The Government are giving every consideration to measures which will effectively tackle the growing concern in our society on this matter. My Lords, we have a national clinical director in the Department of Health who is concerned with particular aspects of care for older people. My right honourable friend John Hutton is the champion for older people in the Government as a whole. Clearly I cannot give such a commitment, but we continue to look to give leadership in these important areas.

My Lords, financial abuse is defined in the No Secrets document, which is statutory guidance to local authorities. I accept that the definition used by ACE is wider. We are working to identify the scale of the problem, and we are using the ACE definition in that, but I will certainly ensure that we consider the question of definition.
We will consider the question of wider guidance in the context of the research now being undertaken into the scale of the problem. It is worth making the point, however, that we already have statutory guidancethat local authorities should be following. I agree that there are number of matters in the ACE report that need to be considered by other bodies such as financial institutions, and I hope they will do so.

My Lords, the Minister, having recently been at the DWP, will recognise that in future the income of older people will come from a number of diverse sources and be more complex. In that case, does he accept that the lack of a clear definition of financial abuse itself leads to abuse? Does he also accept that there is a plethora of guidance available to different people—on the web, for example—but that some of it is conflicting, and that there is therefore a case for consolidated guidance that is available to private institutions such as banks, statutory authorities, family and informal carers, so that there is a common basis upon which to detect and prevent financial abuse of older people?

My Lords, the noble Baroness is right that the data produced by Action on Elder Abuse come from an analysis of 470 phone calls that it received on its helpline, and that the breakdown of abuse was 53 per cent sons and daughters and 9 per cent carers and other paid workers. While that cannot be taken as statistically accurate in terms of the wider question, it is certainly cause for concern.
With regard to the Health Select Committee report and adult protection committees being asked to look at the issue of financial abuse, we do not believe there is anything in the current guidance that will prevent them doing so, but we will look at that. The regulatory bodies are independent, but I will ensure that the report is communicated to them so they can consider the point the noble Baroness has raised.

My Lords, I thank the Minister for that helpful reply. Does he accept that more than £2 million was reported, through one helpline alone, as having been stolen from elderly victims by their own sons and daughters? This is more important than the situation with carers because they are less likely to do this, apparently. We know that older people are very reluctant to report their own children, so the true picture must be dramatically in excess of that. Therefore, will the Government accept the recommendations of the Health Select Committee inquiry in 2004 that, first, the financial abuse should be a specific issue for adult protection committees; and, secondly, that the regulatory bodies of health and social care should increase their surveillance of financial systems, including powers of attorney and, in care homes, the use of residents’ personal allowances?

My Lords, does the Minister agree that the increasing elderly population in this country and the concerns about end of life underline the importance of the retention in the hands of the medical profession of the decision whether patients should receive treatment or not for their end-of-life benefit, in the best interests of the elderly person in the same way as that should be decided in the best interests of the child?

The White Paper Security in retirement: towards a new pensions system (Cm 6841) includes proposals to ensure more carers are able to build up better state pensions. To do this we are proposing to introduce a new carer's credit for those reaching state pension age from 2010. It would be available for relevant weeks of caring within a tax year allowing a person to build entitlement to basic state pension (BSP) and state second pension (S2P) if they are caring: for 20 hours or more a week; and for one or more persons receiving the middle or highest rate of disability living allowance care component, attendance allowance, or constant attendance allowance.
We have proposed to link the new carer's credit to those caring for someone in receipt of specified disability benefits. We estimate that around 70,000 people a year could gain a credit for BSP from this proposal, and over half of these will be women. The new credit should also mean around 110,000 more women and 50,000 more men will be accruing entitlement to S2P.
We estimate that this may leave around 60,000 people in 2010 who report themselves to be caring for 20 hours or more who may not be accruing BSP through paid contributions or credits, including the new carer's credit. The equivalent figure for S2P is around 180,000 people. It is not possible to break down these figures further by the individual benefits received by the person being cared for.
The potential costs of awarding these extra people a credit for BSP and S2P build up slowly over time. They could reach some £200 million in 2030, over and above expenditure on the current system.
With existing data sources, it is difficult reliably to estimate the intensity of care that someone in receipt of a disability benefit such as incapacity benefit or the disability premium in income support, may be receiving from a particular carer. It is also unclear what care needs, if any, those in receipt of these benefits might have.
For the purposes of estimating the cost of the new carer's credit in the White Paper, it was assumed that all those in receipt of the middle or higher rate care component of AA/DLA, or CAA, would have a carer providing more than 20 hours’ care per week. Although this is not a precondition for the receipt of those benefits, entitlement provides a clear indication that the recipient has a significant level of care needs.
As with any reform, the timing of change to the state pension system involves striking a balance: to achieve fair outcomes for tomorrow's pensioners, while ensuring that the transition from the current arrangements is affordable, avoids complexity and is delivered successfully. Backdating the carers credit to make it available on the basis of self certification for past periods of caring activity would not be feasible; to do so would be intrusive and forfeit any checks and balances in the scheme.
It is not possible to make accurate estimates. However, assuming that all those eligible for the proposed carer’s credit from 2010 were automatically awarded five years-worth of backdated credits, costs of the new carer's credit could reach around £200 million, over and above expenditure on the current system in 2030.

