The department is working constructively with the General Medical Council (GMC) to determine the criteria to be applied before language testing, including what evidence European Union doctors would provide to demonstrate that they have the required language ability before testing would be required. It will also be for the GMC to determine what level of English language is necessary. There will be a public consultation on this policy during summer 2013.

We have made no such estimate. Based on its 2011-15 business plan, the National Institute for Health and Clinical Excellence (NICE) estimates the average cost for producing a piece of technology appraisal guidance to be £103,075. This is based on a budget allocation for its technology appraisals programme of £4,123,000 and the projected publication of 40 technology appraisals in 2011-12. NICE has not produced figures based on actual spend and outputs. In addition, academic support for the NICE appraisal programme is commissioned separately by the National Institute for Health Research.

The directive (2005/36/EC) on the recognition of professional qualifications sets out a system of automatic recognition of medical qualifications underpinned by common minimum standards of training for doctors. Article 21 requires the United Kingdom to recognise such medical qualifications obtained by European Economic Area doctors and to provide those doctors with the same access to the profession as UK doctors. Article 8 enables member states to undertake checks at the point of registration, to verify the doctor;s identity, the validity of their qualification and that they are in “good standing” with their home member state, but language capability is not a matter which is permitted to be checked at this point.
Article 53 of the directive states that “Persons benefiting from the recognition of professional qualifications shall have a knowledge of languages necessary for practising the profession in the host member state”. This implies that recognition has occurred before language testing is assessed and therefore language cannot be a pre-condition to registration. European Commission guidance on the directive makes it clear that the lack of language knowledge cannot be a ground for refusal of the recognition of qualifications.
Case law from the Court of Justice of the European Union makes it clear that systematic language testing is not permissible. Language requirements may be imposed for reasons of general interest but may only be applied in a proportionate way.
However, we recognise that there is considerable scope for strengthening the system of checks after the point of registration. We are evaluating options and will be making recommendations in due course.

In pursuit of the Government’s objective to strengthen the arrangements to ensure that all doctors practising in England have sufficient knowledge of English, we are exploring options to amend the Medical Act 1983. This is to strengthen the General Medical Council's (GMC’s) powers so that the GMC can undertake checks on language knowledge where legitimate concerns arise during the registration process about a doctor’s ability to communicate effectively, and before there is evidence of malpractice. The department is working constructively with the GMC, and we envisage that shortly we will be announcing further steps to develop the policy.
Systematic testing of language competence at the point of registration would not be lawful under European Law.
