The key is effective management, but we must acknowledge that particular care over health and safety is important when moving traffic is involved. The Highways Agency is improving its partnership arrangements with its contractors to help tackle litter hotspots.

My Lords, last week, on 15 May, I did some service delivery for single farm payments by receiving applications direct from customers, but I am not doing service delivery on collecting litter. There are some serious issues and the noble Lord is right that we are dirty in some ways, but I cannot comment on his suggestions for that. In the latest year for which figures are available, some 43,000 fixed penalties were issued, which is 10,000 up on the year before, and 77 per cent of that was collected in repayments. It would be complicated to look for other ways of dealing with people throwing litter on the roads, and I am told that it would not be cost effective.

My Lords, I am rather glad that the noble Lord, Lord Rooker, has answered that Question because he, unlike many of his colleagues both in this House and in another place, is a Minister with a reputation for getting results. Given that action is very much needed on this issue, and given that there is only one test as to whether roads are clean, I hope that he will take some action. First, we are about the dirtiest country in Europe—we would be even if we were not in Europe.
Secondly, my Lords, is it not about time that we made the punishment fit the crime? Let there be 20 hours of litter-picking for a first offence and 40 hours for the second offence. As for local authorities, just as they fine people who mess around with their bags, let them pay a fine organised by the Highways Agency when they fail to keep the roads clean.

My Lords, frankly, Birmingham is one of the cleanest cities in the country. Let me make that absolutely clear. Let us look at a more salubrious part of the country’s roads—for example, junctions 1 and 2 of the M3, which are in an area that is not Labour-controlled, I might add. In April this year on one westbound carriageway—one junction, one month, one collection in one direction on the motorway— 189 bags of rubbish amounting to one tonne were collected. I am told that that is typical of our motorways and of what people turf out of their cars as they travel. Very little of it is due to the wind and it is a disgrace.

My Lords, does the noble Lord agree that Mother Nature is very kind to the approaches of his home city of Birmingham in the spring and summer, for she cloaks the filth and litter along their roadsides—I use the A456—railway embankments and canal sides? Visitors from foreign countries to that city must be appalled at the amount of litter lying around. What can he do about it?

My Lords, that is quite a practical suggestion. On the targets, not all local authorities go in for issuing fixed-penalty notices, for example. We are up to 233 authorities at the moment: a year ago, only 197 saw the benefit of issuing those. A degree of competition, with local authorities claiming that they are cleaner—with Birmingham being the cleanest, of course—cannot be a bad idea. I do not pay council tax to Birmingham and have no interest to declare.

My Lords, at this time of the Chelsea Flower Show, I am sure that the Minister will acknowledge the huge benefits that the Britain in Bloom campaign has caused, as local authorities compete to beautify their neighbourhoods. Does he not believe that they might similarly compete in a litter-free Britain campaign, which would stimulate them into making sure that theirs is a litter-free zone?

My Lords, this is an important subject. In the town where I live, the Colne in Bloom volunteers certainly do much litter-picking. I should declare an interest as a member of a principal litter authority—namely, Pendle Borough Council—which, in the league table produced in April, came fifth among authorities in the north-west. We are doing all right, but not well enough.
Will the Minister agree that there is still some difficulty in two-tier areas over the demarcation between the county highways authorities and the main litter authority, which is the district? For example, when it comes to removing dead animals, the litter authority is responsible for small ones such as cats, dogs and hedgehogs while big animals like pigs, cows or elephants are the county’s responsibility.

It is a fair point because the total expenditure for local authorities in England for street cleaning which is not chargeable to the highways is approximately £500 million, which is a lot of money that could be avoided. The cost to council tax payers of fly-tipping, lack of recycling and collecting such litter is a fortune, but getting that connection to them of what it costs society as a whole and them individually is not easy.

