Mr. Alan Johnson: The TUPE Regulations, like other aspects of the employment rights legislation, provide for those who consider that
their rights have been infringed to seek redress through the Employment Tribunals or, in appropriate cases, the civil courts. The
number of cases brought gives an indication of the extent to which private sector employers are observing the Regulations.

Mr. Alan Johnson: Employees or employee representatives who consider that their rights under these Regulations have been infringed
may seek legal redress. In 1998-99, the most recent year for which statistics are available, 505 complaints were made to the
Employment Tribunals alleging unfair dismissal by reason of a transfer of an undertaking, and 886 alleging breach of the
requirements relating to information and consultation of employee representatives about a transfer of an undertaking. Statistics are
not available to show what proportion of these complaints were upheld; some of the cases are still ongoing. Redress for unlawful
changes to terms and conditions by reason of a transfer of an undertaking may be sought either from the civil courts or, in certain
circumstances, the Employment Tribunals. These are not identified separately from other breach of contract complaints in the
available statistics.

Mr. Vaz: (a) The Conventional Armed Forces in Europe (CFE) Treaty was ratified by all 30 States Party and entered into force in July
1992. The adapted CFE Treaty was signed in Istanbul on 19 November 1999. The adapted Treaty will not come into force until all 30
signatories have ratified. This could take some time. In the interim period, the original CFE Treaty remains in force.
(b) While there have been a number of examples of non-compliance, implementation since the Treaty came into force has generally been
good. We and NATO Allies continue to press for full compliance, and have made clear that our ratification of the adapted Treaty will
depend upon the level of all Parties' compliance with limits that have been agreed.

