There are already explicit laws in place to protect children from maltreatment and these laws can be used against anyone who aids or abets abuse. Under Section 1 of the Children and Young Persons Act 1933, it is an offence for any adult with responsibility for a child to wilfully assault, ill-treat, neglect or abandon the child in a manner likely to cause him unnecessary suffering or injury to health, or to counsel or procure such suffering or injury. The maximum penalty on conviction of either offence is 10 years. It is also an offence for anyone to aid or abet someone who causes a child suffering or injury. A belief in ““spirit possession”” is relatively widespread, although abuse linked to such beliefs is rare. The Government published guidance for consultation on 2 February which aims to help local agencies to apply their general child protection procedures to such cases so as to most effectively safeguard and promote the welfare of the children involved.

The Department for Education and Skills does not record the numbers of teachers cautioned or convicted for child pornography or sexual abuse. The Home Office has data relating to the total number of individuals cautioned or convicted, though these are not broken down by profession.

My Lords, as I said, we hope to publish the report shortly, together with a full statement of government policy in response to it. The issues raised are very grave.
Eleanor Stobart, the independent consultant who wrote the report, held discussions with social workers, teachers, police officers, voluntary workers and others with knowledge of the subject. She also collected and examined reports of all cases known to have occurred since 2000. We have been working closely with the Churches’ Child Protection Advisory Service, which has great expertise in the area and includes the black Churches. It has produced best practice guidance on how to handle such issues. Its director, David Pearson, who is very highly regarded, is working closely with his member Churches to see that they have the expertise that they need to deal with these cases.

My Lords, I thank the Minister for his reply. I hope that the report will be published very soon; many of us look forward to it. How widespread has the consultation been in drafting the report? What long-term proposals do the Government have to continue the dialogue with African Churches in the UK to prevent those who are doing their ordinary job—doing it very well—being tarred with the same brush as some of the extreme sects that cause us so much concern?

My Lords, is the Minister aware that, of 40,000 allegations of child abuse made over the past five years in the Metropolitan Police area, 50 concerned allegations of witchcraft involving young African children? He said that the report is to be published very soon; can he give us some idea of whether ““very soon”” is within the next month or the next three months?

We have given support to the Churches’ Child Protection Advisory Service to develop its work, including publication, in conjunction with the Metropolitan Police, of its new guidance, Safe and Secure. That includes a helpline that can give support and advice in crisis situations to those dealing with ongoing protection concerns. It also gives safe practice guidance to protect children and young people from abuse and workers from false allegations. The Churches’ Child Protection Advisory Service has also held positive meetings with Congolese pastors, who have expressed a clear desire to work closely with the advisory service and us in child protection. For example, a child protection training event, run by the Churches’ Child Protection Advisory Service, was held in February and attended by no fewer than 230 Congolese pastors. We believe that we are making progress, but I do not minimise the gravity of the situation.

My Lords, it is important that communities and Churches made up of good and decent people are not vilified. There remain deep concerns about the treatment of a number of children. Does the DfES report look into claims that some children born in Britain are being sent to the Congo, ostensibly to live with relatives, where they end up in appalling conditions in some of the revivalist Churches? If we are to avoid vilification, we need to be sure of the facts. Also, what assistance and resources are being made available to the Churches’ Child Protection Advisory Service and the Metropolitan Police for training and education in child protection in the African Churches and other religious organisations?

Working Together to Safeguard Children, the Government’s core guidance on safeguarding and promoting the welfare of children, defines child abuse and neglect as inflicting harm or failing to act to prevent harm against a child. Child abuse may take the form of physical, emotional or sexual abuse. Neglect is the persistent failure to meet a child’s basic needs.The department collects statistics on referrals, assessments and children and young people on child protection registers (including the type of abuse, or neglect, of which they are judged to be at risk). However, the statistics do not include information on the numbers of children who have suffered serious child abuse at the hands of parents.

The Government’s guidance, Safeguarding Children in whom Illness is Fabricated or Induced (2002), focuses on children when there is a concern that the child is or is likely to suffer harm as a result of their carer inducing or fabricating illness. The key issue is the impact of fabricated or induced illness of the child’s health and development, and consideration of how best to safeguard the child’s welfare. The guidance emphasises the importance of carefully evaluating the child’s signs and symptoms of illness in order to understand the reasons for them and that professionals should be open to all possible explanations. The General Medical Council’s decision to strike Professor Sir Roy Meadow off the medical register related to him giving erroneous and misleading information in a criminal trial about the likelihood of two cot deaths in one family. It had no connection to the contents of the guidance on fabricated or induced illness. We therefore have no plans to amend the guidance.

The joint Chief Inspectors’ report recognises that there have been major developments in policy on children’s services but it raises a number of concerns, including the care of children in residential settings, all of which the Government are considering carefully and will respond to in due course.There is already much good practice. For example, the Chief Inspectors found that where guidance—in particular, the framework for the assessment of children in need and their families—is being used effectively for new placements to inform the care plan, the higher quality of information has led to better outcomes for these children.Residential care homes should have a statement of purpose—this should prevent potential perpetrators being placed with potential younger victims. Homes are also expected to have explicit processes to ensure that children are protected and positive behaviour is supported.Residential special schools are also required to have a statement of purpose and are subject to the national minimum standards. The standards cover admissions for example, schools are required to make reasonable efforts to obtain all necessary information about a child including about any matters that might make a child vulnerable or a danger to others. They are required to take account of the effects of a child’s admission on the existing group of children. A written placement plan is also required for each boarding pupil specifying how the school will care for the child in accordance with his/her assessed needs.The Government also recognise the importance and impact of a well-trained workforce on these issues. That is why the children’s workforce strategy, published by my department on 1 April 2005, made improving the recruitment and retention of social workers a key priority. The strategy commits the Government to looking at further measures to increase the supply of social workers and calls on local authorities to adopt best practice in recruitment, training and development, working practices, and leadership and supervision.