The Government-funded Waste and Resources Action Programme's (WRAP) Achievements Report 2005/6 details the progress so far in encouraging the use of recycled aggregate by local authorities. WRAP's recycled roads campaign, combined with tailored procurement guidance (including standard contract clauses) has helped to more than double the number of councils directly specifying recycled aggregates in their highway contracts. A survey carried out by WRAP found that 21 per cent of local authorities specified recycled and secondary aggregates in their street maintenance contracts, compared with only 10 per cent in the pre-campaign survey. This exceeded WRAP's 20 per cent target for 2006.
In the same period, WRAP also secured an additional 3.14 million tonnes a year of reprocessing capacity for aggregates, against their target of 3 million tonnes.
Through its advocacy campaigns, WRAP continues to offer bespoke advice and guidance to local authorities to encourage and enable them to use more recycled content in their highways projects.

You recently asked Her Majesty's Government a Parliamentary Question regarding, what plans they have to provide traffic-calming measures in the Ballyhackamore area of Belfast; and what is the timescale for such measures. As this issue falls within my responsibility as chief executive of Roads Service, I have been asked to reply.
In my letter dated 6 November 2006, in response to your previous Parliamentary Question relating to this issue (HL 8130), I listed the streets in the Ballyhackamore area that our local officials had assessed for traffic-calming measures.
I am pleased to advise that the consultative and legislative processes have now been successfully completed for Holland Drive, Kirkliston Park, Hewitt Parade, Enid Drive and Enid Parade. Traffic-calming measures on these streets are programmed for completion before the end of May 2007.
There are, however, a number of outstanding objections relating to the provision of traffic-calming measures on Earlswood Road, Belmont Church Road and Sydenham Avenue, and at present no decision has been taken whether to proceed with traffic-calming measures on these streets.
In Clonlee Drive and Irwin Avenue, scores from assessments were sufficient to merit the inclusion of schemes in the 2007-08 traffic-calming programme. However, as with all works of this nature, implementation of any proposal is subject to the successful completion of the consultative and legislative processes. I am therefore unable to confirm at this time whether these schemes will be implemented.
Preliminary assessment scores of Dundela Avenue, Dundela Gardens, Belmont Avenue and Halstein Drive indicate that schemes at these locations would not be as high a priority when compared to other competing sites in our eastern division. While we do not have any plans at present to provide traffic-calming measures at these locations, they will however remain on our list for possible inclusion in future years.

As this issue falls within my responsibility as chief executive of Roads Service, I have been asked to reply.
I can advise that neither Roads Service, our technical advisors, who are monitoring the construction of the A1 Cloghogue to the border dual carriageway (part of the A1/N1 Newry to Dundalk link road), nor the contractor, have any evidence that illegal waste from the Republic of Ireland is being deposited under the carriageway currently being constructed. Therefore, in the absence of any evidence that might indicate the location where such waste may have been deposited, I regret that I am unable to justify the significant costs of carrying out tests along the 4.5 km stretch of the road scheme located within Northern Ireland, to investigate whether such dumping has taken place.
However, I can advise that the new dual carriageway is being constructed through the site of a rubbish tip in an old quarry at Mount Pleasant in County Louth, in the Republic of Ireland. I am advised that the material that is below the footprint of the road at this location is being processed on site. This is in line with current good practice and in consultation with Louth County Council (the client for the section of the road scheme south of the border, and the local authority with responsibility for matters relating to waste). While suitable material arising from this process is being incorporated in the works south of the border, unsuitable waste material is being removed to a licensed land fill site in County Louth.
As regards the security arrangements for the dual carriageway construction site between Newry and Dundalk, I should advise that, while Roads Service's technical advisors are on site monitoring the construction, this is not normally during the hours of darkness. Security of the site is primarily a matter for the contractor, and in this respect the contractor advises that the site is secured at the end of each day and security personnel are engaged to patrol during the hours of darkness.

