Mr. Hood: To ask the Secretary of State for Environment, Food and Rural Affairs what the outcome was of the Agriculture and
Fisheries Council on 14 March; what the Government's stance was on the issues discussed, including its voting record; and if
she will make a statement. [222546]
Margaret Beckett: My hon. Friend, the Parliamentary Secretary, and I represented the United Kingdom at the meeting of the
Agriculture and Fisheries Council in Brussels on 14 March 2005. Ministers responsible for fisheries and agriculture in
Northern Ireland and Scotland were also present.
The Council agreed a proposal concerning establishment of an EU Fisheries Control Agency, which the European Council had previously
agreed to sit in Spain. We were able to support a compromise proposal for commission representation on the Agency's administrative
board.
The Commission reported progress in negotiations with the Russian Federation to agree certain plant and animal health controls.
While the UK has not so far been among the member states most affected by Russian requirements, it was encouraging that progress was
being made to resolve the remaining differences.
The main item for discussion at this Council was Rural Development. The presidency focused discussion on a small number of issues in
the current proposal to revise the Rural Development Regulation, principally focussing on the LEADER reserve and inviting comments
on the Rural Development Strategy which it is planned to table in June. I reiterated the importance we attach to devoting at least
half of the financial resources under the Regulation to environmental work, expressed some doubt as to the level of the LEADER
reserve proposed and supported others in giving a general welcome to the likely shape of the strategy framework.
The Commission presented a progress report on implementation of the EU forestry strategy. Member states took note.
The Commission also presented proposals for EU measures to address market crises through new risk management techniques in the
industry. This was a brief presentation, with substantial discussion planned for later in the year. The Commission made it clear
that it opposed extending any kind of generalised safety net provision such as that found in the current beef regime. It also
indicated that the use of any modulated funds would only be possible in the context of rural development programmes and measures
that were compatible with the WTO Green Box.
Under Any Other Business, we raised the question of cetacean by catches and the need for greater protection of dolphins. The
Commission undertook to call for international research on the subject to be accelerated. Portugal drew attention to the
difficulties that prolonged drought had caused in its rural areas.
Over lunch, the Commission updated Ministers on the WTO agriculture negotiations. I welcomed recent progress and reminded the
Council of the importance of making progress in good time for the Hong Kong Ministerial in December.

for how long Phytophthora ramorum has been present in rhododendrons and related plants in this country. [130855]
Margaret Beckett: It is unlikely that we will be able to determine exactly how long Phytophthora ramorum has been present in
rhododendrons and related plants in this country. However, surveys are currently being conducted to establish how widespread the
disease is and this may give an indication of how long it has been present.
In addition, the literature has been reviewed for records of Phytophthora species on rhododendrons in the UK. The established
authority "Pathogens of Trees and Shrubs" by Pearce, published in 1963, states that at that time there was no evidence of any
Phytophthora on rhododendrons. The first record of a Phytophthora species on this host was in 1968. Phytophthora ramorum was first
described as a new species in October 2001 and first found in the UK in April 2002.

Mr. Lidington: To ask the Secretary of State for Environment, Food and Rural Affairs what study her Department has made into the
incidence of Phytophthora ramorum in wild-growing Rhododendron ponticum. [130852]
Margaret Beckett: In collaboration with the Forestry Commission, English Nature, and the Countryside Commission for Wales, Defra are
currently undertaking a survey of a sample of areas of wild-growing Rhododendron ponticum in order to establish the extent of the
presence of Phytophthora ramorum and the likely impact on our native flora. To date 56 such sites have been inspected for the
presence of the organism but it has been found on only two sites, both of which are in the area of an existing confirmed outbreak.

travellers, `Don't Bring Back More than You Bargained For', have been (a) published and (b) distributed; by what means the leaflets
were distributed to travellers; and when the most recent distribution was. [103755]
Margaret Beckett: 545,000 copies of the `Don't Bring Back More Than You Bargained For' leaflet have been printed.
In total 272,533 have been distributed to date, via various channels including: independent travel agents, travel retailers,
airlines, airports, GPs surgeries, dentists, NHS hospitals, post offices, health clinics/day hospitals, health education units,
public libraries, school/college/university libraries, Citizens Advice Bureaux, chemists, veterinary surgeries, environmental health
officers, law centres/solicitors and the general public.
Copies of the leaflet continue to be available on request from Defra publications.
Leaflets are not the only method we are using to get the message across, for example we are advertising on 7 million ticket wallets
for long haul destinations.