Evidence from the Family Resources Survey (FRS) suggests that around 1.4 million women working part-time in 2003-04 earned less than the lower earnings limit (LEL) from their main or only job. This figure includes women covered by national insurance credits and women protected by home responsibilities protection who may be building up entitlement to basic state pension (BSP) and state second pension (S2P).
We estimate that there may be fewer than 50,000 adults reporting themselves as caring for 20 or more hours per week, who also have a part-time job and earn less than the LEL in their main or only job.
The FRS, on which the information provided is based, is ““point in time”” analysis, so only provides a snapshot of the number of people in these particular circumstances at the time the data are collected. Individuals may not, of course, be in these circumstances all of their working lives.
As a result of our proposed reforms to the BSP, including the reduction in the number of qualifying years to 30, we estimate that by 2025, over 90 per cent of women and men reaching state pension age will be entitled to a full BSP. The extension of childcare credits in S2P to parents until their youngest child turns 12 means that from 2010 around an extra 780,000 women and 30,000 men will be accruing S2P.
People reaching pension age from 2010 will have far greater opportunity to build BSP and S2P entitlement over their working life. Provision of care or spells of employment with earnings below the LEL should no longer compromise this opportunity. Our Green Paper A New Deal for Welfare: Empowering people towork proposed that the new employment and support allowance should not include the basic disability premium, but would provide additional help through a support component and employment support component. We need to consider the implications of this change for disabled people who may claim jobseeker’s allowance, income support, housing benefit or council tax benefit after the introduction of employment and support allowance. We would consult if any further changes were proposed.

The current system allows women who care for children or dependants to build up state pension entitlement through home responsibilities protection (HRP) which reduces the number of years needed for a full basic state pension. Combined with women’s improved labour market position, since its introduction in 1978 HRP has improved women’s basic state pension records.
However, we know that the current system can produce unequal outcomes for women and carers and women have done less well than men in building entitlement to state pension. The report Women and Pensions: The Evidence provides a useful compendium of evidence that highlights the key influences on the level of women’s retirement income, including consideration of the impact of parenthood and family caring responsibilities on pension entitlement.
The report—along with the Pensions Commission’s final report—has informed the national pensions debate as the Government look to build as broad a consensus as possible on pension reform and works towards publication of a White Paper later in the spring. In taking forward any proposals for reform, we will be guided by five key tests: any changes must promote personal responsibility, be fair to women and carers in particular, and be affordable, simpler to understand and sustainable.