The Highways Agency (HA) does not subcontract to local authorities any cleansing on roads under its jurisdiction. The HA has a duty under the Environmental Protection Act 1990 to clear litter and refuse from the strategic road network, which includes all motorways and some A-roads and trunk roads. The cleansing duty on other roads is the responsibility of the relevant local authority. To ensure satisfactory standards, cleansing is undertaken in accordance with the Code of Practice for Litter and Refuse. A map of the roads under HA jurisdiction is available on its website.
Data from the Local Environmental Quality Survey of England 2005-06 show that there has been a steady improvement in cleansing performance over the past three years. However, the survey indicated a rise in levels of detritus on rural roads and other highways.

As this issue falls within my responsibility as chief executive of Roads Service, I have been asked to reply.
May I first say that the fatalities arising from the traffic accidents that have occurred on the Ballybogey Road were most regrettable, and I can assure you that Roads Service gives a very high priority to accident reduction and prevention measures. As you may be aware, Roads Service receives collision reportsfrom the Police Service of Northern Ireland (PSNI), which allows us to regularly carry out assessmentsof locations and routes, in conjunction with theRoad Policing Unit, to identify whether there are appropriate measures that could be undertaken to help reduce road casualties.
The Ballybogey Road has been assessed both on a regular basis and, along with the Road Policing Unit, following previous fatal collisions. These assessments have not indicated any road improvement measures that could be introduced to help prevent further collisions. A further assessment will be carried out following the latest tragic collision when the outcome of the PSNI investigation into the collision is available.
Unfortunately there are incidents such as this where there may be very little in the way of highway measures that would be of assistance to further help the motorist to drive safely.

You recently asked Her Majesty's Government a Parliamentary Question regarding what proposals they have to improve traffic flow in Londonderry. As this issue falls within my responsibility as chief executive of Roads Service, I have been asked to reply.
As you may be aware, the regional development strategy (RDS) for Northern Ireland contains a policy to strengthen the role of Londonderry as the regional city and hub for the north-west. The regional transportation strategy proposed two transport plans, the Regional Strategic Transport Network Transport Plan (RSTNTP) and the Sub-Regional Transport Plan (SRTP), as the mechanism for implementation of the RDS outside the Belfast Metropolitan Area with regard to all modes of transport.
The RSTNTP deals with the main strategic routes into and through Londonderry and this plan was published in March 2005. An enhanced list of schemes for inclusion in the RSTNTP was published for consultation on 31 July 2006 with a response date of 29 September 2006. The full details of the major works schemes included in the plan can be viewed on our website at www.roadsni.gov.uk/consultation/docs/ConsultationDoc_SRI_Prog.pdf or copies are also available in both the House of Commons and House of Lords Libraries. The responses are currently being considered and it is hoped that an announcement of the final proposals will be made later this year. The schemes included in the current RSTNTP and draft proposals would upgrade sections of all the major routes approaching the city.
The SRTP deals with the whole of Northern Ireland, excluding the Belfast Metropolitan Area and the routes included in RSTNTP. A section has been developed for Londonderry and includes a detailed study of all modes of transport (walking, cycling, public transport and traffic) within the city. The draft document was issued for public consultation in March 2006 with a reply date of 23 June 2006. Full details of the draft plan can be viewed on our website at www.roadsni.gov.uk/consultation/docs/ExecSummary.pdf or copies are also available in both Libraries. It is planned to publish the SRTP at the end of March 2007.
These two transport plans will contain the main proposals for improving traffic flows and addressing other transportation issues for the city and its environs for the period to 2015.

As this issue falls within my responsibility as Chief Executive of Roads Service, I have been asked to reply.
I am advised that there are no records of damage resulting from the isolated incidents of water ponding in the Queen Elizabeth Road, Enniskillen. The issue of compensation has, therefore, not arisen.

