The role of the police is to facilitate peaceful protest, to keep the peace, to uphold the law and to prevent the commission of offences. Police tactics and decisions on how to achieve this difficult balance are a matter for the independent judgement of chief officers of police.
While the Government and police are committed to facilitating peaceful protest, we are clear that people have the right to go about their lawful business without fear of harm or intimidation. It is unacceptable for protest to cross over into violence or intimidation and the police will use the range of powers they have to deal with any activity that crosses this line.

The Government are broadly supportive of the idea of the European Protection Order (EPO) and the goal of providing protection for people exercising their free movement rights. Victims of domestic violence and other crimes should be able to move across the European Union with confidence that they will be protected, wherever they are, and we want to work with our European partners towards achieving this.
The UK does, however, have a three month period in which to decide whether to opt in to the proposal. During this period the Government will be following the parliamentary scrutiny process, including consultation with the scrutiny committees. We would not want to pre-empt this process and will be waiting for the committees’ views before coming to a decision on opt-in.

All staff who work at Tinsley House immigration removal centre are vetted by the UK Border Agency to ascertain their suitability to work with children.
Officers also receive child protection training. However, the current package is currently being developed further in conjunction with West Sussex Children's Services.

The single security and intelligence budget, which includes government spending on counterterrorism and intelligence, was announced as part of the 2007 Comprehensive Spending Review. It is forecast to rise from £2.5 billion in 2008-09 to £3.5 billion in 2010-11. The new version of the United Kingdom's Strategy for Countering International Terrorism will be delivered within this envelope.
Breaking down this budget by specific counterterrorism and intelligence activities, beyond what is published already, would reveal our capabilities and details of the security and intelligence agencies’ spending. It has been the policy of successive Governments not to reveal these details.
The provision of counterterrorist protective security measures has long been based upon the principle that the "user pays". However, there has been central government expenditure in respect of the "Protect" strand of the strategy and some information has been made publicly available. This includes:
£5 million for 2009-10 to support regional and local delivery of work in England and Wales to improve the protection of crowded places as set out in the Government’s consultation document "Working Together to Protect Crowded Places.";
£2.7 million for the period 2007-08 to 2008-09 to increase the size of the National Barrier Asset; and
more than £1.5 million in 2008-09 to support additional Counter-Terrorist Security Advisers posts.

We are aware of how much violence of this kind goes on in the home. It is difficult, because women as well as men are committing it, as we know from some awful cases recently. We need the statistics; we need to look at them carefully; but I believe that this pilot scheme will enable things to be done.

My Lords, are the Minister and his department sufficiently aware that the majority of children who suffer physical, sexual or emotional abuse or neglect do so within the family home? Therefore, a substantial minority of abusers will be not the actual father. As the Minister suggested, it is extremely important that this should be looked at with some care so that one can tell the proportion of natural fathers and of stepparents. I understand that the Independent Safeguarding Authority should not be doing this, but someone should be looking at the issue of stepparents going into homes. I have not time to tell your Lordships’ House how many examples I have of that situation.

We have to remember that while there have been horrible cases—indeed, the reason for the ISA is the Bichard report on the Soham murders—the vast majority of people in this country are decent people who have children and look after children and take them around. We must not let these safeguards drive us down the route of doing ludicrous things. However, we have a statutory duty to try to look after people and there has to be a balance. In general, we have got that balance right. The briefing that I read in preparation for this Question—it is why Questions are useful—suggests that we have gone slightly too far in one area, which I shall raise. However, generally, the balance is right, but we must not overreact to these things.

When I asked whether we have clear statistics which show whether abuse is by a stepparent or by a natural parent, I discovered that we do not have a breakdown of those figures; perhaps we should start collecting them. He is right about the large numbers, some of which are real, some of which are not. However, the Independent Safeguarding Authority, which the Question is about, is looking specifically at those seeking to work with, or volunteering to work with, at-risk adults and children. A child sexual offender review disclosure pilot is looking into the areas raised by the noble Lord.

My Lords, I am most grateful to the noble Lord for that helpful Answer. Is he aware that in the year ending March of this year, the main complaint and problem of the 17,406 children who telephoned ChildLine was physical abuse in the home and that a significant part of this was by people who were not their parents? Is he further aware that it is extremely likely that a child living with the natural mother but with a stepfather—especially if the stepfather is not married to the mother—is liable to be exposed to sexual and physical abuse? Do we not owe these children a duty of protection when their parents are unable or unwilling to protect them?

It lasted for 12 months, finished in September and is being independently evaluated at the moment. The final evaluation report is due in January 2010. This will be looked at in a cold, sensible way because we absolutely must not go for vigilantism. There is an awful lot of passion in this area because it is such a horrible business. One needs to look at it in a cold, calm way; otherwise one could go to extremes which cause a lot of trouble.

All staff at immigration removal centres and escorts who have contact with children are checked by the Criminal Records Bureau before they are employed. In very exceptional circumstances, essential workers may be employed provisionally while the checks are completed. In these circumstances, individuals are accompanied by a fully cleared member of staff while undertaking their duties and do not have free access to the removal centre or lone access to individuals detained.
