The Ministry of Justice (MoJ) was formed in May 2007. Information prior to 2007/08 can only be collated at disproportionate cost.
Of the 12 suppliers listed in the question, MoJ has incurred expenditure with the following six:
Figures above cover the Ministry of Justice HQ, HM Courts Service, HM Courts Service Estates and Tribunals Service in both years. The 2008/09 figures include the National Offender Management Service (NOMS) and the 2007/08 figures are for its predecessor agency, HM Prison Service. Both years’ figures exclude probation boards and trusts. Any expenditure incurred by headquarter functions transferred to MoJ from the Home Office are excluded up to November 2008 as expenditure is recorded on Home Office systems and can only be disaggregated at disproportionate cost. The Office of the Public Guardian (OPG) has used none of the companies mentioned.
Consultants are employed by the department to provide expertise for a defined period of time that is not available in-house.
* The majority of payments to Accenture relate to the development of the Libra, an electronic case management system that enables courts across England and Wales to work in a standard way, using a consistent approach to manage their criminal, accounting and enforcement workload. It also provides a platform to enable further improvements and modernise money handling in magistrates' courts. Having one system has also improved information exchange between the courts and criminal justice partners such the Police, the Driver and Vehicle Licensing Agency and the Office of Criminal Justice Reform. This has led to a reduction in duplication of work and has enhanced services to court users, improving scheduling and monitoring of cases.
** The payments to PriceWaterhouseCoopers include £3.8 million in respect of rent and service charge payments for offices and car parks in the Midlands.
How we monitor contracts with these firms
In relation to engagement of external professional services, the Ministry of Justice (MoJ) operates a robust "business case" approvals process based on Office of Government Commerce best practice principles. This process requires that a named Contract Manager be assigned by the business area concerned to each contract. Their role is to manage the day-to-day delivery and operation of the contract, for example by monitoring and ensuring the quality of all deliverables, monitoring spend against the pricing schedule and ensuring appropriate skills transfer (where applicable). The role of the Contract Manager is fully supported by the MoJ Procurement Directorate’s Professional Services category management team. Professionally qualified category managers are on hand to assist with and/or manage the resolution of any contractual issues throughout the life of the contract.
How the department reports (1) during, and (2) at the end of, contracts to Buying Solutions
MoJ works closely with the Office of Government Commerce (OGC), including its Buying Solutions agency, to ensure compliance with procurement best practice and to achieve best value for money outcomes. There is no specific requirement for departments to report to Buying Solutions during or at the end of contracts.
(1) In accordance with OGC best practice guidance, and taking into account the value and complexity of the specific contract, Contract Managers determine and implement the extent/frequency of their internal reporting process to their key stakeholders throughout the life of the contract.
(2) In relation to end of contract reporting, a key feature of the MoJ business case approvals process is a Post Contract Assessment phase. This requires that the person responsible for managing the contract (typically the Contract Manager) return a post contract assessment to the Professional Services category team within three weeks of the end of the contract. Aspects included are the extent to which key deliverables/expected benefits were met, the quality of the service, whether the contract was delivered to budget, whether and how skills transfer was achieved. A repository for the storing and analysis of post contract assessments is currently in the process of being devised and implemented.

My Lords, can the Minister clarify whether PSOs cover secure training centres, which come under the Prison Service and take children as young as 12? Several reports have shown an inordinate and unacceptable amount of restraint being used in those centres. There is a Prison Service order, PSO 4950, which covers juveniles, but I am not aware of one covering secure training centres.

So far as concerns the reports of the treatment of prisoners with disabilities—I think that she is referring to Parkhurst—that particular PSO is currently under review as part of the work following the publication of the NOMS single equality scheme. The review of the PSO predates the publication of the report on Parkhurst by Her Majesty’s inspector but is ongoing so that the issues raised by the inspector’s report can be taken into account during the review process.

My Lords, which official body writes and implements these Prison Service orders and how often are they reviewed? I have in mind the order concerning prisoners with disabilities, which on one occasion, following the unannounced visit by Her Majesty’s Inspectorate of Prisons, revealed that some disabled prisoners were unable to shower, one for more than a year.

No amount of time is specified. The core day, as the noble Baroness knows, was introduced in June 2008 and is intended to provide greater consistency in access to activities by ensuring that adequate staff are available at the times when activities are scheduled. The figures for 2008-09 show an increase of 2 per cent in physical education over the previous year. PSO 4275 is, as I understand it, an ordinary PSO, and if it is breached, the prison governor is accountable.

My Lords, does the Minister agree that giving prisoners one hour a day in the open air is a fairly uncontroversial basic entitlement? If he were imprisoned, which is quite unimaginable, would he not feel it reasonable to ask for at least one hour a day in which to breathe the fresh air? Prison Service Order 4275 requires that prisoners have time in the open air every day; yet the Chief Inspector of Prisons regularly reports that prisoners are sometimes out only twice a week, if that. So, is Prison Service Order 4275 an order? If not, what exactly is it?

At present the law relating to enforcement by the seizure and sale of goods is complex and is contained in numerous statutes, secondary legislation and common law that does not provide for a single cohesive process.
The Tribunals, Courts and Enforcement Act 2007 prescribes or enables regulations to prescribe the entire process to be followed by enforcement agents and includes provisions on the powers of entry.
Under the current contracts between Her Majesty's Courts Service and private bailiff companies there are specific requirements for the companies to report on the use of forced entry. These reporting procedures include the details of any complaints received by the bailiff companies on the actions taken when enforcing debt recovery. Any such complaints must be investigated thoroughly by the company itself. In addition, Her Majesty's Courts Service Regional Management will investigate the complaint to determine that the correct action was taken by the bailiff or if the situation requires further investigation.

The Environment Agency is the competent authority for the waste management licensing regime. However, waste collection authorities have powers to take action against illegal waste disposal or ““fly-tipping””. Under the voluntary fly-tipping protocol agreement, local authorities focus on the smaller incidents of illegal waste disposal whereas the Environment Agency deals with larger, more serious incidents.The Waste Management (England and Wales) Regulations 2006 will implement some provisions of the Waste Framework Directive (75/442/EEC as amended by 91/156/EEC).

In 2005–06, the first year of the scheme, the direct salary costs amounted to some £2,500,000.Indirect costs and management overhead costs are not separately defined.The estimated cost of monitoring by satellite remote sensing for 2005–06 is £364,000 excluding VAT.

The Rural Payments Agency (RPA) inspectorate used TAG (The Arable Group) to provide additional arable and environmental skills training to the inspectors prior to their undertaking single payment scheme and cross-compliance inspections.