You recently asked Her Majesty's Government a Parliamentary Question regarding what proposals they have to improve the safety of the road from Sprucefield to the Irish border.
I have been asked to reply as this issue falls within my responsibility as chief executive of Roads Service.
I am pleased to be able to advise that Roads Service has a substantial programme of work aimed at improving both the reliability of journey times and safety on the A1 Sprucefield to the border key strategic route. This programme, which is contained in the Regional Strategic Transport Network Transport Plan 2015, published in March 2005, and in proposals for Expanding the Strategic Road Improvement Programme 2015, published for consultation in July 2006, includes plans to upgrade the whole route to dual carriageway standard; undertake improvements at selected junctions; and provide a safety barrier in the central reservation.
You will be aware that a nine kilometre stretch of dual carriageway between Loughbrickland and Beech Hill, costing £25 million, was opened to traffic in November last year.
Construction work is currently under way to upgrade a five kilometre portion of the road between Cloghogue and the border. This is part of the A1/N1 Newry to Dundalk link road cross-border project costing an estimated £33 million which is expected to be completed later this year. This will be a high-standard dual carriageway with a continuous safety barrier and one grade-separated junction.
Plans to provide a 12 kilometre high-standard dual carriageway from Beech Hill to Cloghogue, estimated to cost £109 million, are well advanced. These will incorporate a continuous safety barrier along the length of the scheme with access being provided at five strategically located flyover-type junctions. Construction work is expected to begin in the spring, with completion in 2009. When provided, this scheme will complete the dualling of the route from Sprucefield to the border.
Two junction improvement schemes have recently been completed on the A1. A new underpass was opened in June 2005, at a cost of £3.5 million, at Hillsborough Road at the northern end of the Dromore bypass, and a new flyover was opened in March 2004, at a cost of £4.5 million, at Rathfriland Road on the Banbridge bypass.
Plans for the construction of four further junction improvement schemes over the next three years, at a cost of £16 million, are also well advanced. A new flyover is planned for Dromore Road at the southern end of the Hillsborough bypass, while a new underpass is planned for Banbridge Road at the southern end of the Dromore bypass. A second new flyover is planned for Dromore Road at the northern end of the Banbridge bypass and a second new underpass is planned for Dublin Road at the southern end of the Loughbrickland bypass. I can also advise that the developer of the Bridgewater Outlet Centre at Banbridge is providing a new flyover at Newry Road, at Yellow Hill, at the southern end of the Banbridge bypass.
In our Expanding the Strategic Road Improvement Programme 2015 consultation document, we have included two further proposals for the A1. A four kilometre high-standard dual carriageway, estimated to cost £45 million, is proposed to link the M1 motorway to the A1 at Hillsborough. This will bypass the Sprucefield Retail Centre and will include a flyover at Hillsborough roundabout. Four more flyover junctions, estimated to cost £22 million, are also proposed between Hillsborough and Banbridge, which, together with the provision of a continuous central safety barrier between Hillsborough and Loughbrickland, will upgrade this section of the route to a higher-standard dual carriageway with no at-grade crossings.
These proposals represent a substantial investment of more than £250 million, of which £33 million has already been completed; £33 million is under construction; £125 million is expected to be constructed over the next three years; and a further £67 million is proposed in the Expanding the Strategic Road Improvement Programme 2015 consultation document.

You recently asked Her Majesty's Government a Parliamentary Question about what proposals they have to alleviate flooding in Queen Elizabeth Road, Enniskillen, County Fermanagh. As this issue falls within my responsibility as chief executive of Roads Service, I have been asked to reply.
As you may be aware, the Department for Social Development funded a scheme to provide a new boulevard along Queen Elizabeth Road in 2006. During construction, improved drainage was incorporated into the scheme and a new surface on the road was provided by Roads Service at the conclusion of the works.
I am advised that since completion of the scheme, there have been some isolated incidents of water ponding on the roadway caused by leaves covering gulley gratings. However, I have been informed that the problem was resolved by clearing the obstructing leaves and that no further remedial measures are considered necessary.
