Mr. Gordon Prentice: To ask the Chancellor of the Duchy of Lancaster what guidance is given to civil servants concerning information
which can properly be divulged under Chatham House rules. [50467]
Dr. David Clark: [holding answer 14 July 1998]:
There is no specific guidance. All civil servants are under a duty not to disclose, without authority, official information which
has been communicated in confidence within Government, or received in confidence from others. They must clear in advance material
for publication, broadcasts or other public discussion which draws on official information or experience. Any civil servant
participating in outside events--whether under the Chatham House rules or not--should confine their contribution to question of fact
and explanation of Government policy and actions.

Mr. Chaytor: To ask the Chancellor of the Duchy of Lancaster if he will make a statement on the impact of the proposals contained in
his Freedom of Information White Paper on commercial confidentiality within the nuclear industry. [48973]
Dr. David Clark: The Freedom of Information White Paper, Your Right to Know, set out our approach to freedom of information across a
wide range of public authorities, including nationalised industries, public corporations and non-departmental public bodies. The
White Paper also made it clear that commercial confidentiality is one of the proposed specified interests to which the substantial
harm test will be applied in determining whether information should be disclosed. I intend to publish a draft FOI Bill by the end of
September which will make clearer the exact coverage of the regime and its operation. However, at this stage it is not possible to
predict the effect that the proposals will have on one of the specified interests which a particular industry.

Mr. Gray: To ask the Chancellor of the Duchy of Lancaster what regulations govern the shareholdings of special advisers to prevent
cases of conflict of interest arising. [47938]
Dr. David Clark: Special Advisers--like all civil servants--are required under the terms and conditions of their employment to
declare to their department any business interests or shareholdings which they or members of their immediate family hold, which they
would be able to further as a result of their official position. They must not be involved in taking any decision which could affect
the value of their private investments, or the value of those on which they give advice to others; or use information acquired in
the course of their work to advance their private financial interests or those of others.

Mr. Viggers: To ask the Chancellor of the Duchy of Lancaster what assessment he has made of the arrangements for providing
information about changes in Civil Service pensions to the pensioners concerned; what representations he has received on this
matter; and what plans he has to change these procedures. [42278]
Dr. David Clark: Information provided to Civil Service pensioners is compliant with the requirements of The Occupational Pension
Schemes (Disclosure of Information) Regulations 1996. I am aware that a number of pensioners were regrettably notified late of their
increased rate of pension payable from April following the annual uprating exercise. Difficulties encountered by a contractor to
Paymaster (1836) Ltd, the paying agent, resulted in a failure to ensure timely notification in all cases. Payment of the pension at
the revised rate was, however, made to all pensioners on the due date.

Mr. Miller: To ask the Chancellor of the Duchy of Lancaster what steps he has taken to permit individuals to supply information
electronically to Government. [35827]
Dr. David Clark: I intend to publish later this year a White Paper on Better Government, which will set out in more detail ways in
which IT will enable individuals to supply information to the Government electronically. As a prelude to this, last December I
launched the Intelligent Form project, which converts what were once six paper forms on notification of self-employment into one
electronic form, and in so doing enables individuals to supply several departments with information simultaneously via the Internet.