Mr. Gunnell: To ask the Minister for the Cabinet Office if she will make a statement on the Government's approach to equality
issues. [100810]
Marjorie Mowlam: The Government are working to transform Britain into a society which is inclusive and prosperous. Eliminating
unjustified discrimination wherever it exists and making equality of opportunity a reality for all is at the heart of the
Government's agenda. Equality of opportunity is not only inherently right, it is also essential for Britain's future economic and
social success. Much has been achieved in the last two years. But we are not complacent. A lot remains to be done. We will continue
to act to stamp out discrimination, remove barriers and improve the position of groups facing disadvantage and discrimination in
employment, public life and public service delivery. We will ensure that the right legislative framework and institutional
arrangements are in place and that information, guidance and other support is available to challenge discrimination and deliver fair
treatment to allow everyone to develop and contribute to their full potential. That is to the benefit of all--individuals,
communities, business--in a healthy, modern, diverse society.
We will avoid unnecessary and burdensome regulation and will promote, encourage and support progress through non-legislative means.
However, we will legislate where necessary or desirable when legislative time permits. In doing so, we will be governed by the
principles of improving consistency between the protection afforded to different groups by different legislation, modernising
enforcement powers, and by the need for the public sector to lead by example.
As explained in our response to the Better Regulation Task Force Review of Anti-discrimination Legislation, we will where
practicable harmonise the provisions of the Race Relations Act 1976, the Sex Discrimination Act 1975 and the Disability
Discrimination Act 1995 and align the equality commissions' powers. This will significantly extend discrimination law coverage and
strengthen the powers of the Equal Opportunities Commission (EOC) and the Commission for Racial Equality (CRE) to match those of the
Disability Rights Commission (DRC). We will legislate to remove barriers to the equality commissions working together on common
issues and to enable them to produce joint guidance.
We are modernising Government. Not only will we continue to tackle discrimination in all institutions, we will champion equality in
every sense and at every level. Public bodies must take the lead in promoting equal opportunities and the Government will put this
obligation in legislation as soon as Parliamentary time permits. Together with our commitment to implement the Stephen Lawrence
Inquiry action plan, this will help ensure public institutions and services are free from discriminatory procedures and practices
and should improve the position of disadvantaged groups, both as employees and users of public services. This will not in any way
replace or supersede the existing statutory arrangements in Northern Ireland where there is already a duty on the public sector to
promote equality of opportunity. We will be looking at, and learning from, the operation of the law in Northern Ireland. We will
also build on existing mainstreaming and appraisal guidance to ensure that policies are inclusive, and take full account of the
needs and experience of all those likely to be affected by them, and of the impact on particular groups in society.
We will continue to take action to meet our commitment to remove the under-representation of women, members of minority ethnic
groups and disabled people on public bodies; and to meet the challenging targets set for representation of these groups in the Civil
Service.
The Race Relations (Amendment) Bill announced in the Queen's speech, will extend the Race Relations Act to public functions not
previously covered, such as law enforcement and immigration. It will implement, and go beyond, one of the Lawrence Inquiry Report
recommendations by making it unlawful for public authorities generally to discriminate in the exercise of their functions. This is
an important step in the Government's efforts to ensure that the public sector sets the pace in the drive towards equality; and we
will extend it to the Sex Discrimination Act and the Disability Discrimination Act when legislative time permits.
The gender pay gap is indefensible. We will support further action to address this and to achieve greater choice of career, of
working patterns and a better balance between work and home responsibilities that will benefit both businesses and individuals.
We intend to launch a campaign to promote employment policies which help people balance work and life delivered through partnership
with employers. Fairness at Work measures are improving parental and maternity leave, and allowing time off for emergencies. The
National Childcare Strategy, Working Families Tax Credit, Childcare Tax Credit and the National Minimum Wage are all bringing
benefits and removing barriers for women and men. We will consult on changes to Tribunal procedures to speed up and simplify equal
pay claims.
The Disability Discrimination Act lags behind sex and race legislation in the protection it provides for disabled people. The
establishment of a Disability Rights Commission, in April 2000, will address one of the Act's major weaknesses but there are other
gaps in coverage. The Disability Rights Task Force, which has been looking at securing comprehensive rights for disabled people,
will report shortly. The Government will carefully consider its recommendations. But we are committed to improving the rights of
disabled people. Where appropriate legislative opportunities arise, we shall use them to pursue this commitment.
Further legislation is not enough in itself. Changing negative attitudes towards disability, and indeed all forms of discrimination,
is crucially important. We shall continue with our campaign to address the lack of knowledge of disability issues and raise
awareness among service providers' of their duties to improve access for disabled people.
We are certain that a great deal of progress can be made through the provision of information and guidance to ensure awareness of
rights and responsibilities. The Government have already produced a Code of Practice on discrimination in employment based on age
and proposes, in conjunction with the EOC, preparing a Code of Practice on discrimination on the grounds of sexual orientation.
Evaluation of the effectiveness of this Code and consideration of developments in other areas will inform any future decision on the
need for legislation.
The Government are alive to the concerns that have been expressed about the issue of religious discrimination, and to the case for
it to be made subject to the law. However, this issue raises many difficult, sensitive and complex questions. We have commissioned
research to try to assess the current scale and nature of religious discrimination, and the extent to which it overlaps with racial
discrimination, in mainland Britain. The results, due in autumn 2000, will help to inform our thinking about the appropriate
response.
Clarification of the law and advice will be provided in a number of areas to encourage the adoption of good practice. There will be
a code of practice on discrimination against volunteers, guidance on positive action to tackle under-representation of women and
ethnic minorities, and guidance on sexual harassment at work. In particular, we are looking at ways of giving small businesses
better access to coherent information and advice about equality issues. We are planning to pilot a new joined-up service next year.
Overall, therefore, we intend to combat discrimination across a broad front, using both legislative and non-legislative means as
appropriate, and with the public sector taking the lead. To this end, the Government will introduce legislation as soon as
Parliamentary time allows, following a targeted consultation exercise in the first half of 2000; and will press ahead with the
non-legislative measures outlined above. Our efforts to combat discrimination are already making an impact and will, in conjunction
with new actions, continue to yield results making Britain a better place to live and work for all.

Mr. Simon Hughes: To ask the Secretary of State for the Home Department what proposals are (a) in progress and (b) planned to

Mr. Boateng: We are working with the Association of Chief Officers of Probation to raise the level of performance on enforcement,
which is currently unacceptable, through issuing guidance and best practice. A follow up audit of enforcement by all probation
services is being undertaken in the new year.
We are also tightening up the National Standards for Supervision of Offenders in the Community as from 1 April 2000 with the effect
that offenders who fail to comply with their community sentences will be brought back before the court after a maximum of two
unacceptable absences rather than the current three. In addition, we intend to introduce further powers in the Crime and Public
Protection Bill further to improve enforcement of community sentences.