The available information is in the tables. Information provided for PQ1249 and PQ1250 is the number potentially eligible for national insurance credits rather than the numbers expecting to receive them. The estimates therefore include people eligible for credits but who might also be economically active and also paying national insurance (NI) contributions. For example, a person’s eligibility to home responsibilities protection is based on receipt of child benefit regardless of whether that person is working and paying NI contributions. All estimates have been provided by the Government Actuary’s Department.
Please note the following about the above estimates (PQ/05/1248):(1) Projections relating to tax credits are not reliable due to changes in the tax credit system and therefore information has not been provided for part (b).(2) Numbers are based on number of jobs, not individuals; therefore if an individual has two jobs with earnings above the LEL but below the lower tax threshold they will be counted twice in the table.(3) Estimates are based on projections for the Update to the Quinquennial Review(QR) of the National Insurance Fund (NIF) published in December 2004 and are for Great Britain (the figures come from the prices uprating of basic state pension with 2 per cent real earnings growth scenerio, details on the assumptions underlying those projections are provided in the report on the Update to the QR of the NIF).(4) Estimates of the working age population are from the 2003-based population projections and define working age population to be all people aged 16 to state pension age.(5) The number of women includes women retaining the option to pay at the reduced rate.
Please note the following about the above estimates (PQ/05/1249 & PQ/05/1250):(1) These figures include ““potential credits”” cases. For example, there are people eligible for credits because of home responsibilities protection, autocredits and education credits (among others) who might be economically active, in work and therefore also paying national insurance contributions.(2) Part (f) asks about ““credits under existing rules for auto-enrolment”” and we have assumed this to mean those receiving credits because of autocredits. Autocredits projections assume that autocredits will be available to men and women aged 6064 following equalisation of state pension age, which begins in 2010. This is in line with current policy.(3) Figures represent the average number in any given week in the year and are not the number who might be eligible at some point in that year.(4) Numbers represent working age population—age 16 to pension age. Based on Government Actuary’s Department (GAD) 2003 population projections for Great Britain (GB). Allowance is made for raising female pension age between 2010 and 2020.(5) Estimates of numbers claiming each benefit are provided by GAD.(6) The total credits will add up to more than the numbers inactive. This is because it is possible to be economically active and receive credits. For example, the unemployed are counted as ““active”” but will get credits if claiming JobSeekers Allowance.(7) The estimates are based on the same assumptions for economic activity as used for the GAD QR update.(8) Starting credits (included in the other category) are awarded from the age of 16 for up to 3 years for those that need them.(9) No data is given for statutory sick pay (SSP) or statutory maternity pay (SMP). People with SSP or SMP are employed, liable for contributions and are not normally entitled to credits.

Carers and severely disabled adults have access to the full range of social security benefits: carer's allowance, incapacity benefit, jobseeker's allowance, income support, disability living allowance, attendance allowance, industrial injuries benefits, bereavement and widow's benefits, maternity allowance, state pension and state second pension, pension credit, housing benefit and council tax benefit, which are dependent upon their individual circumstances. They may also have access to payments under the tax credits and war pensions schemes, and to statutory sick pay, statutory maternity pay or statutory paternity pay.
A carer's allowance, currently £45.70 per week, can be paid to a carer whose weekly earnings, net of allowable expenses, are £82 or less and who regularly provides care for at least 35 hours a week to a severely disabled person in receipt of attendance allowance or the middle or highest rate of the disability living allowance care component. Extra money can be paid with carer's allowance for a partner whose net earnings are no more than £27.30 per week.
Carers and the disabled people they care for may also be entitled to income support, income-based jobseeker's allowance or pension credit. These entitlements are assessed separately unless they are partners living in the same household, in which case they are subject to a joint assessment. In either circumstance, the assessment can include a carer premium (carer's additional amount in the case of pension credit) on account of the carer's entitlement to carer's allowance, and one or more disability premia (disability additional amount in the case of pension credit) on account of the disabled person's eligibility for attendance allowance or disability living allowance. Receipt of attendance allowance or disability living allowance is ignored in the assessment of entitlement to income support, income-based jobseeker's allowance or pension credit. The maximum levels of housing benefit and council tax benefit are available to recipients of income support, income-based jobseeker's allowance or pension credit who are liable to pay rent or council tax.
Overall, households which include a carer and/or a severely disabled person can receive significantly more benefit than other households receiving income support, income-based jobseeker's allowance or pension credit. These benefits are set at levels which ensure that recipients should be able to meet their normal daily living needs. To protect their purchasing power, they are increased each year in line with the movement in the general level of prices or, in the case of the pension credit guarantee credit, in line with earnings up to and including 2007–08. The higher levels at which the benefits may be paid to carers, and to those for whom they provide care, are part of the package of support available to severely disabled people and their carers. Further help, including means-tested domiciliary services or direct payments in lieu of such services, may be available from local authority social services departments.