The Government have allocated £25 million over the three years commencing 2003-04 for work on illegal meat and plant imports. We
expect to announce very shortly how much of the available budget will transfer to HM Customs and Excise in 2003-04 to fund their new
responsibilities for anti-smuggling controls on animal and plant products.

Mr. Lidington: To ask the Secretary of State for Environment, Food and Rural Affairs when the transfer to Customs and Excise of
responsibility for port checks on the importing of plant and animal products will become effective. [88429]
Margaret Beckett: Responsibility for anti-smuggling controls of plant and animal products will pass to HM Customs and Excise as soon
as practicable, which we hope will mean by 1 April 2003. We are, however, currently discussing with Customs and other enforcement
agencies the legislative options for achieving this transfer and what, if any, transitional arrangements need to be made, before any
firm commitments on a date can be given.
Responsibility for port checks on plant and animal products imported legally will continue to lie respectively with the Plant Health
and Seeds Inspectorate and the official veterinary surgeons appointed by the relevant local or port health authority.

risk of sudden oak death in the United Kingdom. [61602]
Margaret Beckett: [holding answer 19 June 2002]:
"Phytophthora ramorum"--the causative organism of sudden oak death--is not established in the United Kingdom, but has recently been
detected on plants of viburnum and rhododendron in a targeted survey by the Plant Health and Seeds Inspectorate. Research is in
progress to establish whether the "Phytophthora ramorum" found in the United Kingdom exhibits the same pathogenicity as that causing
such serious damage in the USA and whether European tree species are susceptible to either the European or North American isolates.
This work is being carried out by the Central Science Laboratory and the Forestry Commission Research Agency.
Possible Community-wide measures are being considered and there has already been an exchange of information and some additional
survey work by member states. In the meantime, on the basis of a pest risk assessment, precautionary measures have been introduced
to prevent susceptible material being imported into the United Kingdom from affected areas of the USA and to allow plant health
inspectors to track commercial movements of host plants of any origin. Current controls on imported oak wood from the USA are also
being extended to include wood derived from all host trees originating in affected areas. Further information is available on the

Mr. Mitchell: To ask the President of the Council when the then Select Committee on European Legislation reported on proposals from
the European Commission to regulate the growing of genetically modified plants for research and sale, when such proposals were
considered in Standing Committee and on the Floor of the House; and what resolutions were passed. [72180]
Mrs. Beckett: The European Commission adopted a proposal in February 1998 to amend Council Directive 90/220/EEC. This Directive
establishes a system of controls which require prior consent from a Member State competent authority or any research and development
release of genetically modified organisms (GMOs). Approval at Community level is required before any product containing GMOs may be
placed on the Community market. The proposed amendment, which is contained in EC document 6378/98, COM(98)85 final, is currently
under negotiation. The Government submitted an explanatory memorandum on the proposal on 23 March 1998 which was considered by the
then Select Committee on European Legislation on 29 April 1998. The Committee reported that the proposal raised issues of political
importance but requested further information from the Government and did not clear it from scrutiny (26{th} report, 97-98, HC
155-xxv1). The Committee subsequently reconsidered the proposal on 9 December 1998 on the basis of further information provided by
the Government in a letter of 27 November 1998 from my right hon. Friend the Minister for the Environment. The Committee maintained
that the proposal raised issues of political importance and recommended that it should be debated in European Standing Committee A
(3{rd} report, 98-99 HC 34-iii). That debate has yet to take place but will be held in good time before any decisions are taken on
the proposed amendments by the Council of Ministers. An adjournment debate on the effect of Directive 90/220/EEC was held on 16
December 1998, Official Report, columns 927-33, my hon. Friend the Member for Norwich, North (Dr. Gibson).