Mr. Burgon: To ask the Secretary of State for the Environment, Transport and the Regions if he will make a statement on the outcome
of recent consultation on changes to the Producer Responsibility Obligations (Packaging Waste) Regulations 1997. [100179]
Mr. Meacher: I have considered the advice of the Advisory Committee on Packaging as set out in Sir Peter Parker's letter to me of 22
December 1998, in particular as this relates to changing the percentage activity obligations for each of the four main sectors of
the packaging chain. Following consultation on these proposed changes and other matters, and subject to Parliamentary approval, I
propose to make a number of changes to the Regulations as set out.
(i) As I indicated in my reply to the hon. Member for Elmet on 28 January 1999, Official Report, columns 335-37, I have accepted the
advice of the Advisory Committee on Packaging to change the percentage activity obligations and I have now consulted on this
recommendation more widely. I therefore propose to change the percentage activity obligations of three of the four main sectors in
the packaging chain as follows: Reduction in the convertor obligation from 11 per cent. to 9 per cent. Increase in the packer/filler
obligation from 36 per cent. to 37 per cent. Increase in the seller obligation from 47 per cent. to 48 per cent. The recent
consultation paper discussed the option of requiring compliance plans from individually registered businesses. The Regulations
currently require operational plans to be provided by compliance schemes to the relevant Agency showing how, over three years, they
propose to meet the recovery and recycling obligations of their members. Earlier advice from the Advisory Committee on Packaging on
this point recommended that, where there is a significant number of individually registered businesses, they, too should plan ahead
and give thought to the steps that would need to be taken to meet the mandatory Directive in 2001. In 1998, there were some 890
individual registrations with the Agencies and some 800 in 1999. I am also aware that there has been concern among businesses who
are members of compliance schemes that there would be a higher rate of non-compliance among businesses pursuing this individual
route. For 1998 this proved to be true, with around 200 individually registered businesses failing to provide compliance
certificates as required and a number of these failing to take steps to comply with the recovery and recycling obligations. I
believe that it is important that all those obligated under the Regulations should have to consider what infrastructural development
might be needed to enable the UK to meet the mandatory Directive targets in 2001. At the same time, I am concerned to ensure that
smaller businesses should not be faced with disproportionate administrative burdens. I am therefore proposing that businesses
registered individually with an Agency who have annual turnover of more than £5 million, should provide a compliance plan to the
relevant Agency upon registration and update this annually. We will be looking carefully at the new requirement in its first year of
implementation to assess its effectiveness in improving compliance and the associated administrative burdens.
(iii) In my reply to the hon. Member on 28 January 1999, I announced that the financial turnover threshold test for 2000 would be
"more than £2 million" thus excluding smaller businesses in the £1 million to £2 million turnover range from the scope of the
Regulations. The recent consultation document discussed a number of threshold test scenarios to see whether it was going to be
possible to exclude a further number of smaller businesses. However, the Government's view is that the optimum balance of costs and
benefits is to be achieved by continuing with the proposed "over £2 million" financial turnover and "over 50 tonnes" packaging
handled. I am glad to confirm that these are the two threshold tests that will apply from 1.1.2000 as this will exclude a number of
smaller businesses from the scope of the Regulations.
(iv) In my reply to the hon. Member referred to above I also noted that the fee charged by the Environment Agency and Scottish
Environment Protection Agency would rise to £900. Since that fee was calculated in mid-1998, the Agencies have had further
experience of the monitoring that is required and have had feed-back from business as to the sort of monitoring programme that is
wanted to ensure that free-riding does not provide some businesses with a competitive advantage and does not inhibit the achievement
of the Directive targets in 2001. The Agencies fee will therefore rise to £950 with effect from 1.1.2000. The Competition Act 1998
comes into force on 1 March 2000. As a result, the Government is proposing to simplify the Regulations and remove the special
competition scrutiny regime to which those who propose to establish a compliance scheme are subject. All compliance schemes and
individual businesses will, in any case, be subject to the Competition Act 1998 and the Office of Fair Trading can still investigate
any compliance scheme which seems likely to have an anti-competitive effect.

Dr. Tonge: To ask the Secretary of State for the Environment, Transport and the Regions what representations he is making to his

Mr. Meacher: The UK and the EU are considering the concepts discussed at the informal consultations on the Biosafety Protocol held
by the President of the Extraordinary Conference of the Parties (Ex-COP), Minister Mayr, in Vienna in September. I have put the UK
views to my Ministerial colleagues at meetings of the Environment Council. The Environment Council is next due to discuss the
Protocol and agree the framework for the negotiators at its meeting on December 13 and 14. The draft text of the protocol contains
an article that the Parties to the Protocol would, at their first meeting, consider and approve cooperative procedures and
institutional mechanisms to promote compliance with the provisions of the Protocol, and to address cases of non-compliance.

Mr. Hain: I refer my hon. Friend to the speech on Angola I made on 20 November 1999, a copy of which I have placed in the Library.
Following adoption of UN Security Council resolution 1173 (1998), The Angola (United Nations Sanctions) Order 1998 (SI 1998/1752)
came into force on 23 July. It imposes restrictions on certain actions making available or otherwise transferring funds and
financial resources to or to the benefit of UNITA as an organisation or senior officials of UNITA or adult members of their
immediate families.
The Angola (United Nations) (Dependent Territories) Order 1998 (SI 1998/1753) implements these measures in the Overseas Territories.
The Angola (United Nations Sanctions) (Channel Islands) Order 1998 (SI 1998/1756) and The Angola (United Nations Sanctions) (Isle of
Man) Order 1998 (SI 1998/1757) implements these measures in the Crown Dependencies.
