Mr. Rowe: To ask the Secretary of State for the Home Department if he will make a statement on the implementation of the Piggot report and other matters relating to the treatment of juveniles in court proceedings. [7625] Mr. Maclean: The advisory group on video evidence, chaired by Judge Thomas Pigot QC, made a number of recommendations in its 1989 report on the treatment of child witnesses--and other witnesses--in criminal trials. The majority of these recommendations have been implemented. The Criminal Justice Act 1991 provided, in respect of sexual offences and offences involving violence or cruelty, for pre-trial video recordings to be used as a child's evidence-in-chief at court; for a prohibition on the defendant cross-examining a child witness in person; and for trials involving child witnesses to be transferred direct to the Crown Court without the need for a magistrates court to consider the case. The Act also provided that a child's evidence in criminal proceedings should be given unsworn; abolished the presumption that children were not competent as witnesses; and raised the age limit governing a young person's eligibility to be cross-examined via a television link from under 14 to under to 17. The Criminal Justice and Public Order Act 1994 removed the requirement, in sexual offence cases, that the judge warn the jury about convicting on the uncorroborated evidence of the victim. In addition to the legislative changes, the Government have issued, or contributed towards the production of, a variety of documents and guidance notes to promote ways of assisting those children who become involved in the criminal justice system as witnesses. This includes guidance to magistrates courts on the use of screens, as recommended by the Pigot report, and a memorandum of good practice on video recorded interviews with child witnesses in criminal proceedings. In addition, in January, a video, funded by the National Society for the Prevention of Cruelty to Children and the Home Office, will be launched offering good practice advice of judges and barristers for handling cases including child witnesses. All these measures are consistent with the Government's policy of giving a high priority to the needs of victims of crime. The measures that we have implemented are subject to review and research to test their effectiveness. The Government will continue to make further changes where we consider that they will bring improvements to the operation of the justice system.

Mr. Wicks: To ask the Secretary of State for Social Security what measures are planned to assist applicants under the proposed departure directions procedure in obtaining evidence to support allegations of inconsistent lifestyle. [8124] Mr. Andrew Mitchell: The administration of the Child Support Agency is a matter for the chief executive, Miss Ann Chant. She will write to the hon. Member. Letter from Ann Chant to Mr. Malcolm Wicks, dated 9 December 1996: I am replying to your Parliamentary Question to the Secretary of State for Social Security about applications for a departure from the maintenance formula on the grounds that a parent's lifestyle is inconsistent with the income on which their maintenance assessment is based. You asked what measures are planned to assist applicants in gathering evidence to support their application for a departure direction on this ground. While the departures scheme places the onus on the applicant to justify the validity of their application, it is recognised that in such cases, conclusive written evidence will not always be available. Providing there is some indication of a genuine case to consider, it is intended that the decision on the application will be based on a balanced view of all the evidence, even when not supported by documentary evidence. It may be helpful if I outline how applications on this ground will be dealt with. The Agency will first establish that the application is valid and that there is some indication that the parent's overall lifestyle is substantially inconsistent with the level of income on which the maintenance assessment is based. Cases will be refused at this stage if it appears that there is no likelihood of the application succeeding, for example, if the applicant states only that the other parent goes abroad for a holiday or has a better lifestyle than their own. If the application is refused at this point, the parent making the application will have a right of appeal. Cases that are not refused will be referred to a Child Support Appeal Tribunal for a decision. It will be for the Tribunal to decide what evidence it needs and how to balance the information provided by both parents in reaching its decision. There are also powers to hold "direction hearings" in advance of the Tribunal. These provide the Chairman with the opportunity to direct either parent to provide any further evidence considered necessary. I hope this explanation reassures you that, whilst some reasonable degree of responsibility must rest with the applicant to justify their application, it is accepted that they will not always be in a position to provide full supporting documentary evidence; and that failure to do so will not automatically result in the application being refused. A balance must be struck however, to prevent vexatious or malicious applications from getting into the system.

Mr. Straw: to ask the Secretary of State for the Home Department what were the recommendations of the Masefield scrutiny report on police paperwork; what progress has been made in implementing these recommendations; and if he will place a copy of the document in the Library. [7445] Mr. Maclean: The Masefield scrutiny into administrative burdens on the police in the context of the criminal justice system reported in June 1995. Recommendation 4 and endorsements 8 and 9 in the report concerned police paperwork on case files. Full or phased implementation of new style abbreviated files--endorsement 8--is taking place in 40 forces with the remaining three planning to introduce the new files by 31 December 1996. These new files were designed to reduce significantly the number of administrative documents required in cases which are likely to result in a guilty plea in the magistrates court. Police forces are required to prepare and implement a programme to employ civilians to produce records of taped interviews or ROTIs--recommendation 4. A Home Office circular issued in July 1995 asked Chief Officers to implement this recommendation by 31 March 1997. In the new style abbreviated files. ROTIs have been replaced with short descriptive notes or SDNs comprising brief accounts of admissions, any mitigating or aggravating features and other relevant material. The SDNs are being piloted for 12 months. The scrutiny endorsed the use of dual case files by the police and Crown Prosecution Service--endorsement 9. A total of 37 forces have now implemented the dual file system, with three others planning to do so by the end of 1996. A copy of the scrutiny report has been placed in the Library.
