice on how to minimise the risk of a sleep-related accident. Recommendations derived from this work have since been incorporated into the Highway Code. Much of the research undertaken in the road safety area has relevance in rail, air and maritime situations and vice-versa. It is also significant that leading experts in this field are very aware of each other's work. A further phase of the Department's research, begun in September, is reviewing successful measures that have been employed elsewhere in the world and in different operating environments. This includes a requirement to develop a targeted programme of publicity and education to counter driver fatigue. When this is completed in September 2000, the Government will consider what action to take, including whether to commission further research.

[102708] Mr. Hill: I have asked the Chief Executive of the Highways Agency, Mr. Peter Nutt, to reply to my hon. Friend. Letter from David York, on behalf of Mr. Peter Nutt, to Mr. Tom Cox, dated 15 December 1999: The Minister for Transport for London, Keith Hill, has asked me to reply to your recent Parliamentary Question about major road improvement schemes that are now taking place in Greater London. I am replying in the absence of the Chief Executive, Peter Nutt. Landscaping work is being carried out on the A12 Hackney M11 Link Road which opened to traffic on 6{th} October. The final section of the A13 West of Heathway to Mardyke scheme opened to traffic on 14 December and work continues on the London Primary Route Network Signing project to redesign and replace direction signs on London's primary routes within the M25 corridor. This work is being carried out in three phases because of its complexity and geographical spread. Two of the phases, covering East London and South West London, will be completed shortly, whilst work on the third phase, covering North West London, is expected to be completed in Autumn 2000. There are also a number of schemes in the pipeline. We are nearly ready to award a contract for the A13 Thames Gateway DBFO project which includes improvements at Ironbridge-Canning Town, the A13/A117 junction and Movers Lane junction. Subject to the completion of the necessary statutory procedures, it could also include improvements to the A13/A117 Prince Regent Lane junction. Detailed design work for the A40 Western Avenue bridge replacement scheme will start next year and we are preparing tender documents for the A23 Coulsdon Inner Relief Road improvement scheme so that it could start in early 2002. There are also four proposals to improve the A406 North Circular Road at Bounds Green, Regents Park and Golders Green and the A205 at Catford Town Centre. These schemes will transfer to the Greater London Authority (GLA) who will study the role of these roads as part of their development of a transport strategy for London. It will be for the GLA to decide whether or not to take the schemes forward. One local authority major improvement is also underway, the A240 North South strategy for the London Borough of Kensington.

[100821] Mr. Hill: Compensation negotiations between the District Valuer, acting for the Highway's Agency and the London Borough of Enfield are continuing. The Chief Executive of the Highways Agency, Mr. Peter Nutt, will write to my hon. Friend with further details. Letter from Richard Thorndike to Mr. Andrew Love, dated 8 December 1999: The Parliamentary Under Secretary of State, Keith Hill, has asked me to write in response to your recent written Parliament Question about compensation being claimed by the London Borough of Enfield for the loss of a mature cedar tree in Pymmes Park, as a result of works to improve the A406 North Circular Road. I am replying in the absence of Peter Nutt, the Chief Executive. Although the tree was located very close to the highway construction area, it was intended to carry out the road works without disturbing it. Once construction started, however, because of the tree's extensive root system, it was found that it would be seriously affected. Ways of saving the tree including moving it, at an estimated cost of £100,000 were considered but none were found to be practicable. The Agency concluded that the only option was for it to be cut down. Meetings between the Agency, the District Valuer and the Council to discuss the provision of replacement trees, wider landscape proposals for Pymmes Park and compensation matters have taken place and are set to continue. The final settlement of any compensation due will depend on the outcome of these negotiations. In the event that agreement on compensation cannot be reached the Lands Tribunal is available to make an independent determination. As part of the overall arrangements to offset disturbance, the Agency has provided exchange land at the former Willoughby Gas Works, as replacement for public open space land taken from Pymmes Park for the A406 works.

Mr. Blizzard: To ask the Secretary of State for the Environment, Transport and the Regions what assessment he has made of the value of porous asphalt road surfacing as a means of reducing spray in wet weather. [101136] Mr. Hill: I have asked the Chief Executive of the Highways Agency, Mr. Peter Nutt, to write to my hon. Friend. Letter from Richard Thorndike to Mr. Bob Blizzard, dated 7 December 1999: You recently asked the Secretary of State for the Environment, Transport and the Regions what assessment he has made of the value of porous asphalt roads surfacing as a means of reducing spray in wet weather. I am replying in the absence of the Chief Executive, Peter Nutt. Research undertaken by the Highways Agency has assessed the value of using porous asphalt road surfaces, including the benefit of reduced spray. Work carried out in the 1980's has shown that porous asphalt can reduce spray by as much as 95 per cent. compared to conventional asphalt when new. This reduces to approximately 30 per cent. after about three years due to the clogging of the porous asphalt from road detritus. The reduction in spray and the better visibility it offers drivers in wet weather, could be expected to reduce accidents when using porous asphalt compared with conventional surfacing. However, surveys carried out for the Highways Agency indicate that vehicles travel faster on porous asphalt in the wet than on conventional surfacing which increases the risk of accidents. This work is supported by an extensive accident survey report from the Netherlands. Where porous asphalt is widely used. Their survey demonstrates that porous asphalt was no safer than conventional surfacing. This was attributed to motorists driving at higher speeds on porous asphalt than conventional surfacing due to reduced spray and better visibility. The results of limited work undertaken by the Highways Agency are consistent with evidence collected in Holland. As part of a strategy to reduce impact of road noise the Highways Agency is carrying out research into alternative types of low noise road surfacing. As a result, new types of surfacing are now being introduced, some of which are often confused with porous asphalt, given their spray suppressing properties. Research on porous asphalt and the new road surfaces is continuing and will include monitoring spray reduction and the benefits offered. [100011] Mr. Hill: There were 85 child car passenger casualties per 100 million km travelled between 1996 and 1998 in Great Britain. Of these, seven per 100 million km were fatal or serious. The number of children identified in the National Travel Survey making journeys as motorcycle pillion passengers over the last five years has been too small to provide a reliable estimate for the population as a whole. The absolute numbers of child passenger casualties in the past three years are as shown in the table.
